a.This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans,accurate plot plan to scale.Fee according to schedule.
b.Plot plan showing location of lot and of buildings on premises,relationship to adjoining premises or public streets or
areas,and waterways.
c.The work covered by this application may not be commenced before issuance of Building Permit,
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant.Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f.Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date.If no zoning amendments or other regulations affecting the
property have been enacted in the interim,the Building Inspector may authorize,in writing,the extension of the permit for all
addition six months.Thereafter,a new permit shall be required.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type 11 category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE.: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated July 1, 2016, stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated July 26, 2016 indicating that based upon the
information provided on the LWRP Consistency Assessment Form submitted, as well as the records available,that
the proposed action is CONSISTENT with policy standards, and therefore is CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: The subject parcel is located within the ME Zoning District and has
frontage on Budd's Pond (connected to Southold Bay) to the south which connects to walkway ramps and several
floating docks. The easterly property line measures 314.25 feet, the westerly property line measures 469.81 feet,
and the property fronts 222.96 feet to the north on NYS Route 25 (Main Road). Furthermore, the property is
improved with a large two story frame building, two (2) large one story marine frame buildings and one and two
story hotel buildings as depicted on a survey prepared by John Metzger, LS, dated August 6, 2003, last revised
June 27, 2013.
BASIS OF APPLICATION: Request for Variance(s) from Article XIII, Section 280-56 and the Building
Inspector's June 8, 2016 Notice of Disapproval based on an application for a building permit to demolish and
rebuild a portion of an existing storage building, at; 1) less than the code required minimum side yard setback of 25
feet, located at: 61600 NYS Route 25, Main Road, (Adj. to Budd's Pond, Southold Bay) Southold, NY.

RELIEF REQUESTED: The applicant requests a variance to reconstruct a one story portion of an existing two
story marine storage building (in place and in kind) having a distance of approximately 1.167 feet from the side
yard property line to the west instead of the required 25 feet side yard setback.

ADDITIONAL TION: The applicant testified that the building is used for business and marine storage
only, and was damaged by Super Storrn Sandy. In 2012, a permit was issued by the Town Trustees, but the
applicant was not able to secure a building permit. It was further explained by the applicant that the reason for the
setback of one foot from the property line is because of a land sub-division and sale of property after the structure
was built in the 170's.

The Zoning Board of Appeals held a public hearing on this application on August 4, 2016 at which time written
and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law '267-b 3, b 1 Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The existence of the most northerly portion of the
building has been in e same location for many years and located in a boat yard for more than 60 years.
2. Towyn Law "267-b 3 b 2 The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. In order to rebuild in place and in kind and in the same
footprint, the applicant requires variance relief, and any additions or alterations to the subject marine storage
building would require variance relief.
3. Town Law§267-bQ(b)(3). e variance granted herein is mathematically substantial,representing 95.6%
relief from e code.However,the setback was established as a result of a subdivision,the marine storage
building has been in its present location for many years without adverse impact, and the proposed construction
is in place and in kind and will not increase the existing degree of non-conformity.
4. Town Law 267-b 3' b 4 . No evidence has been submitted to suggest that a variance in this M11 District
will have an adverse impact on the physical or environmental conditions in e neighborhood. The applicant
must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town 1,awv ~267-b(3){b)(5)., The difficulty has not been self-created. The building has been in existence for
ore than 50 years, in its present location,but has been partially destroyed by Super Storm Sandy.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of reconstruction of the one story portion of a two story marine storage building
while preserving and protecting the character of the neighborhood and the health, safety and welfare of the
community.
SOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-13, motion was offered by Member Goeringer, seconded by Member Weisman
(Chairperson).
GRANT the variance as applied for, and shown on the survey prepared by John Metzger, LS, dated August 6,
2003, last revised June 27, 2013.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan d/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under thf zoning code. This action does not authorize or condone any current or future

use, setback or other feature of the subject property that'may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in thi, action.
The Board reserves the right to substitute a similar design that is de ii is in nature for an alteration that does
not increase the degree of nonconformity.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three
(3)years from the date such variance was granted. The Board of Appeals may, upon written
request prior tote date of expiration, grant an extension not to exceed three (3) consecutive one
(1)year terms.

Your recent request to modify the referenced permit has been reviewed pursuant to
6NYCRR, Part 621. It has been determined that the proposed modifications will not
substantially change the scope of the permitted actions or the existing permit conditions.
Therefore, the permit amended to authorize:
Replace existing sidewalk with raised wooden decks and walkways. Remove and
replace driveway apron. Expand existing parking lot with new gravel area. Remove
and replace in-kind and in-place a 29' x 46' portion of an existing storm damaged
storage structure. Establish a native planting area landward of bulkhead. All work must
be done in strict accordance with the attached plans stamped "NYSDEC Approved" on
August 23, 2016.
In addition, the following Natural Resource Permit Condition is modified as follows:
8. Custom Vegetated Buffer To protect the values of the tidal wetlands, a
permanent vegetated buffer zone shall be established. The area landward of the
existing bulkhead, 100' x 25' — 30' as shown on the approved plans, shall be planted
with native upland vegetation at appropriate densities. Please note: This required
vegetated buffer must be established prior to the expiration date of this permit.
