The Trustees detailed field inspection of January 16, 2016 with Trimble's Nursery present and the Trustee Clerk's communication to Trimble's Nursery on my behalf on Aprit,28, 2016, should have gone a long way toward the corrections needed. Communications with Trimble's Nursery were inconclusive and there was no substantive dialogue following the April 28, 2016 e-mail. Herei is a comprehensive list of the items needed to secure a wetland permit. 01 Please have your surveyor label the area to the left of the Trustee's flagged wetland line as "non-disturbance wetland area". 0 The shaded region labeled "10' wide wetlands buffer" should be labeled "10' wide r non-turf wetland buffer". --Once a wetland permit is approved by the Trustees according to the corrected N survey a restrictive covenant will need to be filed with the Suffolk County Clerk in accordance with Trustee procedures to create a record future owners will be G advised of at closing. You may wish to secure legal assistance to effectuate this voll filing. The planting plan of Trimble's Nursery dated November 2015, unnecessarily places plants inside the restricted wetland area. To simplify permitting matters You may restrict your restoration planting to the 10' wide non-turf wetland buffer" Tgq W I,UoCAt4G- Wait- Tkukfte:_2 A6*hl. 1 X6/27/2016 12:54 63r `,6641 SOUTHOLD TFC .ES PAGE 02/02 outlined above using only native plants. Any of the plants listed in Trimble's Nursery plan are acceptable_ The plan need not be formal or the work of a landscape architect. Wetland shrubs such as blueberries and bayberries or similar in a staggered row X-5' apart should be fine, It is required that wood chip or similar mulch be used on all areas of barren soil and beneath the restoration plantings. We highly recommend that a low profile barrier such as an "open" split rail fence be located at the flagged wetland boundary and that some form of edging or landscape ties be installed at the edge of the lawn where it meets the non-turf rL. = buffer so that lawn maintenance personnel will honor these restrictive zones automatically and avoid the potential of any further violation. It is okay to remove the invasive bamboo during the restoration. If identified s a slow growing variety by a plant professional, you may maintain it pruned from expanding into the "non-disturbance wetland area". If still in this area, please remove the boat. tVOgKtMG®nl 17- All stumps, stacked firewood and dead fallen trees may be carefully removed b hand (no heavy equipment) during the restoration. iUtCu —aa jT y G . 9. If you want to remove any invasive black locust trees as part of the permit, please request this in writing. 10. After receiving your permit and upon completion of the project it is likely that one or more compliance inspection(s) will be required. We request that all required materials be submitted to this office by July 9, 2015 so that we may act upon your application at our July 20, 2016 regular monthly meeting. With all due respect, Mr. Bredemeyer, if you're a"bit"disappointed with not concluding this matter by now,I'm actually"shocked" it isn't. In your second paragraph which outlines dates of certain transactions that took place between Trustees,Trimbles, and me,the most critical date was omitted. On November 30, 2015,1 paid for and submitted The Application that I was asked to produce. I did. No one ever acknowledged it to this day. The wheels of progress didn't start until January 16,2016, as you mentioned in your letter. I would say there was a fair amount of time that lapsed between my Application and when the Trustees visited my property. With regard to Trimble, It was inconclusive because a landscape architect was to be summoned. She is a horticulturist. It's just now in your letter of June 27`h,do I learn that"the plan need not be formal or the work of a landscape architect." And, by the way,I'm very grateful to you that I did not have to employ the services of a landscape architect just to do some indigenous plantings. Thank you. Should I sell the property, the new owner would be informed of this restricted area by virtue of the survey. No? And, by the way, how come there was no restrictive covenant filed with the Suffolk County Clerk when I purchased the house? No township authorities,Trustees, or anyone informed me of this? It wasn't until I received the summons from Officer O'Leary that I became aware of wetlands. By the way,Off.O'Leary's survey never clearly indicated the section that was wetlands or contained the verbiage about it being"non-turf wetlands buffer either." Points 4, 5 &6—fine. Point 7—Bamboo will be removed. Point 8—Already in the process of being done. I have a problem complying with all of these details by July 9t' Today is the 28`"of June. You're asking me to produce this stuff in literally 7 working days. I can't do it. Are you and the other Trustees aware that I also have another court date scheduled for September 12,2016? With all due respect, Mr.Bredemeyer, I may be at fault in some capacity, but I truly believe the culpability of delaying this project rests more with the Town of Southold than it does me. Rehren 155 Breakwater Road Mattituck, NY 11952 RE: 155 BREAKWATER ROAD, MATTITUCK SCTM#: 1000-113-3-4 Dear Ms. Rehren: I am a bit disappointed we have not been able to conclude this matter by now. The Trustees detailed field inspection of January 16, 2016 with Trimble's Nursery present and the Trustee Clerk's communication to Trimble's Nursery on my behalf on April 28, 2016, should have gone a long way toward the corrections needed. Communications with Trimble's Nursery were inconclusive and there was no substantive dialogue following the April 28, 2016 e-mail. Here is a comprehensive list of the items needed to secure a wetland permit. 1. Please have your surveyor label the area to the left of the Trustee's flagged wetland line as "non-disturbance wetland area". 2. The shaded region labeled "10' wide wetlands buffer" should be labeled "10' wide non-turf wetland buffer". 3. Once a wetland permit is approved by the Trustees according to the corrected survey a restrictive covenant will need to be filed with the Suffolk County Clerk in accordance with Trustee procedures to create a record future owners will be advised of at closing. You may wish to secure-legal assistance to effectuate this filing. 4. The planting plan of Trimble's Nursery dated November 2015, unnecessarily places plants inside the restricted wetland area. To simplify permitting matters you may restrict your restoration planting to the 10' wide non-turf wetland buffer" outlined above using only native plants. Any of the plants listed in Trimble's Nursery plan are acceptable. The plan need not be formal or the work of a landscape architect. Wetland shrubs such as blueberries and bayberries or similar in a staggered row 3'-5' apart should be fine. 5. It is required that wood chip or similar mulch be used on all areas of barren soil and beneath the restoration plantings. 6. We highly recommend that a low profile barrier such as an "open" split rail fence be located at the flagged wetland boundary and that some form of edging or landscape ties be installed at the edge of the lawn where it meets the non-turf buffer so that lawn maintenance personnel will honor these restrictive zones automatically and avoid the potential of any further violation. 7. It is okay to remove the invasive bamboo during the restoration. If identified as a slow growing variety by a plant professional, you may maintain it pruned from expanding into the "non-disturbance wetland area". If still in this area, please remove the boat. 8. All stumps, stacked firewood and dead fallen trees may be carefully removed by hand (no heavy equipment) during the restoration. Please do not hesitate to contact me if you have any questions. Thank you for your cooperation in this matter. Very truly yours, ohn M. Mr. Bredemeyer felt that it would be the easiest to get a copy of the updated/latest licensed survey and use that to develop your plan that should also show the wetland boundary as flagged by the Board of Trustees on 1/21/16. Using the wetland boundary, areas"waterward" inside the wetland is a "non-disturbance area" and should be labeled as such. The area from the wetland boundary and immediately 10 feet landward is to be"non-turf buffer" and should be shaded and labeled as such. The use of mulch is ok to use in the non-turf area and portion of the non-disturbance area with bare soils. Box 1179 Southold, NY 11971 Re: 155 Breakwater Rd. Mattituck, NY 11952 Dear Sir/Madam: On September 6,2015, 1 received a summons from Officer Joseph O'Leary against the above property for clearing a tree within 100ft.of wetlands without first obtaining a trustee permit. It is a fact that I cleared the tree. However, I would appreciate you knowing that I had no idea it was within wetlands. Nothing in my deed;contract of sale indicated such. Nor did my broker at the time of sale mention anything about wetlands to me. In my ignorance, I removed the tree because of these reasons: - The tree's roots were well above the ground as the tree itself leaned directly toward my deck. I was fearful that if we have another"Sandy"there goes the deck and side of house. - The tree was totally embraced with poison ivy. I was also trying to keep the tick population down,as my husband got a tick and my dog had 3 ticks in him. - FYI -I do employ an "organic" pest control company for my grounds on Breakwater Rd. Had I known this section was wetlands, I would not have requested my landscaper to take it down in spite of the conditions I listed above. I would have gone directly to the Board of Trustees and requested permission to do so with permit in hand. Please know that I have another home located at the above address in Douglaston, NY. My property is partially on Udalls Cove(also a designated wetland area.) I have nothing but the utmost respect for this privilege and would never jeopardize the area by removing anything from it. I'm privileged to hear and see the beautiful songbirds that come to visit, along with the red-tailed hawk who perches on a huge oak tree outside my window, as well as our red fox who occasionally treats us to a show while he suns himself on one of our steps in the backyard. I would hope that you could be understanding of my situation and be lenient with the summons, and I would ask,(now that I know)if the Board of Trustees could assist me in removing some of the debris that exists because of the downed tree. Please see attached a few photos I took to indicate exactly where and what I did. And I apologize for having done something on wetlands, but I honestly didn't know it was. Didn't even know it was on wetlands. Nor did I understand`that I was to have a permit from the Trustees to remove, replace, or do anything on my property without Trustee permission. Now that I know and going forward, I am hereby requesting permission to plant the attached diagram of indigenous plants, shrubs, perennials, and grasses that were landscape designed by Trimble's of Corchaug Nursery. In addition I am also requesting approval to remove the remains of the tree I innocently took down. Please know you have permission from me to go to my property and see where these specimens will be planted. In the meantime, I hope you will see that I am trying to do the right thing. Thanking you in advance, I remain, Barbara A. Rehren Owner Enclosures T'RIMBLE'S OF CURCHAUG NURSER`' 20985 Main Road,Cutchogue,NewYork 11935 • 631 734 6494 Plant List for Wetlands Planting .
