Unfortunately, we will be traveling outside the country during the week of February 15, and as a result will not be able to attend the public hearing on this project in person, so instead we are writing to Board on this matter. While in no way expert in the technical merits of this proposal, in general, we are ok with the upgrade plan. However, we want to be sure that the new construction will not adversely affect our property or improvements. Therefore, we request that for the work that the Board review the application from this perspective; and as to any work the Board may provide permit for, that this work be subject to the Gampers Estate, or their successors, agreeing to be financially and otherwise responsible for damage to or undermining of our property or our existing bulkhead as a result of the construction or placement of that work. We make this request given that the plan includes a new 16 foot bulkhead section adjacent to our bulkhead. Our bulkhead is currently in very sound condition. We spoke with both Rob Herman of En-Consultants and Angelo Stepnoski of Greenport Dock to better understand the work and the need for assurances of remediation action if required. Also proposed is the addition of a+/- 16'section of vinyl bulkhead to be constructed immediately seaward(within 14")of the existing concrete wall that makes up part of the foundation of the existing boat house. This proposed section of wall would connect the subject bulkheading being replaced to the south of the boat house with the northerly neighbor's bulkhead return to the north of the boat house and would serve to protect and preserve the integrity of the boat house. (A similar bulkhead extension was approved for a property fronting Jockey Creek to the north on Calves Neck Road in 2001 via Wetlands Permit No.5270). GAMPER 2895 WELLS AVENUE SOUTHOLD,NY SCTM#1000-70-4-13 Policy 4 The project seeks to replace an existing timber bulkhead(originally permitted by the Town of Southold in 1957)with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. Pursuant to Pursuant to Town Code §268-5 ("Review of Actions") and the corresponding definitions of"action" and "minor action" by §286- 3 ("Definitions"),the project meets the following definition of minor action and is thus not subject to waterfront consistency review pursuant to Chapter 268: "GG. Within all Town creeks, replacement of existing bulkhead on the applicant's property in the same location with a silt curtain deployed prior to and during construction." Also proposed is the addition of a+/- 16' section of vinyl bulkhead to be constructed immediately seaward(within 14") of the existing concrete wall that comprises part of the existing boat house foundation. This proposed section of wall would connect the subject bulkheading being replaced to the south of the boat house with the northerly neighbor's bulkhead return to the north of the boat house and would serve to protect and preserve the integrity of the boat house. (A similar bulkhead extension was approved for a property fronting Jockey Creek to the north on Calves Neck Road in 2001 via Wetlands Permit No. 5270). The existing, developed site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1960, and there is no viable non- structural alternative means of maintaining and protecting the upland portion of the property or the existing boat house in its current location. Without replacement and maintenance of the bulkhead,the subject and adjacent properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon. Therefore the project is consistent with Policy 4. Pursuant to Town Code§268-5("Review c____.ions")and the corresponding definitions of"ac, 'and"minor action"by§286-3 ("Definitions"),the proposed bulkhead replacement meets the following definition of minor action and is thus not subject to waterfront consistency review pursuant to Chapter 268: "GG.
