SCTM# 1000-106-1-2.1 Dear Mr. Herrmann: The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft Corwin, III, Land Surveyor, last dated October 10, 20.15,-and the site plan prepared by Carmen Lenzi, Architect, dated September 22, 2016, and performed a field inspection on October 13, 2016,, and determined that the proposed construction of a swimming pool, tennis court, and related construction activities are out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore,-in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no Trustee permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Pursuant to §111-8 and §275- 3(C), all of the proposed activities are thus located beyond the jurisdiction of the Board of Trustees. Therefore, I am writing to respectfully request that you issue a"Letter of Non-Jurisdiction" stating that no permit is required for the project pursuant to Chapter 111 or Chapter 275 of the Southold Town Code. In support of our request, I have enclosed two (2) copies of the above referenced survey/site plan; recent site photographs; a check payable to the Town of Southold for $50; and letters signed by the property owners providing authorization for En-Consultants to act on their behalf and for the Trustees to access their property.
