APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use: 1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation fi.om Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance fi.om architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF JULY 25, 2002

Property Location: 620 Knapp Place, Greenport; Parcel 34.-3-10.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and deternfines that tiffs review falls under the Type II category
of the State's List of Actions, without an adverse effect on the environment if the project is
implemented as planned as a setback or lot line reqnest.
PROPERTY FACTS/DESCRIPTION: Tile applicmlt's property is located on the south side of
Knapp Place ill Greenport. The property is 14,720.19 sq. ft. ill area with 99 ft. frontage along
Knapp Place. The lot is improved with a 1-1/2 story frame house with deck(s) and accessory
buildings located at the rear of the property, all as shown on the survey prepared by Joseph A,
Ingegno, L.S. dated January 7, 2002.
BASIS OF APPLICATION: Bnilding Inspector's April 9, 2002 Notice of Disapproval under
Section 100-33 for tbe reason that the as-built addition was added to the existing accessory garage
with a setback of less than the code requiremeut of three feet to the rear lot line, at its closest
point.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application ou July 25, 2002, at wlfich
time written and oral evidence was presented. Based upon all testimofiy, tiocumentation, personal
msp&t/6n of the property and tile area, and other evidence, the Zoning Board~linds the following
facts to'be true and rele4ant.
AREA VARIANCE RELIEF REQUESTED: Applicant was disapproved under Section I00-
33(1) in bis bnilding permit application 1o tile Building Department for approval of an an-built
addition to all existing garage.
.REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and
personal inspection, the Board made the following findings:
1. Grant of all area variance will not produce an undesirable change in the character of the
neighborhood or a dctrmmnt to nearby properties. A very portion of the addition to the garage at
the southwest corner is non-conforming under tile Zoning Code.
2. The benefit sought by the applicant cannot be achieved by some method feasible for the
applicant to pursue other than an area variauce. The applicant's pre-existing garage and carport

could not be moved to allow for a greater setback for the addition without a financial hardship for
the applicant.
3. The variauce grmated herein is not substantial. Thc variance grmlts a modest reduction in the
setback of the southwest corner of tile building.
4. The variance granted will not have an adverse effect or impact on tile physical or
environmental conditions m the neighborhood or district. No evidence has been submitted to this
board to suggest that this nfinor variauce will. have m~y adverse impact.
5. Grmlt of tile requested varim~ce is the mhfimum action necessary and adequate to enable the
applicant to enjoy the benefit of a garage additiou, while preserving and
protecting the character of the neighborhood, and the health, safety, and welfare of the
community.
BOARD RESOLUTION: Ou motion by Member Tortoral seconded by Member Homing, it was
RESOLVED, to G1L~NT the variance as applied for.
This action does not authorize or condone any current or future use, setback or other feature of
the subject property that lnay violate the Zouing Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

The "as built" addition to a an accessory garage, on a property measuring 14,720 square feet, is nol
permitted pursuant to Article I~ Section 100-33 (1), which states;
"On lots containing up to twenty thousand (20,000) square feet, such buildings shall be set
back no less than three (3) feet from any lot line."
The "as built" garage addition is noted as being +/- 2 feet from the rear lot line.
Note to Applicant: Any change or deviation to the above referenced application, may require
further review by the Southold Town Building Department.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
