Chapter 97 of the Town Wetlands code, Section 12 specifies the setbacks from wetlands.
The minimum setbacks are as follows:
(a) Residence—one hundred (100) feet from the wetland boundary
(b) Driveway—fifty(50)feet
(c) Sanitary,leaching pool (cesspool)—one hundred(100) feet
(d) Septic tank—seventy five(75) feet
The Board of Trustees on their site inspection of November 15, 2004 determined that the
wetlands would make you unable to construct with these setbacks.

With regard to the above-referenced property, this is to confirm that on Monday,
November 15, 2004, the Board of Trustees met with you at the site for a pre-submission
inspection to discuss the proposed construction of a single-family dwelling.
As discussed with you at the site, the Board of Trustees determined that both the location
and amount of wetlands on the property makes it difficult to obtain the proper setbacks, as
described in Chapter 97 of the Town Wetlands Code,to construct a dwelling and sanitary
system.

Madeleine is dead ( June 1,1992). and we have inherited the property by her will. Her death was in Maryland but we paid
death taxes to New York. Our lawyer at the time Pete Lundberg said we did not need to change the name on the
property and we have since sold a lot without a problem.
