The issuance of an Administrative Permit allows for the operations as indicated on the project plan prepared by Marijo Adimey, received on October 18, 2016, and stamped approved on October 19, 2016. Special Conditions: The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. Inspections: Final Inspection. If the proposed activities do not meet the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Permit will be required. Easement September 10, 2016 Christopher Nuzzi 525 Clark Road Southold,New York 11971 Re: Clark Road Easement Mr.Nuzzi, Please allow this correspondence to memorialize our conversations of earlier this week and to properly place you(and all other interested parties to the Clark Road Easement) on notice of our position with respect to the right of way in question, and our objection to the prior placement of the survey stakes onto our property, any future placement of a fence or structure thereon, and any future trespassing onto our property. As you are aware, the recorded deed for the right of way of which you have interest describes the easterly portion of the right of way as extending "to the land of McDonald" (attached hereto), not onto the land of McDonald. As you are also aware, our surveyor Nathan Corwin staked our property in accordance with not only the recorded deed and title of our property, which we purchased from the McDonalds, but with the recorded deed and title to the right of way. All of these documents are consistent with the survey done by Nathan Corwin. Approximately one month ago, you retained Peconic Surveyors to survey and stake the property in accordance with that same deed however, the easterly line of the easement was placed onto our property-not up to our property as the deed calls for. As we discussed, it is our position that the survey was improperly created based upon an erroneous reading of the deed to the right of way. As stated in our conference call with you, me, our title attorney and title President, we do not dispute that the easement in question exists and is located to the west of our property line. The width of the easement may be in question since the description in the easement refers to a distance that is "more or less" and is bounded by the westerly land of land of McDonald. As you are certainly aware however, the monumented boundary line of the land of McDonald would control over the distance recited in the easement. It is our understanding that you have, or will be, applying for a permit to erect a fence on what you purport to be the easterly property line of the right of way. Our title company has conducted extensive research into the records of the deed and title to the right of way from the Clarks to all interested parties. Moreover, we have retained counsel to do their own research, review the documents in question, and advise as to any support for the survey performed by Peconic. All have concluded that the Peconic survey is incorrect and based upon an erroneous reading of the easement deed. In addition, they have concluded that there exists no recorded document to support the easterly portion of the easement onto our property as per the Peconic survey. As such, you have no interest in any of the property east of that staked by our surveyor. Once that conclusion was made, ' we advised the Trustee's Office, Buildings Department, Town Attorney and Suffolk PD as to this dispute so there is no issue going forward. Please be on notice that if and until you are able to produce documentation that establishes a right of way onto our property—not up to our property---any I attempt to place any structure on our property will be considered trespassing and support a claim for property damage. Furthermore, anyone who crosses onto our property will be considered to be trespassing and we will be forced to contact the SPD. I reiterate to you what our title company and title attorney stated in our conference call: if you are in possession of a lawful,properly recorded deed that establishes a right of way onto our property, we will_gladly have our title company examine it. You advised us;on Wednesday that you would forward to us any documentation to the contrary. In addition, we have asked for a copy of your title to see if it is in accordance with the deeds. Finally, I reached out to you yesterday to see if you had.any documents to send over. We have not received any response from you and will not wait indefinitely in order for this issue to be resolved. Until such time as there is proof submitted in contradiction to the recorded deed to the easement and property, we will continue to use, enjoy and develop our property in accordance with our deed, title and survey and will assume nothing to the contrary going forward. Finally, I have spoken with our electrician regarding the underground electrical wiring that was placed 1.5 inches onto the easement near the garage, for approximately three feet. He will be correcting that as soon as possible. j I I am certain that we will be able to come to a resolution with respect to this matter in an amicable way. We do not wish to make this into a contentious issue; to the contrary, we would like a harmonious relationship with all of our neighbors. I am certain that Peconic and your title company will realize the error, and that Peconic will amend their survey. Prior to purchasing this home, we had the property surveyed in accordance with the deed and title, and we had stakes placed so that eventually we could place a fence or shrubbery. Adjacent to our property on the westerly border is a pedestrian right of way that belongs to several home owners on Clark Road. Last month one of the property owners who recently been moved onto Clark Rd, Christopher Nuzzi,had the right of way surveyed and staked by a different surveyor. When he did, a significant portion of the right away was staked onto our rop pertX. Mr.Nuzzi's survey is inconsistent with ours. Mr.Nuzzi approached our contractor (Shawn Kruk of Absolute Improvement), who was doing work on our property, screaming for him to "get off his right of way" and that they intended on erecting a fence along the right of way, onto our property. I contacted my title company and title attorney and they have reviewed all deeds and title documents relating not only to our own property, but the deeds and titles to the right of way. They are 100% certain that the right of way does not run over our property, but up to our property and is described as such in all documents. In an effort to resolve this amicably, my title company president, title company attorney and I had a conference call with Mr. Nuzzi wherein we explained the language in the deed that states the right of way runs "To the land of our property, and not over our property. We advised Mr. Nuzzi that although we did a search of all deeds and title in the Records office and found nothing to the contrary, we would be more than happy to review any documents he had that was to the contrary. So far, he has produced nothing. More importantly,we advised Mr.Nuzzi that until the issue is resolved, he should NOT erect any structure on the right of way nor should he or any other resident of Clark Road trespass onto our property. I am writing to the Town on the advice of our title company and contractor so that if an application is made by a Clark Road resident to erect a fence, that application is denied. We have all documentation to evidence that the meets and bounds of our property indicate that the right of way goes up to the land of our property, not onto our property. Until the Clark Road residents produce evidence to the contrary, we will continue to use, enjoy and improve our property in accordance with our deed, title and survey, including the placement of trees and/or fencing upon receipt of the applicable permit. i Moreover, if any of these residents erect a structure or trespass on our property, we will contact Chief Flatley and the SPD for immediate assistance.
