SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 6, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 16,753 sq. ft. waterfront parcel located in R-40 Zoning District. The parcel has a wood bulkhead adjacent to Arshamomogue Pond measuring 118.25 feet to the west, fronts Bayview Avenue along the easterly property line measuring 85.00 feet and along the northerly property line measuring 187.72 feet. The southerly property measures 201.44 feet adjacent to residential property. The parcel is improved with a two story frame single family dwelling with attached wood deck and garage. As shown on a site plan prepared by Frank W. Uellendahl, R.A., dated August 18, 2016. BA81S OF APPLICATION: Request for Variance(s) from Article III, Section 280-15 F and the Building Inspector's June 21, 2016, Amended August 18, 2016 Notice of Disapproval based on an application for a building permit to construct an accessory shed, at; 1) proposed accessory shed located at less than the code-required minimum front yard setback of 35 feet; located at: 2345 Bayview Avenue, (adj. to Hashamonuck Pond), Southold, NY. SCTM#1000-52-5-1. RELIEF REQUESTED: The applicant requests a variance to construct an 8 foot by 10 foot (80 sq. ft.) accessory storage shed in the front yard having a front yard setback of five feet from Bayview Avenue and five feet from the side yard property line, where the code requires a minimum front yard setback of 35 feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 3, 2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property Page 2, November 17, 2016 #6999, Byrne SUM No. 1000-52-5-1 and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law.X267-1b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel is a non-conforming 16,753 square foot waterfront lot in an R-40 Zone District with two front yards, located at the dead end of the street. Only one other neighbor, across the street, will see the proposed shed. Many other homes on the waterfront side of this street have accessory structures, with non-conforming setbacks, located in their front yards. The proposed shed will be well screened from the adjacent neighbor by an existing mature hedgerow. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Locating the shed in the rear yard would position the structure closer to the Bay, which would not be desirable. The property is trapezoidal in shape and increasing the prosed front yard setback will position the proposed shed closer to the side yard property line and block access to the existing attached garage. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 85% relief from the zoning code. However, the adjacent neighbor has an accessory garage with a front yard setback that is closer to the road than what the applicant proposes for an 80 sq. ft. shed, and accessory sheds in front yards are typical of this neighborhood 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code 5. Town Law _4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant the requested relief is the minimum action necessary and adequate, to enable the applicant to enjoy the benefit of an accessory storage building in the front yard area while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer and seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the Site Plan prepared by Frank Uellendahl, Architect, dated August 17, 2016 and detailed plans(A-1)prepared by E. S. Kalogeras, P. E. dated January 12, 2004. SUBJECT TO THE FOLLOWING CONDITION: 1. The accessory storage shed shall have no electricity or plumbing installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. TOWN CODE CHAPTER 268 LWRP DETERMINATION (Exempt): The second-story is over an existing first floor area of a dwelling, exempt as a minor action. It is also noted that a major portion of the second-floor additions is beyond the 75 ft. zoning code setback restriction of the bulkhead, and therefore not subject to jurisdiction of the Zoning Board of Appeals. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 31, 2007, at which time written and oral evidence were presented. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment'to nearby properties. The proposed second floor addition will be on the north side of the house above the existing dwelling, which has a pre-existing non-conforming front yard setback along Bayview Avenue extension dead ends at Arshamomaque Pond, providing water access to owners. There are no neighbors to the north,and the proposed addition is similar to other second floor additions in the neighborhood along Rausch Lane and Bayview Avenue. The proposed deck extensions replace and modestly enlarge an existing deck in the rear yard where there is privacy from the streets and neighbors. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the buildable area on this oddly shaped lot with two front yards is very limited. 3. The variances granted herein are not substantial. The proposed lot coverage will be under 14%, including the decks.The proposed side yard setback for the new deck reduces the existing setback from 6' to 4.5' but only on a small portion on the southern corner. This small deck extension is necessary because the existing garage, which is above grade, will be converted to a first floor fitness room with an exterior door providing access to the rear yard. The setbacks from the bulkhead vary from conforming at 75'to 73'and 60'to the pre- eAsting bulkhead stairs. 4. The difficulty has*not been self-created but is the result of the siting of the existing house on an oddly shaped lot with two front yards. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of new deck construction and a second floor addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on the 5/30/2007 site plan drawing A-1 B and 4/20/2007 elevation drawing A-3,prepared by Frank Uellendahl,Architect. Any deviation from the variance given such as extensions,or demolitions which are not shown on the applicant's diagrams or survey site maps,are not authorized under this application when involving nonconformities under the zoning code.
