Horton, deceased, late of Mattltuok, Town of Southold Suffolk County, New York, o rty of the first part, and FRANK ® residing at Mettituok, Town of Southold, Suffolk County, New York, party of the second Dart. WITNESSETH; WHEREAS. by an order of Hon. Richard W. Hawkins, Surrogate of the County of Suffolk, granted and filed in said Surrogate's Office of the County of Suffolk on the 7th day of May, 1945, in a certain proceeding then pending entitled 'In the Matter of the Final Judicial Settlement of the Account of Proceedings of MINNIE D. HORTON, as Executrix of the Last Will and Testams nt of FRANK T. HORTON, Deoeased, and for the sale of the real property of the deoedent.N the party of the first part hereto was authorized and directed to convey the premises hereinafter described for the purpose of payment of debts, claims, funeral and administration expenses of the estate of said decedent, and for the additional purpose of complying with the provisions of the Last Will and Testament of decedent so that decedent's widow, the party of the first Part, might be provided with comfortable maintenance and sup- port, to the party of the second part, upon receipt by the party of the first part of the purchase price therefor, to Bit, the em of TWO THOUSAND ({2,000.00) DOLLARS; and WFC, a bond was dispensed with by the tome of said order for reasons specifically set forth therein; and WRIUMAS. the sale was duly made to the party of the second part pursuant to and in compliance with the Lerma prescribed by the said order of said Surrogate's Court; and BTA@, the said party of the first part has a of ee-14 6 mw Jt) valid right to convey the premises hereinafter described pur- suant to the provisions of the Last Will and Testament of said decedent and said party of the first part brought the proceeding above entitled and obtained the aforesaid order solely for the purposes of making a public record of the dis- position of said real estate; L, ' , by virtue of the authority in her Invented by the said proceedings and order of the Surrogate's Court of Suffolk County, and also by virtue of the power of sale granted to her in and by the Last Will and Testament of the above named decedent, and in consideration of the em of Two Thousand ({2,000.00) Dollars to her in hand paid by the party of the second part, the receipt whereof Is hereby so- knowledged, the party of the first part, Individually and as said executrix of the Last Will and Testament of Frank T. Horton, deceased, does hereby grant and release unto the party of the second part, his hairs and assigns forever: ALL that tract or parcel of land, with the Improve- ments thereon, situate in the Village of Hattituck, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: On the north by the land of Harry DePetris; on the east by the Highway (Main Road); on the south by the land of Mrs. Maggie Doran Gildersleeve (form- erly of Wlllisl A. Overton); and on the west by the lands of Joseph Sontag and Leroy Hallock, containing by estimation about one-fourth (1/4) of an son, more or less.
