SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 18, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 14, 2016. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is their recommendation that the proposed action is CONSISTENT with the Policy Standards; and therefore, CONSISTENT with the LWRP provided that a functioning sanitary system be verified, or upgraded, if required, and that stormwater compliance with Chapter 236 Stormwater Management of the Southold Town Code is met. PROPERTY FACTS/DESCRIPTION: The subject property is 9,449 square feet parcel in a R40 Zoning District. The parcel is corner lot and is improved with a one story frame dwelling with attached sheds and an accessory frame shed.. The parcel fronts Kenney's Road to the west for 75.00 feet, fronts Dogwood Lane to the north for 126.35 feet, adjoins a parcel to the east for 82.46 feet and adjoins a parcel to the south for 125 feet, as shown on the Survey/Site Plan prepared by Ernest G. Jung, L.S., dated June 27, 2009 and last revised May 26, 2016 to show proposed additions and lot coverage calculations. BASIS OF APPLICATION: Request for Variance(s) from Article XXIII Section 280-124 and the Building Inspector's June 10, 2016,Notice of Disapproval based on an application for building permit to construct additions and alterations to an existing single family dwelling, at; 1)proposed additions located at less than the code required minimum rear yard setback of 35 feet; 2) proposed additions located at less than the code required minimum side yard setback of 10 feet; and 3) proposed additions more than the code permitted maximum lot coverage of 20%, located at: 80 Dogwood Lane(3200 Kenney's Road), Southold,NY, SCTM No. 1000-59-2-2. Page 2,October 20,2016 #6988,Costanzo SCTM No. 1000-59-2-2 RELIEF REQUESTED: The applicant proposes to construct additions and alterations to the existing single family dwelling including an attached garage, a wood deck and front porch that will require variances for the following; 1) a rear yard setback of 6.5 feet where the code requires a minimum setback of 35 feet(rear yard to Kenney's Road), easterly property line, 2) a side yard setback of 4.167 feet(4' 2")where the code requires a minimum setback of 10 feet, southerly property line and 3) lot coverage of 24.5%where the code permits a maximum of 20%, as shown on the Survey/Site Plan prepared by Ernest G. Jung, L.S., dated June 27, 2009 and last revised May 26, 2016 to show proposed additions and lot coverage calculations. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 6, 2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(1). Grant of the variance for a rear yard setback and side yard setback will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are many dwelling in this neighborhood with non-conforming setbacks of varying degrees. Grant of alternative relief for maximum lot coverage of 22% will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are many parcels in this neighborhood that appear to have non-conforming lot coverage. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances for the proposed non-conforming rear yard and side yard setbacks. The dwelling exists in its non-conforming location and any proposed additions and alterations will require variances. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance for excessive lot coverage. The applicant could design a plan having conforming lot coverage. 3. Town Law $267-b(3)(b)(3). The variances granted herein for a rear yard setback of 6.5 feet and a side yard setback of 4.167 feet are mathematically substantial, representing 81% and 60% relief from the code, respectively. However, the dwelling exifts in its non-conforming location and any proposed additions and alterations will require variances. The applicant proposes to remove two non-conforming attached sheds and one non-conforming accessory shed. The alternative relief granted herein for maximum lot coverage of 22% is not mathematically substantial, representing 10%relief from the code. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested reliefs for a rear yard and side yard setback is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing additions and alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Grant of alternative relief for maximum lot coverage of 22% is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing additions and alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variances as applied for, for a rear yard setback and side yard setback, and shown on the Survey/Site Plan prepared by Ernest G. Jung, L.S., dated June 27, 2009 and last revised May 26, 2016 to show proposed additions and lot coverage calculations. DENY the variance as applied for, for lot coverage, and GRANT ALTERNATIVE RELIEF as follows: Maximum lot coverage of 22%. SUBJECT TO THE FOLLOWING CONDITIONS 1. The two attached sheds and the accessory frame shed shall be removed or relocated to a conforming location. 2. A functioning sanitary system to be verified or upgraded, if required, in compliance with Policies 5 and 6 of the LWRP Policy Standards. 3. Proposed improvements shall be in compliance with Chapter 236 Stormwater Management of the Southold Town Code. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before ap lying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the revised/amended site plan/survey with recalculation of lot coverage, conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department Failure to follow this procedure may result in the delay or denial of a buildingpermit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
