Welcome to our meeting. First order of business would be the Pledge to the Flag. Please join us. Is there anyone that would like to speak to any item on the agenda? Mr. Dunn? Robert Dunn, Peconic ROBERT DUNN: I just have a question and I may be confused, on 872, the one regarding the override tax levy? COUNCILMAN RULAND: Yes. MR. DUNN: It says, whereas New York State (inaudible) that pursuant to general municipal law, the tax cap level for the fiscal year will be .68, that's not the tax cap levy, that's the tax cap increase isn't it? In other words, you can only.... COUNCILMAN RULAND: You can only increase your appropriation by .68 without piercing the cap. Is that correct? The Comptroller happens to be in the audience. MR. DUNN: I know. But the cap, that's not a cap on taxes, that .68 is not a figure... COMPTROLLER JOHN CUSHMAN: That's the legislative, that's the (inaudible) by New York State Department of Taxation.... MR. DUNN: Understood. COMPTROLLER CUSHMAN: That's the maximum rate the town can increase taxes without piercing the cap. MR. DUNN: Can increase. But that is not the cap. That's the amount you're allowed to increase over last year. COMPTROLLER CUSHMAN: Correct. That's the cap. That's the cap. .68 % over this year. MR. DUNN: But that's...but then that would be the tax levy cap increase, that's not what this says. It's misleading. COMPTROLLER CUSHMAN: That's the cap. MR. DUNN: Okay. I mean I understand, that's what I thought it was when you were explaining it to me. Do you understand what I am saying? Policies DEPARTIVENT: Accounting Adopt a Capital and Intangible Asset Policy RESOLVED that the Town Board of the Town of Southold hereby adopts the following policy entitled: TOWN OF SOUTHOLD CAPITAL AND INTANGIBLE ASSET POLICY Southold Town Board Regular Meeting September 20, 2016 page 11 Capital Assets Property records and inventory records are maintained in a Capital Assets software application for land, land improvements,buildings,vehicles and equipment and other assets under the control of the Town as outlined below. Fairly reporting fixed assets is important for two key reasons. First, it allows the Town to meet the requirements under Generally Accepted Accounting Principles(GAAP)for fairly reporting fixed assets in its general purpose financial statements. Second, fixed asset accounting provides management with a valuable tool for controlling fixed assets and planning replacements. Fixed asset accounting is a valuable management tool because it 1) Establishes a record of fixed assets.Having a formal record enables the Town Board to easily determine what assets they have and where they are located. 2) Fixes responsibilities over assets.Fixing responsibility for assets improves the care that employees exercise over assets.In addition,it enables the Town Board to fulfill its stewardship responsibilities in managing the assets. 3) Identifies financing source of assets.It provides a record of how each asset was financed. This information may be useful in planning future purchases and how they will be financed. 4) Provides the Town Board with useful information including: • Replacement cost.Knowing what an asset cost may help the Town Board in determining an approximate replacement cost.This is particularly important if the Town Board establishes a reserve for future capital acquisitions. • Insurance coverage-knowing the values of assets permits the optimum insurance coverage by eliminating over or under insurance coverage.In addition,fixed asset records provide valuable information for proof of loss if a claim for loss is filed. • Maintenance cost-knowing what assets a local government has is beneficial in planning a repair and preventive maintenance schedule and providing for the required expenditure. • Useful Life-Know how long an asset is expected to last may help in planning for future replacement and expansion programs. • Capital Budget-Knowing what assets the Town has is very useful in forming an overall capital improvement program for acquiring and replacing fixed assets and determining how to finance such purchase. FIXED ASSETS PROGRAM OUTLINE The Office of the Town Comptroller is responsible for maintaining the Town's fixed asset inventory. The Town has established$5,000 as the minimum dollar value of a fixed asset owned by the Town to be recorded in the Town's accounting records.Additional items(such as computer equipment)with a value of less than$5,000 but more than$500 may be inventoried for property control purposes The Town Board has overall responsibility for the fixed assets of the Town and the Office of the Town Comptroller has overall responsibility for the accuracy and usefulness of the fixed asset inventory. All fixed assets are recorded at historical cost, estimated if the actual cost is not available, unless acquired through gift, in which case,the fair market value at the time of acquisition will be recorded. This cost factor will be reflected Southold Town Board Regular Meeting September 20, 2016 page 12 in the accounting records until the fixed asset is disposed of. CLASSIFICATION The fixed assets of the Town are recorded into one of the following accounts: • Land i • Buildings • Improvements other than Buildings • Machinery&Equipment • Construction in Progress • Infrastructure The record maintained for each asset includes information used to identify the asset and usually includes the asset number,serial number or tax map number,department,owning fund,acquisition date or approximate date of acquisition,acquisition cost,method of financing,vendor name,as well as depreciation. Initial costs of fixed assets and methods of financing are usually determined from contracts,purchase orders,and other transaction documents.When the original purchase documents are not available or inordinate expenditures will be required to determine the cost and/or method of financing,the original cost is estimated and so noted. As new inventory items are acquired or surplus fixed assets are disposed of,the individual property records are added to or eliminated from the inventory file.Items are depreciated in the fixed asset system on a straight-line method based on the date placed into service. Intangible Assets GASB 51 defines intangible assets as lacking physical evidence,nonfinancial in nature and with an initial life extending beyond one fiscal year. Intangible assets include but are not limited to development rights, easements and computer software. The Town,does not capitalize internally generated capital assets produced by Town labor. In most cases,the Town capitalizes all other intangible assets exceeding $5,000 in value. Intangibles with indefinite useful lives are capitalized (if it exceeds-the threshold) and are not amortized. Periods of Useful Life Under GASB 34, the Town has assigned useful lives for its fixed assets as close as possible to the probable useful life. The Office of the Town Comptroller maintains a schedule indicating the current Estimated Useful Life of assets maintained in the fixed assets inventory (Appendix A). Qualifications: - Senior resident of the Town of Southold 60 years of age and older, with a demonstrated need for access to their home during periods of temporary disability. - The portable ramps are to be used by families and/or other caregivers to assist the seniors with access to their homes. The ramps are NOT intended for individual use without assistance. - The Town currently has 15 portable suitcase ramps in various sizes to accommodate access up to a 3 step entry. COUNCILMAN DINIZIO: He ran into some problems with how to make it public, it was going to be mostly for youths and communicating with them. Speaking of facebook, the website, I recall also a promise that that would be revised this year. COUNCILMAN DINIZIO: We are currently in the process, meeting every other week with the company that's upgrading.... MR. SCHWARTZ: Doing some work on it? Southold Town Board Regular Meeting September 20, 2016 page 37 COUNCILMAN DINIZIO: Just really a freshening up kind of thing, Benja and as you know, that most of the content on the site needs to be reviewed to make it clearer for people to get in. That, as you know, is an ongoing thing with us. MR. SCHWARTZ: As you know, there is some underlying issues about the organization, the information architecture. COUNCILMAN DINIZIO: Inaudible. MR. SCHWARTZ: How the site is put together. COUNCILMAN DINIZIO: I could not agree with you more. MR. SCHWARTZ: And how it is maintained without anybody, any responsible party, identifiable responsible party etc. I don't understand how it works as well as it does, it doesn't work very well. But then again, you are not alone, how did you like the other day when we had the hurricane warning and they told us to evacuate Long Island? Or just a few days ago, when we had that rain that came down like cats and dogs or buckets. COUNCILMAN GHOSIO: That was yesterday. MR. SCHWARTZ: Was that yesterday? No? And my wife left for work around 8:00 in the morning or so and I almost told her not to go because it was raining so hard. But instead I went on line and I couldn't find anything about it. That evening, I saw there was an alert by the National Weather Service that was issued at 1:00, it was supposed to be an alert until 2:00 but the rain was between 8:00 and 9:00 in the morning. And I just got another alert today that supposedly was issued at 11:00 AM but didn't come through until today. anyway, we have a system in the town for notifications of things, conditions like that, how are the roads going, I am sure that somebody in town, police or highway, knows more than we do in our house in Cutchogue and maybe if we knew how bad it was, we would not have driven to Orient that morning. I know there's one accident, thankfully we missed that on the way. I don't know, Councilman Ruland, maybe you can answer the question. If you have fallow farmland, farmland which is not in use but its farmland, it's just not actively being used. How much does that cost the town? To maintain, to keep that up? How many, how much in town services does it cost to provide what's needed for that property. COUNCILMAN RULAND: The town doesn't own any fallow farmland. MR. SCHWARTZ: No, I am not saying the town owns the land but if the land is there, does the town have to provide school for the weeds that are growing in the field? No. The town, the taxpayers, do they have to provide policing for those weeds? No, right? so what would be the cost to the town to support property that is not owned by the town, it's private property but it's fallow farmland? COUNCILMAN RULAND: Well, the answer generally would be minimal. Southold Town Board Regular Meeting September 20, 2016 page 38 MR. SCHWARTZ: Close to zero. COUNCILMAN RULAND: Police and fire services, could be. Could be needed, depending on what transpired on that. MR. SCHWARTZ: Well, could we compare that to a housing development, say? COUNCILMAN RULAND: No. You can compare it but they are not the same. MR. SCHWARTZ: And what would be the cost of the housing development? COUNCILMAN RULAND: Police, fire, schools. Any municipal service that's available. Highway. MR. SCHWARTZ: But the housing development would pay more in taxes? COUNCILMAN RULAND: Yes, they would. MR. SCHWARTZ: Would that make up for the difference? COUNCILMAN RULAND: Oh, definitely. Well, I am not sure that it would cover the cost but it certainly would make up for a lot of the difference. MR. SCHWARTZ: Well, it might help. COUNCILMAN RULAND: Certainly it will help. MR. SCHWARTZ: But the accepted wisdom is that it would not cover the cost. COUNCILMAN RULAND: The total cost? MR. SCHWARTZ: No. so the more we develop, the more taxes will be levied and not only on the people in the developments but the people in the rest of the town. COUNCILMAN RULAND: That would be a correct statement. MR. SCHWARTZ: I was hoping Scott Russell would be here because I have a question that's really kind of about property assessments. Does anyone here know how condominiums are assessed? COUNCILMAN RULAND: Well, certainly he could answer that, it has been the subject of discussion very recently because the town is involved in certiorari proceedings. MR. SCHWARTZ: On.... Southold Town Board Regular Meeting September 20, 2016 page 39 COUNCILMAN RULAND: On just such a thing... MR. SCHWARTZ: Condominium properties? We are also involved in a permit approval process to build 124 condominiums in Cutchogue. Correct me if I am wrong, the first condominiums in the hamlet of Cutchogue. COUNCILMAN RULAND: It could well be. MR. SCHWARTZ: And the answer is, there is a provision of state tax law that says that instead of assessing these houses because they are houses, like regular houses because they are owned by the people that live in them because these houses are owned by the condominium association,the inside of the houses are owned by the people who live in them, but the outside, it's very complicated but the bottom line is, the law says forget about how much the house cost, we are not going to go by that, we are going to assess the house based on the potential for rental value. Which opens a whole other can of worms if you think that the condominiums at the Heritage at Cutchogue are all going to be rented out but I don't know, I know we are trying to put some limitations on the age of the people that can live there, I don't think we have anything controlling the ability to use as rentals but when you consider the potential rental value instead of what a house is worth, it ends up I believe with 1/3 of the tax levy. So the other 2/3 of the tax levy, that those 124 houses in Cutchogue should be paying, are going to be spread out among everybody else in Southold Town. It's going to be our taxes going up, a lot faster than they are this year. Jim, what are you doing these days? Are you planning for the future of Southold Town? COUNCILMAN DINIZIO: I live day to day. MR. SCHWARTZ: Day to day. Because you told me the other day you are not a planner. COUNCILMAN DINIZIO: No, I am not a planner. MR. SCHWARTZ: But you are on the Town Board. COUNCILMAN DINIZIO: Yes, I am. MR. SCHWARTZ: Isn't that the job of the Town Board, to plan? COUNCILMAN DINIZIO: We have planners. MR. SCHWARTZ: Well, with all due respect, you don't have planners that adopt, that accept the plans, you direct the Planning Department and should be working with the Planning Board, not directing the Planning Board. COUNCILMAN DINIZIO: I don't think I should ever speak to the Planning Board quite honestly, the Planning Board is autonomous, they make their own decisions based on their facts that they are presented. I should not have any influence at all, other than to appoint them, one for every year, okay, five years in a row. That's all I need to do.. Southold Town Board Regular Meeting September 20, 2016 page 40 MR. SCHWARTZ: I am sorry you feel that way. COUNCILMAN DINIZIO: Honestly, I think the law tells me that. MR. SCHWARTZ: I think that the law tells you that your role as a planner for the town... COUNCILMAN DINIZIO: I am not a planner. MR. SCHWARTZ: You are entitled, in fact, expected, to consult the Planning Board. And there are formal ways of doing that but there are also informal,proper ways. COUNCILMAN DINIZIO: Well, Benja, if you are asking me to influence the Board because you want to have a certain project go your way, I will not do that. I promise you that. MR. SCHWARTZ: No, I am not suggesting you get involved.... COUNCILMAN DINIZIO: I am getting the opinion from you that that is what you want. MR. SCHWARTZ: Well, I would just call your attention to the fact that the Town Board is very involved in the application for the condominium, high density, luxury housing in Cutchogue. Extremely involved. In fact, it was the Town Board's idea 35 years ago, 36, in 1983, the Town Board passed a rezoning. That rezoning was questioned should we say? Well, it was based on a statement that it would only affect 10 acres of land and it was 50 acres that was rezoned. So how the Town Board could accept the statement that it was only going to affect 10 acres when they were rezoning 50 is just the tip of the iceberg. But the rest of... COUNCILMAN DINIZIO: I fail to see where I come on that list. MR. SCHWARTZ: Well, because you are sitting in the seat now, you are a member of the current Town Board and this rezoning that happened in 1983 to high density residential has never been reviewed. In fact, in the years since then, there has been a lot of dancing around that property. The watershed protection zone covers almost the entire hamlet center of Cutchogue except for there's a big whole where the Heritage at Cutchogue is. The watershed protection couldn't touch that. The hamlet studies groups, what were they called? The stakeholders. The hamlet stakeholders for Cutchogue were told, don't even think about it. Leave that alone. It is outside of the hamlet. This is what they told me. COUNCILMAN DINIZIO: Can I answer your question? MR. SCHWARTZ: Yes. COUNCILMAN DINIZIO: It was the subject of a lawsuit. MR. SCHWARTZ: And the settlement involved the Town Board as well as the Planning Board... Southold Town Board Regular Meeting September 20, 2016 page 41 COUNCILMAN DINIZIO: Inaudible. MR. SCHWARTZ: Well, there was a stipulation of so-called settlement which is partially controlling the current process. I am very unhappy with. COUNCILMAN DINIZIO: I get that. MR. SCHWARTZ: Can I explain to you? First of all, you say you are not a planner, but I would just like to very briefly review for you because apparently, Ms. Evans, are you listening? JUSTICE EVANS: Yes, I am. MR. SCHWARTZ: Oh, because you were talking at the same time. So if you want to have a private conversation, let me know and I will wait until you are finished. COUNCILMAN RULAND: Will you please get to the point, sir? MR. SCHWARTZ: Right now I am preparing to talk about planning. Do you consider yourself a planner? COUNCILMAN RULAND: Not by vocation but as a member of the Town Board, I have to be willing to look at everything. MR. SCHWARTZ: Okay, thank you. So planning is essentially a two part process. This is my philosophy of planning but I hope it will be useful to you. it's the same for meditation, one, you can meditate on what is, here and now and the other you can meditate on everything that always was and always will be everywhere and the same with planning but you have to start at looking at what you have and then you think about how you got that and where it's going. I'm extremely concerned with what's going to happen in very short term in connection with the Heritage at Cutchogue. The Planning Board has accepted a final environmental impact statement at which major changes were made to the proposed development and yet none of those changes were reviewed by an environmental analysis. The promise in the so-called stipulation of settlement was that we would do an environmental analysis. We haven't done that. The changes include a promise to employ a technology for sewage treatment. The technology is not even identified. There's no study on that. The changes which were well-intentioned to mitigate the adverse, the harmful environmental impacts, including on the cultural and human aspects not just the natural environment, right now we are talking about the natural environment. Councilman Ghosio, you're aware that they have now decided instead of, I mean, there's been a lot of talk recently, you had a meeting on water use to try to reduce the use of water in Southold Town and yet we are talking about hooking up another use that is going to use tens of thousands of gallons a day. Well, they realized in the draft environmental impact statement there was way too much water, so they've decided to mitigate that by digging a well. But there's been no study of what the impact of that high yield well, which is proposing to, I think they are talking about pumping 25,000 gallons of water a day from one well, I mean, maybe they should think about putting in three or four wells, or don't you agree that that needs to be considered before it's just pushed Southold Town Board Regular Meeting September 20, 2016 page 42 through without any environmental analysis? I mean, maybe you know something about this, Councilman Ruland, as a farmer, do you have wells that pump 25,000 gallons of water a day? Seems like a lot of water to me. COUNCILMAN RULAND: Certainly. Certainly. MR. SCHWARTZ: And what impact will that have on the nearby houses that are using wells? COUNCILMAN RULAND: At this point, I am not aware that it's had any. MR. SCHWARTZ: Well, I am saying that if they dig a well at the Heritage next to the residential development next door, will that impact the wells of those people? If they start using a high impact well there. I would think it may be. COUNCILMAN RULAND: I would be highly surprised that the health department would even consider allowing them to use well water because the water company has a water main right there. MR. SCHWARTZ: No, they are planning to use well water for some or all of their irrigation needs. COUNCILMAN RULAND: Which they are allowed to do. MR. SCHWARTZ: Of course they are allowed but they should be, if it's part of the development that's required to go through an environmental impact analysis, then that should be part of the analysis, it shouldn't just be something thrown in at the last minute. That doesn't get studied. And part of the reason it doesn't get studied is because the whole process has been put on a fast track and that is the decision of the town board as well as the planning board, so don't tell me you are not involved. COUNCILMAN DINIZIO: Inaudible. MR. SCHWARTZ: Please. COUNCILMAN DINIZIO: I never put it on a fast track. MR. SCHWARTZ: Well, you agreed to the stipulation of settlement. That imposes... COUNCILMAN DINIZIO: I agreed that it should move on, of course. MR. SCHWARTZ: Well, that imposes specific time frames where time is of the essence on the town, on the other hand, it says that the developer has to meet the time frames.... COUNCILMAN DINIZIO: Inaudible. Southold Town Board Regular Meeting September 20, 2016 page 43 MR. SCHWARTZ: But if the developer misses the deadline, we will make allowances for it. that is what is in the agreement that was signed by the ..... COUNCILMAN DINIZIO: Inaudible. MR. SCHWARTZ: When you accelerate the deadlines, the time frames that are in the state environmental quality review act, I call that a fast track, speeds up the process. COUNCILMAN DINIZIO: The process has been for 35 years, Benja. MR. SCHWARTZ: You want to go back to 35 years? Because I was there and I can tell you what happened 35 years ago. COUNCILMAN DINIZIO: I know you were there because I was there myself. MR. SCHWARTZ: Yeah. But that's not the environmental impact statement. The environmental impact statement process in this case started in 2015 and then there was a final impact statement that came out and the public was invited to comment on it before the public was allowed to see it. COUNCILMAN DINIZIO: I think you have me at a disadvantage because we have, the whole board I think you have at a disadvantage, because we are in the process of a settlement and I don't want to discuss the specifics, have a discussion with you back and forth about the specifics of that. MR. SCHWARTZ: Alright. COUNCILMAN RULAND: Sir, you have made your point.... MR. SCHWARTZ: I will try to be brief and conclude my statements. One of the other major changes in the proposed development was that now it is scheduled to occur in four phases instead of all at once. At least the prior plan and the draft environmental impact statement was to remove every square inch of topsoil on the property to begin with and move it all around and then start from there and go forward, now they are talking about having four construction phases but you know, there could be other alternatives maybe some of the things in the second phase could be moved to the first or the first could be moved to the second or you could add a few phases, a lot of different ways to cut the cake but we are getting no opportunity to weigh in or comment on that and I believe that is unfair and invalid process which we are entitled to under the state environmental law. So I am very unhappy, I am waiting for a decision that I don't think I am going to like. We are going to, any minute the Town Planning Board to come out and give a site plan to approve 124 McMansions, we are talking about high density, luxury housing. Now you know, I can be a little argumentative. I will tell you a quick story, when I was in high school in Spanish class the Spanish teacher was teaching us about the necessities of life. One of the necessities was TV. I didn't go along with that, I think we can live without TV. I think we can live without high density luxury condominiums. I don't feel that we need that kind of housing in Southold Town Board Regular Meeting September 20, 2016 page 44 Southold Town. I know there are people that want to buy them and you know what? Let then buy them because there are plenty other places they can go where they can find them but there is nothing in the law that says we have to have them in the Town of Southold. We don't have to have big, this town is not the right place for this kind of development. Forget about it. Besides for that, this town is the right place for so many other things that could be happening. The other day on facebook a friend of mine posted he is going to be running in a charity marathon and I am proud to be sponsoring him. Supporting the Gould farm, unlike in Cutchogue where we have the gold diggers farm. That's what they called it right there on Depot Lane. It was something like that, do you remember the title they gave it? Gold something or other. All about the money. Gould farm was founded in 1913, it's the first place in the nation where they help adults who have mental problems, mental illnesses, depression, bipolar disorder etc., through giving them an opportunity to live in a community where they can engage in meaningful work and also receive some clinical care. Their motto is harvesting hope, promoting recovery. On the other hand, the mitigation measure that are being proposed for the Heritage at Cutchogue not only won't solve the problems, they may cause more problems. And I promise I'll be over, one last point, I know that people are listening but they don't seem to be understanding. I spoke about how the hamlet of Cutchogue is known as the sunniest town in New York State and there is nothing solar about the proposed plan, so in the final environmental impact statement, they've agreed to put some solar panels on top of the so-called community center which the community is not going to be allowed to use but they are going to, they are proposing that they might, I will believe it when I see it, put some solar panels on top of the building. That's not the way it's done. I have been in the business for over 30 years. Solar business. And if you have an existing facility, then you need to retrofit it. but if you don't have a facility, you want to design it, before you build it you want to design it so that it takes advantage of the passive solar, the solar thermal, the, which is much more efficient than the solar electric and the solar electric. This is not that. what's happening here and this is the way the Planning Board works every time, but I can't come up here and talk to you every time because we are talking about one house or two or you know, my neighbors, we are talking about 125 houses plus a community, a private community facility. You know, I would love to see a community like the Gould farm come in there and offer something that would be of value, not just to the people who would be living there but also to the people in our town but this will be a detriment to our town if it is approved and I am not asking you to get involved in that any more than you are, your duty, which is to keep abreast of what is happening and the Town Board already stepped in and rezoned that property, I think it was 1995 but then they reversed that rezoning and said no, we will go back to the old law until you get your building done. So you know, it's not that you don't have authority or it's the wrong thing to do, it's just that this Town Board is agreeing to allow this huge change to occur that puts us backwards and will destroy our future. It's never, we are not going to have, there will be a lot of changes and I am not against changes, I would like to see some appropriate development in the hamlet of Cutchogue but the other proposal which is also pending which was not taken into consideration in relationship, although the application was filed before the final environmental impact statement was accepted, the proposal by Terp to add more buildings right up on the Main Road was something that they used to do when there was horses and buggies going there but we have automobiles now and we know that they, that those stores would do better if they would move them back off the Main Road, so please think about it and if you have any questions or Southold Town Board Regular Meeting September 20, 2016 page 45 would like to discuss anything with me, you all know how to contact me.
