Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface-or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Therefore, no permit is required pursuant to the Freshwater wetlands Act(Article 24) and its implementing regulations (6NYCRR Part 663). Please be advised, all construction, clearing, and/or ground disturbance must remain more than 100 feet from the freshwater wetland boundary. We are proposing a 30'x40'x10' pole barn to be used as a horse and livestock barn. The second barn would be 30'x40'x12'pole barn that would be used as an equipment and hay storage shed. The total square footage of coverage would be 2400 sq./ft. Both building will be for private use.The area where the barns are to be located is clear and relatively flat and will require about 20 cubic yards of clean fill to level the area.The project will be located greater than 100'from any body of water. We do reside in a fresh water wetlands area and we have already applied and received a letter of"No Jurisdiction"from the New York State Department of Environmental Conservation (See attached).
