Dear Mr. and Mrs. Raia: '
The Southold Town Board of Trustees has determined that there are no tidal or
freshwater wetlands on the above mentioned property and therefore it is out of the
Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of
the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.

RE: The Department's jurisdiction under Article 24 (The Freshwater Wetland Act) on
your property at 1815 Arrowhead Lane, Southold (SCTM# 1000-98-3-13.001)
Dear Mr. Raia,
Under Article 24 the Department has jurisdiction over all regulated freshwater wetlands
and 100 feet landward of those wetlands. Many activities (including construction,
grading, fill and clearing of vegetation) within the wetland and the 100 foot adjacent area
require Article 24 permits from this Department. Conducting these activities without the
benefit of a permit from this Department is in violation of Article 24 of the-Environmental
Conservation Law (ECL) and 6NYCRR Part 663 (the regulations promulgated under
Article 24). Activities greater than 100 feet from the regulated freshwater wetland
are beyond the jurisdiction of Article 24 and do not require an Article 24 permit
from this Department.
Staff from the Bureau of Habitat visited the property on June 28, 2016. While on site we
found the presumptive property corner monument for the southeast corner. The
southeast corner is the closest location to the regulated freshwater wetland. Staff
measured from the monument 133 feet to the east and were still not in the regulated
freshwater wetland. The wetland was approximately another 7-10' to the east.
Therefore, your property is greater than 100 feet from the regulated freshwater wetland.

Dear Sir/Madam:
Please accept the following to request a letter of no jurisdiction from the Town of
Southold Board of Trustees with regard to the above-reference property,which is
owned by my wife, Katherine Raia, and me. Attached is a copy of the recently
recorded deed and survey. Also enclosed is a letter of no jurisdiction from the NYS
DEC acknowledging that the property was greater 100 feet from the regulated
freshwater wetland, and a$50.00 check made payable to Town of Southold.
Please be advised that my permission is hereby granted to Town of Southold Board
of Trustees to enter my land without me or my wife being present. However, as this
is undeveloped land, and there is undeveloped land surrounding the property,you
may find it helpful if I join you at the property for your inspection. Therefore,if you
feel that my presence would be helpful,please contact me prior to scheduling this
inspection. Also, if possible please provide the requested letter of your inspection to
