Nicholas Krupski I�CQUNV Fax(631) 765-6641 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD June 21, 2017 Victor Prusinowski 533 Elton Street Riverhead, NY 11901 RE: DAVID SCHWARTZ 1015 LAKESIDE DRIVE NORTH, SOUTHOLD SCTM# 1000-90-4-5.1 ;r Dear Mr. Prusinowski: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, June 21, 2017: WHEREAS, VICTOR PRUSINOWSKI, on behalf of DAVID SCHWARTZ applied to the Southold Town Trustees for an Amendment to Wetland Permit#8876 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 1, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 4.1 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: that the project meets flood plan FEMA requirements, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 21, 2017, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit #8876 to modify the proposed pool and decking by constructing a proposed 544.7sq.ft. 2nd floor deck extension with stairs to pool deck onto the existing 447.1 sq.ft. 2nd floor deck; construct a 20'x28' infinity pool with a shallow water collection area and 12" pool border, and pool deck raised 6' above grade with associated steps to grade for a combined total of 1,516.2sq.ft.; install a proposed 7'4"x6'8" hot tub onto pool deck; and for a proposed 48.6sq.ft. raised equipment pad for pool equipment and generator; with the condition that only one 4' wide access path to the water be created and that there be minimal or no cutting of additional trees on the property; and as depicted on the site plan prepared by Robert I. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 4.1. Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The newly proposed raised deck and pool, generator, equipment location is within FEMA Flood Zone Elevation AE 6' and does not meet this policy. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. You did submit the dimensions of proposed pool in your amendment request. I am also having trouble finding the new location of the pool fencing. Please either come in to point it out or add it to the site plan. This proposed fencing cannot be placed within the established 50'wide non-disturbance buffer. This amendment application will go onto our June 21, 2017 public hearing meeting. Please have the proposed new deck, patio areas,and pool staked out for the Trustees June 13, 2017 field inspections.
