Box 488 Hampton Bays, NY 11946 RE: SAMUEL SINGER 44030 ROUTE 25, PECONIC SCTM# 1000-75-6-6.1 Dear Ms. Rigdon: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, March 22, 2017: WHEREAS, DKR Shores, Inc., on behalf of SAMUEL SINGER applied to the Southold Town Trustees for an Amendment to Wetland Permit#8893 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated February 10, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit#8893 to relocate the dock further to the north of previously approved location; and to construct a smaller dock consisting of a 4' wide landward fixed ramp up to a landward 4'x60' fixed dock section using Thru-Flow decking and supported by 4"x4" posts in vegetated areas; a seaward 4'x60' fixed dock section using Thru-Flow decking and supported by Monopile 3-pile (8"-9" diameter) ice-breaker pilings installed 12' on center; a 3'x20' adjustable ramp; and a 6'x20' floating dock secured in an "L" configuration; and as depicted on the site plan prepared by DKR Shores, Inc., dated January 25, 2017, and stamped approved on March 22, 2017. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) The modified proposal involves a change in the location of the proposed structure, northward along the subject property shoreline, and will result in a net reduction of over water coverage(approx. 144 square feet reduction of fixed dock structure)and a-reduced linear extension (of approx. 36 linear feet) over wetland and the Richmond Creek as compared to the originally submitted proposal. Depths for the floating dock portion are within Town Trustee, NYSDEC and USACE guidelines and there is no recognized Federal/New York State/Town channel contiguous to this site. • Scope: The proposed dock, in order to meet prevailing navigation standards for depth in this location in this un-dredged portion of the creek, where a dredge ban is in effect, shall extend approximately 136' water-ward of MHW for a creek nearly 500'wide in this location. Eleven other docks measured on "Google Earth" existing in this North-East branch of Richmond Creek appear to vary in length from approximately 50'to 170' offshore of MHW to meet similar standard depths. • Toxcity: To protect the headwaters of Richmond Creek where poor water exchange and circulation are considered a possibility, the dock shall be constructed entirely of non- toxic materials. • Scope in relation to the riparian rights of shellfishers: The plan revision provides for a piling separation of 12' per dock section, much more than the usual separation of 8'. The 3 pile system supporting each dock section is designed so as to nearly create a monopole that will provide for easier access for those boating and seeking shellfish and crustacea in season. The offshore waters in this location may offer limited mobility to users on foot due to silt and muds but would also be improved by the aforementioned spacing. The non-toxic wood pilings will actually increase net surface area available for the attachment of beneficial marine organisms while minimizing permanent bottom loss from pile coverage compared with a standard construction dock of similar length. There is insufficient loss of shell fishing access to justify extinguishing the riparian right to wharf out of the upland owner. The non-toxic attributes of this site potentially make it a prime location for cooperative shellfish aquaculture. • Scope in relation to small human powered water craft: The Creek seaward to its mouth is'slightly over one mile long and is sufficiently protected from high winds under ordinary conditions that it is ideal for small human powered water craft. A vessel traversing the East side of this creek from its mouth to and entirely around the proposed dock(and not returning)will be inconvenienced out of way approximately 5.2% of the entire trip. This is not considered significant. Any operator of a small water craft powered by hand should consider energy and food/water reserves to effectively deal with any emergency. Not unlike a motor or sail powered vessel a minimum reserve of 50% supplies/effort is minimal. • Environmental Upkeep: The dock design projects no pile replacement for 30 years or the need for bubbler system in the winter(used to protect against frost heave). The presence of such a system in the headwaters of a creek may upset the thermodynamic balance in winter and kill fish, shellfish and their larvae. We are not sure of the exact situation elsewhere but it seems that other shallow upland creek areas do not have much if any of this construction. If you allow this to be built you have then created an ever worsening precedent for longer and more inappropriately placed docks. . The board knows as well as we that these estuarial creeks silt in as their natural life cycle and the next thing is someone in this setting will start demanding public money for dredging. Coming to Southold and buying land on a shallow creekfront does not automatically entitle one to have the people and Town of Southold provide them with deep water boating. The planning board has a professional environmentalist, not a hired permit procurer, who has done a thorough and professional evaluation of this proposal as the LWRP(Local Wetland Revitalization Plan) Coordinator. As he states this action is located within: NYS Dept of State Significant Fish ;and Wildlife Habitat Area NYS Critical Environmental Area Peconic Estuary Critical Natural Resource Area His findings are that this proposal is INCONSISTENT with all the environmental guidelines including causing "barriers to fish migration which would have a major impact on fisheries in Richmond Creek, (NYDOS)" He also states that" it appears that the applicant is designing a dock to a large vessel (or vessels) rather than proposing the minimum structure necessary; and that the applicant has not demonstrated that the dock would not impair navigation of small watercraft and other vessels." Numerous kayakers use this creek constantly and probably have no idea what's going on here when what looks like a marina suddenly appears in this relatively pristine creek. He concludes that this placement of such a"dock structure in public trust lands and waters results in a net loss of public use of such land and water.(and he underlines the next) Due to the high ecological value of Richmond Creek, a seasonal mooring is a better option in this instance" All of these regulations were crafted by the State and Federal bodies with incredible effort, time and wide input, but you are the only body that can enforce them for those they were designed to benefit, the public of Southold Town and the wildlife of our waters. We are the owners of Bayside Farm, as well as the end of Indian Neck, the former Lappe farm, and Onabay Vineyards, Almost 200 acres in total. Although we do not abut the parcel under review, we have an interest in preserving the beauty and uniqueness of the area that encompasses the Eastern shore of Richmond Creek. Over the last 20 years, we have seen the continual degradation_.of`the Creek. Acres of marshland and eel grass have disappeared. The Eastern headwaters of,the Creek have served as a critical nursery for aquatic life including turtles. The Eastern shore of Richmond Creek is the last of the undeveloped shoreline for this large estuary. It is very unfortunate that the Town did not pursue protecting this important watershed parcel. While we understand Mr.,Silver's desire to make full use of his purchased property, the plans for development on the parcel are overscated and will overwhelm the fragile wetlands and uplands along the Creek. This is such an important site, that a thorough enviromental evaluation and your scrupulous oversite are warranted. Our old woods downshore along the creekbank and the wooded area on the proposed building site are important wildlife areas, and one of the few wooded areas left for miles....A bald eagle was sighted during a couple weeks in the fall. The back fields of Bayside Farm and the adjoining open space have been used for the prestigious Audubon Christmas Bird Count for decades with very impressive species counts. (51 Whether the dock will cause degradation of surface water quality and natural resources, All lumber is proposed to be treated with CCA in this ecological sensitive area and does not comply with Chapter 275 regulationscited below: L31 In order to prevent the release of metals and other contaminants into the wetlands and waters of Southold, the use of lumber pre-treated with any preservative,-including but not limited to chromated copper arsenate (also known as "CCA"), commercial copper quat(CCQ), Penta products, Alkaline Copper Quat(ACQ), or homemade wood preservatives is prohibited for use in sheathing and decking on structures in the wetlands as well as on any part of a structure in low tidal flow wetland areas as determined by the Trustees. The use of creosote is prohibited. i `t J The use of tropical hardwoods is prohibited unless it is certified by the Forest Stewardship Council or similar organization. Materials used for structural components shall be at the discretion of the Trustees. [Amended 12-18-2007 by L.L. No. 23-20071 The area is shallow and increased turbidity and/or bottom scarring may occur form vessel operations. As indicated above, the proposed action is located within a New York State Department of State Significant Fish and Wildlife Habitat Area, a New York State Critical Environmental Area and a Peconic Estuary Critical Natural Resource Area. [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The proposed action is located within a New�York State Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. Diamondback terrapin are vulnerable to disturbance by humans from April 1 through August 15. Nesting shorebirds inhabiting Richmond Creek and Beach are highly vulnerable to disturbance by humans, especially during the nesting and fledging period (March 15 through August 15). Significant pedestrian traffic or recreational vehicle use of the beach could easily eliminate the use of this site as a breeding area and should be minimized during this period. Recreational activities (e.g., boat and personal watercraft landing, off-road vehicle use, picnicking) in the vicinity of bird nesting areas should be minimized during this period. Predation of chicks and destruction of eggs or nests by unleashed pets (e.g., dogs, cats) and natural predators may also occur, and predator control should be implemented where feasible. Fencing and/or continued annual posting of shorebird nesting areas should be provided to help protect these species (NYSDOS). Alterations of tidal patterns in the marsh (e.g., by modifying the inlet) could have major impacts on the fish and wildlife species present. Construction of bulkheads, breakwaters, revetments, and other"hard" shoreline structures negatively impact tidal wetland habitats. Alternative strategies for the protection of shoreline property should be examined, including innovative, vegetation-based approaches. Control of invasive nuisance plant species, through a variety of means, may improve fish and wildlife species use of the area and enhance overall wetland values. Any activity that would substantially degrade the water quality of Richmond Creek would adversely affect the biological productivity of this area. All species of fish and wildlife are affected by water pollution, such as chemical contamination (including food chain effects as a result of bioaccumulation), oil spills, sedimentation, excessive turbidity, stormwater runoff, and waste disposal (including boat wastes). Impacts to water quality in the creek should be minimized or eliminated to enhance locally important shellfish and crustacean populations. Barriers to fish migration,whether physical or chemical would have a major impact on the fisheries in Richmond Creek. (NYSDOS) Unrestricted use of motorized vessels including personal watercraft in the protected, shallow waters of bays, harbors, and tidal creeks can have adverse effects on aquatic vegetation and fish and wildlife populations. (NYSDOS) [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass(Zosters marina) and widgeon grass (Ruppia maritima) or shellfish; There is a high probability that commercially valuable shellfish species occur in the proposed location of the dock structure. Bottom scarring is would be expected due to low water depths in the creek. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The construction method has not been identified. §275-11 Construction and operation standards requires that all intertidal construction and excavation employ the installation of a silt boom that will retain all suspended sediments within the immediate project area. [12]Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. The answer to this question has not been provided. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The placement of a private, residential 223' dock structure in public trust lands and/or waters results in a net loss of public use of such lands and water. Due to the high ecological value of Richmond Creek, a seasonal mooring is a better option in this instance.
