OF 2016 A LOCAL LAW entitled to "A LOCAL LAW to consider amending Southold Town Code Chapter 100 (Buildings,Unsafe; Property Maintenance) BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose The purpose of this amendment is to amending restrict the placement of dumpsters on residential properties II. Chapter 100 of the Code of the Town of Southold is hereby amended as follows: § 100-4 Standards. A. Property maintenance. , (1) Surface and subsurface water shall be adequately drained to protect buildings and structures,to prevent damage to adjacent property and to prevent the development of stagnant ponds. Swimming pools, spas,hot tubs and other similar structures erected for recreational use shall be maintained so as to avoid the stagnation of the water therein. (2) Landscaping shall be adequately maintained so that lawns,hedges, bushes, weeds and trees do not become overgrown and unsightly so as to constitute an unsafe condition or blight. At no time shall landscaping, hedges, bushes, weeds or trees create an impediment to emergency and/or fire rescue vehicle access. (3) Garbage, crates, rubbish, refuse or debris shall be kept inside a building or buildings on the premises, or in an acceptable enclosed container, and shall be Resolution 2016-912 Board Meeting of October 18, 2016 regularly collected and removed from the premises. (4) No dumpster shall be permitted in the front yard or side yard of a residential property for more than two weeks, unless the property benefits from an open and valid building permit. If the property benefits from an open and valid building permit, said dumpster may remain in the front yard or side yard until either the building permit expires, or a certificate of occupancy and/or compliance is issued for the work described in the permit,whichever occurs first. Thereafter,the dumpster must be removed. Properties used for bonafide agricultural production shall not be subiect to this provision. (4)_U5 Open wells, cesspools or cisterns shall be securely closed or barricaded to prevent access'by the public. (5)�Junked or unregistered vehicles may not be located or stored in open view but shall be stored in a suitable location inside a building or behind a fence outside of public view. (6)MExterior facades shall at all times be kept free of graffiti or other defacement. III. Severability If any clause, sentence,paragraph, section, or part of this Local law shall be adjudged by any court of competent jurisdiction to be invalid, the judgement shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. I have won at least 20 blue ribbons from the Riverhead County Fair. Mattituck Environmental has their own transfer station. Please vote to allow me to keep the dumpster. There is much grass and agricultural cuttings that is too cumbersome to transport to the town dump. Hopefully, property owners with 1 acre or more would be allowed to have a dumpster. I am an avid gardener and need a dumpster. Or maybe a fee could be imposed for a dumpster with an annual permit, similar, to the dump permit, in order to have a dumpster. Please allow home owners to have a dumpster. My dumpster is not visible from the road, I have a 5 acre parcel. Thank you. Schriever WHEREAS there has been resented to the Town Board of the Town of SouthoTauth follcwn CIPA County, New York, on the 9' day of September, 2016, a Local Law entitled "A Local Law to consider amending Southold Town Code Chapter 100 (Buildings, Unsafe:- Property , Maintenance)to (i) restrict the placement of dumpsters on residential properties" and WHEREAS the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold,New York, on the 4th day of October, 2016 at 4:33 p.m. at which time all interested persons will be given an opportunity to be heard. I believe that the Amendment as written is much too restrictive and that the Amendment should either be defeated completely or, if the Amendment is adopted, that the restriction should be limited to only the front yard. The Amendment to restrict the placement of dumpsters on a residential property assumes that the only dumpsters that will be needed are those to dispose of construction debris generated during construction projects for which a building permit is required. But Chapter 144 of the Town Code also lists many construction projects for which no building permit is required, specifically § 144-8 A(1) . . . except that no building permit shall be required for (a) Necessary repairs which do not affect structural features. (b) Alterations to existing buildings,provided that the alterations [1] Cost less than $10,000; [2) Do not materially affect structural features; . . . The list includes a total of 14 items, (a)through(n). Chapter 100 of the Town Code requires that the landscaping be adequately maintained which will create another type of debris, specifically , § 100-4 A(2) Landscaping shall be adequately maintained so that lawns, hedges, bushes, weeds and trees do not become overgrown and unsightly so as to constitute an unsafe condition or blight. At no time shall landscaping hedges, bushes, weeds or trees create an impediment to emergency and/or fire rescue vehicle access. The next paragraph addresses the storage and disposal of this debris, specifically § 100-4 A(3) Garbage, crates, rubbish, refuse or debris shall be kept inside a building or buildings on the premises, or in an acceptable enclosed container, and shall be regularly collected and removed from the premises. The only commercial service that provides an acceptable enclosed container that is regularly collected and removed from the premises is a dumpster. The Amendment to restrict the placement of dumpsters on a residential property as written will limit the placement of such a dumpster to the rear yard. The owner of the residential property may have developed or may have plans to develop the rear yard for a specific purpose. For example he may have fenced or enclosed the rear yard for one or more of the following reasons: October 4,2016 - 1 - William W. Schriever Restricting The Placement Of Du Asters By William W. Schriever 1. Provide a secure playground for young children. .., 2. Provide a secure playground for a dog. 3. Protect a garden or landscaping from being eaten by deer. 4. Enclose a patio and/or a swimming pool for privacy. In any one of these cases placing a dumpster in the rear yard would severely detract from the beneficial use of the rear yard. Assuming that the dumpster is delivered by truck through the front yard, the door to load the dumpster will open toward the rear of the property. Placing the dumpster in the side yard will allow room for the dumpster to be loaded directly from the rear yard: Placing the dumpster in the rear yard will require that the dumpster be loaded at the rear of the property and may even block access to the door of the dumpster depending on the depth of the rear yard. In the current Town Code the minimum width of side yards and driveways is 15 feet which is sufficient for the placement of a dumpster between a fence or a hedge on the lot line and the wall of the building. I believe that I have demonstrated that the ideal placement of a dumpster on a residential property is in a side yard. Thus the restriction on the placement of a dumpster in the Amendment should be limited to the front yard. I recommend that the words, "or side yard" be deleted from the Amendment in two locations before the Town Board votes on adopting the Amendment. So the Amendment would read § 100-4 A(4) No dumpster shall be permitted in-'the front yard of a residential property for more than two weeks, unless the property benefits from an open and valid building permit. If the property benefits from an open and valid building permit, said dumpster may remain in the front yard until either the building permit expires, or,a certificate of occupancy and/or compliance is issued for the work described in the permit, whichever occurs first.
