SCTM# 1000-137-4-35 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS items "II" which states: B. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated Aug. 5,2016, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. , LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Aug.15, 2016. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available, it has been determined that the proposed action for "as built" construction approximately 14 feet from the top of the bank be considered INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP further advises that according to Policy 6.3 of the regulation requirements, the as built deck was constructed without a Board of Trustees Wetland Permit or Board of Appeals Review and that a vegetated buffer is not being proposed to protect water quality. These conditions are mitigated by the fact that the original deck was issued a CO in 1980, the deck will be re-built within the original footprint, the project will comply with Chapter 236 of the Town's Storm Water Management Code, and the current project is subject to Zoning Board of Appeals and Town Trustees reviews; and,therefore, is CONSISTENT with LWRP policy standards. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: The application was referred for an evaluation and recommendation. According to the information provided in letter dated August 31, 2016, and following an evaluation conducted on August 8, 2016, the Soil Technician advised that the bank appears to be stable and "well established with vegetation, and there are currently no signs of any significant erosion at the site." It is recommended that drywells be installed on the property to divert all rooftop stormwater to them via gutters and leaders and that sprinklers located along the top of the bluff be removed in order to prevent irrigation runoff from causing severe erosion. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming, 18,541 sq. ft. parcel in the R- 40 zone. The northerly lot line measures 262.39 feet, and the easterly lot line measures 76.10 feet along Eugene's Creek. BASIS OF APPLICATION: Request for Variance from Article XXII, Section 280-116A(1), and the Building Inspector's June 2, 2016 Notice of Disapproval based on an application for a building permit to legalize an `as built' wood deck addition attached to an existing single family dwelling, at; 1) `as built' wood deck addition is less than 100 feet from the top of the bluff. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 1,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1.
