SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 5, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 15, 2016. Based upon the information provided on the LWRP Consistency Assessment Form submitteW d, as well as the records available, it is the LRP Coordinator's recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The report states "The applicant proposes to fill the property up to 4.3 feet over existing grade. The purpose is to accommodate the new sanitary system. There is a concern about storm water movement on the property post filling." On August 22, 2016 and October 3, 2016 the applicant sent letters stating that the applicant will install drywells to handle storm water runoff. The applicant also stated that it will reduce the proposed fill to 2.2 feet above grade thereby mitigating the LWRP's assessment of inconsistent. TOWN OF SOUTHOLD OFFICE OF THE ENGINEER This application was referred for review to the Office of the Engineer Town of Southold. In the department's e- mail correspondence dated July 19, 2016, the Town Engineer advised that submission and review of a Stormwater Management Control Plan for compliance to Chapter 239, Stormwater Management Control, is required prior to the issuance of a building permit. PROPERTY FACTSMESCRIPTION: The applicant's parcel is a non-conforming 10,846.65 square foot waterfront lot located in an R-40 Zoning District with frontage measuring 95.59 feet along a creek.. The parcel is currently improved with a one story frame house with wood deck and wood patio, and a wood dock as shown on a survey prepared by Nathan Taft Corwin, III, LS dated July 13, 2005 and last updated October 3, 2016. BASIS OF APPLICATION: Request for Variance(s) from Article XXIII, Section 280-124, and the Building Inspector's April 22, 2016, amended and renewed June 30, 2016 Notice of Disapproval based on an application for a building permit to demolish and construct a new single family dwelling, at; 1) proposed single family dwelling is less than the code required front yard setback of 35 feet; 2) proposed single family dwelling is less than the code required rear yard setback of 35 feet, located at: 805 Island View Drive, Greenport,NY. SCTM#1000-57-2-23 RELIEF REQUESTED: The applicant requests variances to demolish an existing dwelling and construct a new dwelling that will result in a front yard setback of 31 feet where code requires a minimum of 35 feet and a rear yard setback of 25 feet where code requires a minimum of 35 feet. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the Town Code. The applicant on October 3, 2016 submitted a letter describing an amended plan to drop the front yard fill to 2.2 feet in an attempt to mitigate the LWRP's concerns as well as the Trustees concerns. Furthermore, the applicant submitted a survey prepared by Nathan Taft Corwin, 11I, L.S., last revised October 3, 2016, depicting a revised front yard setback to 30.5 feet and a revised rear yard setback to 27.3 feet. ADDITIONAL INFORMATION: The applicant will be required to submit an application to the Board of Town Trustees to review and approve the proposed improvements, including the location and design of the sanitary system and a stormwater run-off management plan to comply with the Town's on site drainage code. FINDINGS OF FACT/REASONS-FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 1,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances, as amended, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Island View Lane is a private dead end road that consists of single family homes on irregular, non-conforming lots with non-conforming setbacks similar to what the applicant proposes. Currently,there is a single family home on Island View Lane which received variance relief for a 15.8 foot setback from the high water mark/rear yard line. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant's lot is a small non-conforming lot with an existing dwelling that does not conform to existing zoning setbacks. The applicant's amended plan proposes to increase the rear yard setback to 27.3 feet thereby bringing the creek setback and rear yard setback into more conformity with the town code than the currently existing dwelling. In order to increase the setback from the creek the applicant needs zoning relief from the front yard setback requirement of 35 feet. Any proposed additions and alterations will require an area variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein for the front yard setback is not mathematically substantial, representing 9% relief from the code. The variance granted herein for the rear yard setback is mathematically substantial representing 29% relief from the code. However, the setbacks for the proposed new Page 3,October 20,2016 96982,Bontje SCTM No. 1000-57-2-23 structure are more conforming to the code than the setbacks of the existing dwelling, and due to the requirements of the sanitary system, odd shape of the lot, and setback from the creek,variances are required. Moreover,the subject property includes a 16 foot right of way along the applicant's street frontage that will make the front yard setback, as amended, appear to be 46.5 feet from the dwelling to the road edge. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Schneider, and duly carried,to GRANT the variances AS AMENDED, and shown on the Architectural plans prepared by Mark Schwartz, Architect labeled A-1-4 and dated February 3, 2016, and survey prepared by Nathan Taft Corwin, III, LS dated July 13, 2005 and last updated October 3, 2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must obtain approvals from the Southold Board of Town Trustees,The Suffolk County Department of Health Services, and the Southold Town Engineer. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. This eliminates grading in the northern ROW. 1-1e !mentioned that the Trustees had little further concerns about the proposed re-development as the action is entirely out of the wetlands and even shading would not be an issue- We concurred that I should seek the determination of the ZBA and then come back to the Trustees for a formal review and process. None of the above matters are within the jurisdiction orthe ZBA and do not bear directly on the two variances before you. We have received an August 15, 2016 memorandum from the Town's LWRP coordinator in regard to the subject property's compliance with Policy 4.1 Minimize loss of human life and structures from flooding and erosion hazards. The memorandum asks how storm water will be retained on site and will it impact the neighbors' property. The proposed re-development has anticipated this potential impact. As such, drywells are proposed around the enlarged structure to capture storm water from impervious surfaces and percolate them to groundwater. The storm water runoff and dry wells were modeled as their effectiveness using the HydroCAD system. The modeling shows a peak run off in a 5 year 4.5 inch storm of 0.16 cfs (cubic feet per second) in the existing conditions. This storm water is discharged to the surface at present and largely "runs off." With the proposed re-development, impervious surfaces will' increase and the peak discharge from the same storm will increase to 0.30 cfs. The modeling shows that the dry wells will handle the 5 year, 4.5 inch storm with no surface discharge.
