After the bulkhead was destroyed during Hurricane Sandy, the NYSDEC issued an emergency permit for its replacement(copy attached). After later being approached by a salesman, however, Mrs. Chisholm was talked into proposing"HESCO barriers" in place of the destroyed bulkhead and obtained a permit from the Trustees accordingly. That permit presently remains valid through June 19, 2017. Because Mrs. Chisholm could not finance the installation of the bulkhead or the stone baskets at the time, however, she unfortunately had to delay taking any action to restore her property until now. The DEC has indicated to me verbally that because of the historically existing nature of the bulkhead and the bulkheaded nature of the surrounding shorelines, they would issue a permit for its reconstruction presently. In fact, had their 2013 approval been issued as a standard permit rather than as an emergency permit, that permit would still be valid. The Army Corps of Engineers has similarly indicated that the bulkhead may be reconstructed presently pursuant to their Nationwide General Permit No. 3,which allows for the in-place reconstruction of a historically existing shoreline structure destroyed during a storm event. See below email from Randy Piersol of the New York District: -----Original Message----- From:Piersol, Randy T NAN Sent: Thursday, October 13,2016 3:00 PM To:Robert Herrmann Subject:RE:[EXTERNAL]Hurricane Sandy/NW#3 question Robert, based on the information you attached to this email, in my review of the documents you have proven the existence and location of the historic bulkhead, prior to super storm sandy. As per our Nationwide Permit#3, the homeowner may proceed without any further notice or documentation from the Corps of Engineers provided they follow the permit specifications and regional conditions. Thank you. Randy Piersol The only other regulatory hurdle for Mrs. Chisholm is the modification of her Trustees permit to authorize reconstruction of a bulkhead rather than installation of the previously approved HESCO baskets. With installation of either device, the effect will be the re-hardening of the subject shoreline in the same location as the prior bulkhead and backfilling of the property,so really the only question before for the Board is which is the more appropriate structure to install, a traditional bulkhead or HESCO baskets. I have attached a picture of HESCO baskets, which occupy a much larger footprint than a bulkhead; are unsightly; and if installed would be the only such installation along the neighboring shoreline. Further, they are not to my knowledge engineered for long term erosion control purposes and designed to protect residential homes from intense beach erosion during avulsive storm events like Hurricane Sandy. Rather, in addition to other military installations, it appears they are engineered primarily for flood control, e.g., holding back the flood waters of a rising river. They are essentially steel mesh baskets filled with sand, gravel, or rock that sit on existing beach grade and have no below grade penetration. Therefore, unlike vertically driven bulkhead sheathing, if the beach 1 grade elevation drops over time o '.n re is reflective scour at the base of the wan mat occurs during a storm, the baskets have no sub-grade penetration to protect their integrity. In short, I don't believe these baskets are a desirable or effective solution as a shoreline protection structure in place of a traditionally constructed bulkhead at this location. Rather, like all the other bayfront homeowners who were permitted to reconstruct their legally preexisting bulkheads that were damaged or destroyed during Hurricane Sandy, I believe that Mrs. Chisholm should be granted the same right and should not be effectively punished for having been talked into a bad deal or not having had the finances to replace her shoreline protection structure three years ago. By twice renewing her permit, she has maintained her intent to proceed with restoring her shoreline protection, so I believe the Board should allow her to do so in a manner that will be effective rather than forcing her to pursue installation of the HESCO baskets, which upon failure would place both her dwelling and property and her neighbors' dwellings and property at serious risk of flood and erosion damage during the next major storm event. Finally, with respect to how the application is being processed, you will recall that after you suggested that the amendment request could be processed administratively, I asked you to confirm that with Jay because I did not want to risk having the application tabled at the October meeting. Mrs. Chisholm is anxious to start work as soon as we can complete the permit process, and the recent destruction caused to the Southeast coastline during Hurricane Matthew has only increased her anxiety about her home remaining unprotected any longer. Therefore, it is my sincere hope that given the above information and circumstances that the Board will see fit to approve the modification request as applied for. Please call me to discuss further as needed. Box 1179 0 Southold,NY 11971 Re: 18975 Soundview Avenue,LLC, 18975 Soundview Avenue, Southold(1000-51-1-16) Dear Mr. Bredemeyer: As you know, several months ago we filed an application for an Administrative Wetlands Permit to authorize installation of a permanent pool enclosure fence in place of an existing wire pool fence that did not meet the standards necessary to pass the Building Department's inspection of the previously permitted swimming pool. And as a result of your review of our application, the Board identified several issues relating to existing structures on the property that you wished us to resolve in connection with our application for the pool fence. To that end and pursuant to my communications with you in July, we wish to amend our application to include the permitting of the existing bluff stairway and to address the following items, all of which are depicted on the enclosed survey/site plan prepared by Nathan Taft Corwin Land Surveyor, last dated September 8,2016: Jl) The most seaward 8' wide, approximately 335 sf section of existing pool patio shall be removed; '2) The location of the proposed pool enclosure fence has been modified to match the reduced patio; ,J 3) The existing plastic fence that runs along the bluff crest is to be relocated to a 10' setback from the bluff crest; ,/4) A 10' wide nonturf buffer shall be established in place of existing lawn adjacent to the bluff crest; and ,15) The area of a previously existing wood deck adjacent to the bluff crest shall be removed and restored with native vegetation. As a result of these plan modifications, the project description has been revised as described below. Please note that I have also included the preexisting swimming pool in the project description if the Board feels that it is appropriate to include it, although it was constructed 1319 North Sea Road I Southampton,New York 11968 1 p 631283 6360 1 f 631.283 6136 www.enconsultants.com environmental consulting 1 J \ prior to the Board having jurisdiction within 100 feet of the bluff. In the short term,we would like to get a code-compliant pool fence installed that will enable the Building Department to close out and C/O what is now a nearly 40-year old open building permit my office recently renewed for a swimming pool that has been in place since the late 1970s. When Gary inspected the property prior to his retirement, the inspection failed only due to insufficient fencing and an unpermitted carport on the side of the house, which has since been approved. We understand that independent of the issue of correcting the pool fence,we have other items that must be addressed with the Trustees and plan to do so. But if we can get this matter resolved with your Department first, that would be ideal. Please let me know how we may proceed. While the Trustees continue the review of the application for a permit for permanent compliant fencing surrounding the existing swimming pool,we have no objection to suitable temporary-security fencing being installed on this site during the pendency of our review which may take some time. Thank-you for your cooperation in this matter. It looks like there's a dashed rectangle matching the current pool location, but I can't read what it says—does it say"existing pool?" Maybe they were proposing to move a then-existing pool to a different location? Or did Building issue a permit for a pool that was already there, which is where it remains today? Unfortunately I have no way of knowing, but we have a dated aerial photograph showing the pool where it is now in 1976. I've attached that aerial, which appears to reflect what's on the old survey. Again, either way, I don't think the pool itself should create an issue for the Trustees since it was clearly in existence (and permitted by the Building Department) long before the Trustees' had jurisdiction landward of the bluff. So unless the Building Department has an issue with the pool location, I would think that the Trustees could simply issue a permit for the fence. I assume the Trustees (or you)will inquire with Building to confirm one way or the other? I can also call Sue. Always fun trying to interpret what happened almost 40 years ago with minimal documentation. Diane From: Robert Herrmann [mailto:rherrmannCcbenconsultants.com] Sent: Friday, June 17, 2016 12:34 PM To: DiSalvo, Diane Subject: RE: Christopher Moore Diane, the Trustees didn't have jurisdiction landward of the bluff in 1978, so no Wetlands Permit was required at the time the Building Permit was issued and the pool installed. However, because they now have jurisdiction within 100 feet of the bluff,we need their permission to install the new pool enclosure fence. With respect to the "paper trail," I'm not sure what Mike is referring to when he refers to the pool being in a "different location." It is my understanding that the pool was constructed where it was permitted pursuant to Building Permit 9849Z in 1978, and the only reason the recent final inspection failed was due to the insufficient fencing and an unpermitted carport located next to the house (outside Trustees jurisdiction), which has since been removed. A copy of the failed inspection notice is attached. According to Sue in Building, they have an electrical certificate and pools plans in their file. I'm attaching the Building Permit documents we received from Sue. 1 With the above information in hand, I assume Mike's concerns would be satisfied, but yet me know if not. Box 1179 L Board t Southold,NY 11971 Re: 18975 Soundview Avenue,LLC, 18975 Soundview Avenue,Southold(1000-51-1-16) Dear Mr. Bredemeyer: En-Consultants was retained by the current property owner to help close out Town Building Permit No. 9849, a thirty-eight year old permit that was issued on July 19, 1978, for a swimming pool constructed in the 1970s. To that end, we submitted an Application for Certificate of Occupancy to the Town Building Department and arranged for a compliance inspection, which occurred on March 29, 2016. During the inspection, however, the Building Inspector determined that the existing fencing is insufficient and must be replaced with a code-compliant pool enclosure fence in order to pass inspection. Therefore, because the pool fencing is located within 100 feet of the bluff crest and thus within Chapter 275 jurisdiction, we are submitting herewith an application for an Administrative Wetlands Permit for the new pool fence. With the exception of a slight change in configuration on the landward side of the pool, the proposed fence would be situated in the same location as the existing fence, as depicted on the enclosed survey prepared by Nathan Taft Corwin III Land Surveyor, last dated May 13, 2016. Should you have any questions or require any additional information in support of our application, please let me know. Respe lly yours, Robert .
