Docko, Inc. on behalf of HARRINGTON FAMILY LIMITED PARTNERSHIP, c/o DAVID
HARRINGTON requests a Wetland Permit and a Coastal Erosion Permit to reconstruct remains of
dock structure with a 5 foot wide by+/-138 linear foot long fixed wood pile and timber pier with open
grate decking including four batter braced tie-off piles and ladders waterward of the apparent high
water line; relocate 4' wide stairs to beach to be off of new 5'x4'fixed landing;.and reconstruct an
existing 3.5' wide by 34' linear foot long wood access ramp landward of the apparent high water
line. Located: Private Road on Clay Point Road, Fishers Island. SCTM# 1000-2-1-12.2
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is INCONSISTENT with the below listed Policy Standards and therefore is
INCONSISTENT with LWRP.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses'of human life and structures from flooding
and erosion hazards are suggested:
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
The proposed deck is within the Coastal Erosion Hazard Area (CEHA)., All development is
prohibited in the nearshore area pursuant to § 111-11. unless specifically provided for by
Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable
activities in these areas may include iopen timber piles or other similar open work
supports with a top surface area of less than 200 square feet which are removed in the
fall of each year. Therefore, the proposed action is prohibited in the nearshore area pursuant to
Chapter 111, COASTAL EROSION HAZARD AREAS as it is not removable.
§ 111-6. Definitions. -
UNREGULATED ACTIVITY --Excepted activities which are not regulated by this chapter
include but are not limited to elevated walkways or stairways constructed solely for pedestrian
use and built by an individual property owner for the limited purposes of providing
noncommercial access to the beach; docks, piers, wharves or structures built on floats,
columns, open timber piles or other similar open work supports with atop surface area of
less than 200 square feet or which are removed in the fall of each year;normal beach
grooming or cleanup; maintenance of structures when normal and customary and/or in
compliance with an approved maintenance program; planting vegetation and sand fencing so as
to stabilize-or entrap sand in primary dune and secondary dune-areas in order to maintain or
increase the height and width of dunes; routine agricultural operations, including cultivation or
harvesting; and the implementation of practices recommended in a soil and water conservation
plan as defined in § 3, Subsection (12),,of the Soil and Water Conservation Districts Law;
provided, however, that agricultural operations and implementation of practices will not be
construed to include any activity that involves the construction or placement of a structure.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Dear Mr. Neilson:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 17, 2016 regarding the above matter:-
WHEREAS, Docko, Inc. on behalf of HARRINGTON FAMILY LIMITED PARTNERSHIP
c/o DAVID HARRINGTON applied to the Southold Town Trustees for a permit under
the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of
the Town of Southold, application dated July 20, 2016, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 4 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the proposed project meets with
general environmental conditions, will protect the eel grass and will be constructed with
thru-flow decking, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 17, 2016, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding.area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of HARRINGTON
FAMILY LIMITED PARTNERSHIP c/o DAVID HARRINGTON to reconstruct remains
of dock structure with a 5 foot wide by +/-138 linear foot long fixed wood pile and timber
pier with open grate decking including four batter braced tie-off piles and ladders
waterward of the apparent high water line; relocate 4' wide stairs to beach to be off of
new 5'x4' fixed landing; and reconstruct an existing 3.5' wide by 34' linear foot long
wood access ramp landward of the apparent high water line; and as depicted on the site
plan prepared by Docko, Inc. last dated July 17, 2013, and stamped approved on
August 17, 2016.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)
