At no time shall landscaping, hedges, bushes, weeds or trees create an impediment to emergency and/or fire rescue vehicle access. William Schriever, Greenport WILLIAM SCHRIEVER: I gave this to the Town Clerk and then I took it back. I understand that you have a copy of this, this is an engineering document, this is a political document. This is what I am going to speak about. I would like to see them go to the Planning Board (inaudible). My name is William W. Schriever and I married a young woman who summered here her whole life, she passed away 10 years ago but the house that I lived in in Orient was their family home. It's at 2075 Main Road, right after you go past, the third house after you go past the causeway and then I have another piece of property, 820 Front Street which is in front of the school, which I was hoping to build a community center on and then I live now in an apartment at Peconic Landing, so I have three, in a sense, three properties in the town. And as far as my, I am going to be talking on engineering today. I do want to make clear, I have a degree in engineering, I have an advanced degree in physics. I was in the construction business and I installed septic tanks and water lines and sewer lines and all that stuff, so I have a direct knowledge of that technology as it existed, you know, 50 years ago. I am now just turned 90, so my days of politics were 60 years ago. You probably don't remember that. Anyway, I don't do politics anymore. I am here as an engineer, not as a politician. And engineers are the ones that solve problems. Politicians make laws and they pay for the, they raise the revenue to pay for the government. And but they are not good at problem solving and one I am trying to do here, I think is one of the most important things that I can bring before this government, I really believe that, I think this is critically important to the community and I have spent a lot of time working on this thing so that it would be as accessible to you and your advisors as possible. So I have written it out so that it is easy to read and it is written in English. There are two documents, one is an engineering proposal and it's called High Pressure Sewer Systems. There's only one page of text, that's the front page, the rest of the document are ads that I downloaded off the internet so you could see the equipment Southold Town Board Meeting September 6, 2016 page 35 that's available to implement this technology and I think that's very important ultimately but the thing that we need to assume here when we are talking politics, that the technology is available, it's been used for years in some locations so it is not new technology but it is not well adopted and it should be. This is 21St century technology and I want to explain why it works. This is why I arrived at why it works. I invented the technology and then I went around looking to see who had it, so I came at it from a back door. But let's think of it this way, you have a water system (inaudible), Suffolk County Water District and they deliver water to your building, your house or your commercial building in a pipe that's usually two inches in diameter or less. It could even be one inch in diameter, I have a meter. I don't have public water in Orient but for political reasons, not technical reasons. But I do have it in Greenport. I think it's called 5/8ths service, 5/8th of an inch in diameter. But anyway, when you use the water from the water district, you use it in surges. You flush the toilet and you use a surge of water and then it's shut off and then there's no use. When you run the dishwasher, you take a shot of it and when you fill the teapot, you take a shot of it. When you water the grass, you don't water 24 hours a day, you water it for a little while and then you stop. So the water comes into your property not as a steady flow but as a periodic use. Also, remember that not all of the water that comes into your property comes back as sewage. Only part of it does. If you water the grass or the flowers, that water doesn't return as sewage. It is not likely that you are going to be using, if you have public water, that you are going to be using water that produces wastewater, except if you got it from the water district. So the point I am making is, that all the water that you are going to return to the sewage treatment plant, wherever that is, all that water got to your property in a small pipe. And this high pressure sewage system is just a way of returning the water to the sewage treatment plant in another small pipe. And since that pipe can flow 24 hours a day, it can be a very tiny pipe. So you can serve a large apartment building with a 1 t/4 line, it's that simple. A 2 inch line would be enough to serve a whole community, a whole hamlet or something. They have them up to 3 inches, a small city or a town could go in a 3 inch pipe. There are two types of, well there are lot of different kinds of water systems and then on the front page at the first paragraph are the various types of sewer systems and let me just read them through so you will understand that the kind we have isn't the only available. Our technology, the gravity technology is 19th century stuff and we are still using it. It is not the way to go today. What I am proposing is a modern, 21" century system, well, it's really 201h century but we haven't adopted it yet. But it would do, allow sewer service to be provided everywhere in the town at minimal cost, so let me first list the types of sewer systems that are commercially available. We have the septic system that's where you put in a septic tank and either a cesspool or a leaching pool and the water is returned to the ground after its stripped of its, most of the sludge is retained in the septic tank and then you have that periodically removed from the septic tank by pumping the tank. Before that, we just have cesspools. When I started in the construction business in 1968, we were building cesspools out of cement block, just stacking them up. And before that, they used to build them out of bricks. I had around my house, I had cesspools that were made out of bricks from the Sage Brickyard. If you get old bricks around here, they all have Sage written on them. So anything that would leak and then you tried to fill around the cesspool with sand or gravel, I used to buy the gravel that was pushed up to maintain the ferry dock and then I would use that as backfill material around the cesspools. And that makes a very good backfill material, it's very porous and it's very stable. So that's the technology that we had in this town when we started trying to regulate the system and then the next technology is the old fashioned gravity Southold Town Board Meeting September 6, 2016 page 36 system, that's where you have a pipe that is pitched downhill and the sewage flows along the bottom of the pipe and it gets deeper and deeper and deeper as it goes along. So if you put a sewage system on flat ground, let's say along the beach, you could start at 4 feet deep at one end of the beach and you would be 8 feet deep at the other end. And the problem with that technology is, as you can see, these trenches get very deep. I remember the, where I grew up in Oklahoma, I was in the southern part of town and we had a gravity system there and the sewer line was about 20 or 25 feet deep when it went by my house and it was getting deeper as it went and eventually of course, it hit the banks of the old river and it got shallow again because the land dropped off not because of the pipe and the problem with the gravity system is, you have to keep lifting the water up otherwise your trenches get too deep and deep trenches are extremely dangerous. Most of the deaths you see happening in the construction business happens because of cave-ins, the walls of the trench cave in and they have all sorts of shoring mechanisms that you buy and install to keep the trench open while the men are working in the bottom of the trench and they have to work down there because they have to assemble the sewage line in the bottom of the trench. It's made of pieces and they have joints and they have to do that with a transit so that the elevation of the pipe is exactly determined within a quarter of an inch or less. So it's a very meticulous job, it's a very dangerous job and sooner or later you have to have what they call a lift station, that means that you have to have a pump, a low pressure pump, that will pick up the water that's coming out of the pipe, lift it up let's say 20 feet and discharge it into another pipe and start the process again. So gravity systems have a very limited range unless you have pumps involved. It's pretty hard to imagine gravity systems extending very far. A few miles and you are so deep you don't dare install it. So that's the limitation of gravity systems, its 19th century technology. The rules for it were written back then, we are still trying to build sewer systems with that technology. And it's very expensive, it's very dangerous and I made a, on the high pressure sewer system, there's a middle paragraph is comparing gravity systems with this high pressure system that I am recommending. And I have taken a bunch of properties and compared the two and as you can see, the new high pressure system is far superior, in the first place, you can install the pipe by boring it underground, you can buy the pipe on rolls so you don't have to make all the joints, it doesn't matter whether it goes uphill or downhill, so you don't have to worry about getting a transit to install it, you just have to make sure that it's deep enough that it doesn't freeze when we get cold weather. In my experience here, a pipe that is three foot deep, it is pretty secure. If something it completely shaded all the time, it will of course, freeze deeper than that. Maybe occasionally but by and large, I have pipes in my house in Orient that have gone through a lot of cold weather and I've never had one freeze underground. When the hydrants outside freeze, they freeze from the top down. But, so they are blocked by ice but that ice is in the vertical pipe, not the horizontal. Anyway, so that's the gravity system. Let me tell you the other types,just so you will know that the high pressure and the gravity aren't the only systems. We have gravity systems, you can imagine, you can't use a gravity system on a ship. The ship is twisting and turning and rocking back and forth and there's no way that you can use a gravity system that's not level. So they have vacuum systems. If you have been on a cruise ship, when you flush the toilet, the thing sucks your, whatever the trash you have there in the toilet gets sucked down the pipe and so it uses very little water which is great for being on a ship since you don't have an endless supply of good water, so it sucks it into a storage tank, they used to discharge it but nowadays they bring it ashore at the end of the cruise and discharge it to a treatment plant on shore. And that's also used for all kinds of industrial it Southold Town Board Meeting September 6, 2016 page 37 waste collection. If you are running a packing plant packing meat or a fish plant something like that, a food processing plant the waste there is not collected by a gravity system, it's vacuumed up. When you want to get rid of something, you suck it into a reservoir and then you deal with it, so then, let's talk about the lift system. You are only lifting the water from say the basement floor to above the ground. You might be 10 feet, let's say it was a deep sump and you went 20 feet but that's typically all you would use. There are other, there is a form of lift station that you put in a gravity system as I mentioned, to lift the water from a lower level to a higher level so it can go down the pipe again without the trench being so deep and those basically use the same technology, it's just a low pressure pump delivering no pressure, it's just the head, the water head that you are pushing and there's 2.3 feet of head, water produces one pound per square inch, you will find that quoted in here, so you can estimate. If you have 100 pounds pressure,that will lift water 130 feet. And this high pressure systems, the pumps produce over 100 psi. so you could have water going all the way up 200 feet without having an additional pump. And so let's you are down in an river bottom that's way deep and you want to get the sewage out of that river bottom, well you have got 200 feet of lift there built into the system so you can at least accommodate most of your variation in elevation within the system itself. Okay, so then you have reached the low pressure system, now this is what they refer to when they refer to pressure sewer systems and they use the acronym PSS. Now what these are, they are little pumps with grinders on them to grind up the fecal material and whatever else is in there, the vegetation, whatever is coming down the pipe and it grinds it up into a slurry so it can flow like water and then there's a low pressure pump that pushes it into a local line. The line can only vary in elevation by maybe 20 feet or something and the pump runs out of lift, so these can be used as a collection and the companies love the system because it means that every single homeowner has a pump grinding away and that sells a lot of pumps but it's not a good system. In my opinion, it's not practical. So what I would suggest is you build a gravity system to a reservoir and then you pump out of the reservoir, so you just have a local reservoir or a septic tank. You can call it a septic tank, that's what it is. And you shouldn't, if it's done right, you shouldn't have to remove the sludge. The sludge should be ground up and go down the sewer line along with the water. And that's so that you don't have any local, well, maintaining the equipment I guess but you don't have any maintenance jobs to do at the, where the flow is initiated. It's an automatic system that has a, they don't even use a float because float gets tangled up with the grease and everything. They use an electronic detector to detect the height of the water in the reservoir or septic tank and then it turns on the pump and then turns it off and there's valves in there that prevent the backflow. But anyway, so that's the high pressure system and that's what I am recommending. Now, let's do some comparison of a high pressure system with a gravity system and we have here, the operating pressure of a gravity flow system is zero, I mean, it's just, you have to pitch the pipe and it just runs downhill so there's no pressure at all. And, but it requires very careful leveling and maintaining of the pipes and these pipes are rigid and they tend to crack because the earth has movements, earthquake type movements, settling and so on and it cracks the pipe and so the sewer pipes almost all of them leak. It cracks and then they leak through the crack. And they generally don't fix the crack unless it's a bad leak, they just let it leak. So that is a bad part about a gravity system. As I say, the pumps, the one I pulled off the internet something over 100 psi, so that it gives you the same pressure going back in the sewer line that you had in the water line coming in. The water line only flows occasionally. You have a line that is going to flow 24 hours a day if necessary to get the water to the treatment plant. So Southold Town Board Meeting September 6, 2016 page 38 therefore, you can move an enormous amount of sewage in a very small pipe and one of the standard sizes for a small line is 1 1/4 inch. Can you believe that? Inch and a quarter sewer line. It comes in a spool, it's plastic, you use a tunneling machine or a boring machine. You can go a city block and pull it underground so you don't have to trench through the pavement and so forth. It can be installed, the technology is a little beyond my competence, I've never used it but I understand you put in electronic markers on the ground where you want the pipe to go and the machine reads the electronic signals it picks up from these reference points that you place on the ground and then follows along so you can guide the pipe, you can guide it around a curb if you want to and the machine will get the pipe to wherever you want it to go. You have got to come out somewhere, so you come out in a small excavation, let's say the size of a car, and then you place your reel of pipe at that excavation, alongside it, you grab the end of the pipe, you hook it onto the cable that you just, that came through and you pull it through behind a reamer or you may have a reamer go and then you go and pull it behind that again but anyway, that's how you get it in, you put a cable through and then you pull the pipe back through the hole, that's how you get the pipe physically installed. And you have trenchers, you know they look like a chainsaw but larger. I had a similar trencher when I was in business, it was a little smaller than the ones that I reference but mine only dug two feet deep but it worked very well. I remember one day I put a drain line in at the Greenport Post Office from the back door of the post office out to the bay and that was all filled, that whole area back there was filled so I was cutting timbers, I was cutting brick. This little trencher was making a trench. You couldn't dig your way in there, I mean, it was a horrible mess but you could trench it. These trenchers are built that way, they can cut roots, they can cut pipes, anything but you have got to be careful where you use them. SUPERVISOR RUSSELL: Can I just make a suggestion? Because I like everything you are saying. Would you be willing to meet with the Town Engineers? MR. SCHRIEVER: I sure would. SUPERVISOR RUSSELL: Meet with the engineers and then the three of you can bring it back as a presentation to the Town Board at a work session. That way, because you are talking to (inaudible) MR. SCHRIEVER: I would love to do that. I think this is so important. SUPERVISOR RUSSELL: So what we will do is we will get the three of you together and you can bring it back to the Town Board as a presentation during a work session. Alright? MR. SCHRIEVER: Alright. Sounds good. SUPERVISOR RUSSELL: Thank you. MR. SCHRIEVER: So I would just like to do the political part. We have been talking technology or engineering. I would just like to do the political part of the speech and it's only the top paragraph, the lower paragraph is the same one that I just referenced. So it's the top Southold Town Board Meeting September 6, 2016 page 39 paragraph and what I said in here was critical economic and environmental problems requiring an engineering solution. So remember, I am not a politician, at least not anymore. I am an engineer and I am trying to sell you an idea that you didn't think of and that's a really hard job but let me try. Here are the things that I think need solving in our community in order to continue living here in a healthy climate and the first thing that comes to mind is affordable housing. You can't build affordable housing unless you build multiple housing, rental housing because that's all people can afford that are young or elderly or whatever, disabled, who are not working at a highly paid job and so you need to have a sewer to connect that building to. you can't afford to put in a sewage treatment plant at every building. That is just totally impractical and I see it being proposed but I think it's a terrible mistake. That's why I am so concerned about this. We are going to spend all our money and get nothing. Now here's the next item, nitrogen in the marine environment. Well, if we had sewers that were taking away this nitrogen wastewater in the vicinity of the coastline, that probably would solve that, so we could put one of these collection systems along the coastline and eliminate the nitrogen pollution that's causing our problems with fishing and bathing and everything else. Sewers for the hamlet, you have a hamlet but you have to build sewage systems, septic tanks for every single business or whatever is there. if you had one reservoir, you just use a gravity system into that reservoir and one pickup with a pump and take the effluent away. You solve that whole problem without making septic tanks all over the place. And then you have sewers for restaurants. We have restaurants lining our highways and much too far apart to serve with a gravity system. You couldn't afford it. Cost more for a pipe than it would for the restaurant. So this system that I am talking about is that you could have one line going along the road and you just simply tap into that line and you have a local pump at that restaurant, it pushes into that line and the line carries it away. So you have a pump and a reservoir, a septic tank, that's all you have at the origin. You need a treatment plant at the end and that's another problem,that's a political problem. They know how to make treatment plants but somebody has to authorize them. But remember now, with this technology you don't have to build a treatment plant where the people are. You can build a treatment plant anywhere you want. And you can transfer the sewage from the hamlet, let's say you could build the treatment plant in Cutchogue if you wanted to for a development in Mattituck and have one of those pipes going there. Problem solved. So you don't have all of the odors, you don't have the fumes associated with a sewage system. And then another one would be food processing. We do, we have fish being brought aboard and harvested and filleted and so forth, so you have that kind of waste to dispose of now and it's all over the place and this way you could just pick up all those spots, including on a farm or down along the highway. You can just make a collection system and the one thing we are missing of course, is the treatment plant. we have one in Greenport, we need maybe one more at least in Mattituck or Cutchogue or maybe one in Southold but I would say one in the west end would be enough with this system. You wouldn't need two. Because you are not talking gravity, remember? We can carry this stuff as far as we want without any problem. and then you have wastewater from farms and wineries, they have wastewater that shouldn't be dumped to shore, that has nitrogen and all sorts of things, probably pesticides and god knows what, we shouldn't be putting that into the ground, we should be carrying it away. And here's the biggest one I think, and that is, every time we build a building, especially a public building, by public buildings I mean churches and prisons and fire department buildings and town halls, whatever it is you are building, you have got to put in a whole septic system for that building and it takes a lot of room according to the code to do that. Southold Town Board Meeting September 6, 2016 page 40 besides it's putting all that pollution into the ground. So now you want to get rid of the nitrogen, so then you put in an expensive system to get rid of the nitrogen but you are still putting the crap into the ground. If you had this system, all you would have to do is put in a little septic tank and a pump, hook you building to that and take it away. I just think this is such wonderful technology. I just hope that you will consider it. SUPERVISOR RUSSELL: Oh, absolutely. I think when you meet with the engineers, you are going to find out that the three of you are going to have a lot to talk about, because this is right up their alley. So I thank you for coming before the Board. MR. SCHRIEVER: Good. Thank you very much. I really appreciate it. SUPERVISOR RUSSELL: Thank you. Bill Shipman, Cutchogue BILL SHIPMAN: Bill Shipman, Horseshoe Drive, Cutchogue. Recently I filed a complaint on line regarding the cigar shop again. Any word? SUPERVISOR RUSSELL: Bill? COUNCILMAN RULAND: We are aware of it. TOWN ATTORNEY DUFFY: We are aware of it. We investigated it, we confirmed what you told us and we look forward to moving against the.... MR. SHIPMAN: So they are up and running again? Violated their agreement again? TOWN ATTORNEY DUFFY: Yes. SUPERVISOR RUSSELL: We came to the conclusion today is that we have tried to work with the operation, there was the pending lawsuits of the, both sides had legal arguments. We tried to resolve it with this and we can't. It is clear that they are not going to, we thought we were getting somewhere but their behavior over the last few weeks, I have to say, discussions are over with them. That's it. We are going to bring all of our legal might to enforce every component of what they have been doing. MR. SHIPMAN: And what I am kind of looking at is May 22, alcohol overdose. June 5, like I have already said, alcohol overdose. Middle of August, two people are arrested there for harassment and trespass. The violations for the cigar shop that you have already addressed and now are addressing again. So these are continual violations, even though they have already been punished by SLA. So I am just wondering, I am sure you are wondering the same thing is when does justice get served? SUPERVISOR RUSSELL: You know, I have explained to you several times, the frustrated, I think that there's the misunderstanding that you need to come and convince the Board to do Southold Town Board Meeting September 6, 2016 page 41 something. I think we have done quite a bit but in the context of everything that we have done, we have tried to come up with some reasonable guidelines that address the Town's concerns and address the operators concerns, it's clear at this point after the most recent event, there's no talking, it's a waste of our time talking to them. We are going to bring all of our legal might we can to the global picture there. Not just cigar shops. MR. SHIPMAN: Here's the thing, we butted heads over you know, how you feel I am presenting things and how I feel that you may be presenting things but I knew a long time ago that they were not going to comply with what you offer and literally like you say, you were bending over backward to offer them a resolution. Their resolution is the almighty dollar which stems from the corrupt state politics and, am I pulling the tigers tail a little bit by saying it's corrupt? Yeah. That place is as corrupt as you can get. Literally when they had their punishment handed down from the SLA, that wasn't on the calendar for that particular day and when it was brought to the chairman's attention, he told us he would get back to us. That was like 8 months ago. Sorry, 6 months ago. So why aren't you getting back to us? Because somebody caught something that you thought you were going to push over, and that's the politics in it. SUPERVISOR RUSSELL: You are talking about the state level,the SLA level? MR. SHIPMAN: Yeah. And when you go back to May, June, the incident in August and the cigar shop violations, the Planning Board says it's not a permitted use, you say it's not a permitted use. The building that they are selling out is laboratory/office space. So all these problems that are occurring and I am going to go out on a limb and say a majority of these problems are not occurring at any other vineyard or wine tasting room on the north fork. Are there intermittent problems here and there? Yes. But it's not happening May, June, August, September, October. When harvest season comes along, that place is going to go wild. I know it, you know it, I will be here complaining again but they are literally, this site is having these particular problems, why? Because they are overcrowded, that particular place is overcrowded. Who cared? I could have cared less, in 2011 how many people were there. As long as they are making money, they were having a good time and I was living peacefully. Nobody cared how many people were at a particular site. But when it turns into a disaster, now numbers come into effect. Are you going to say the site is overcrowded? Which it is. And they are overserving. They are exploiting a gray area, the SLA's determination because they never made a determination for what a serving was. So they are serving beach pail full of sangria, to people that are already drinking. So what is that induce? That makes the calls for the fire department about alcohol overdose. But they are doing it. Nobody has the moral obligation to say that guy shouldn't have it because they are getting $50 for the thing. And then the neighbors that are living next to it, myself in particularly, the outspoken big mouth, but if I don't continue and I close my mouth, that place will be back to where it was within the season and then we will be doing the same thing. SUPERVISOR RUSSELL: I'm sorry. I am going to disagree because I think the Town Board has worked really hard to reel them in, I think there has been a substantial amount of success. This is what it gets down to today, they seemed like they were on their best behavior to negotiate Southold Town Board Meeting September 6, 2016 page 42 a settlement. We have no reason to think at this point if we can't get them to comply with no cigar sales, then we can't in the long term get them to comply with anything. MR. SHIPMAN: That's a pretty good way of looking at it. Through December of 2013, the ZBA said that this site was generating this noise problem was inconsistent with agricultural residential nature, right? So we are already saying that this stuff happened, you were attempting to address it, the town was attempting to address it and when I complained about the parking and the site plan, alright, in 2013 in addition the site clearly does not comply with town code 287-78 H which requires parking for that site to be contained on site. So every time that I complained, I came up here and complained to you that there's more than the 34 vehicles, your Planning Board said this already. So when you told me that I was intimidating and harassing... SUPERVISOR RUSSELL: No, you're not. What you are trying to do is get the town to use all of its resources, the police department and everything else to nitpick every little thing, alright? MR. SHIPMAN: No. SUPERVISOR RUSSELL: Yeah. And what we have been trying to do is get them to reel it in like any other operation in Southold Town. We had some success, we have recently had some setbacks, so everything is off the table with us and them. We actually have been sending a code enforcement officer down there every Saturday. The one Saturday she is off, they start selling cigars again. So all that success we had and all that stuff, it's all out the window. We are going back to full battle now. MR. SHIPMAN: So now you are not going to be afraid of harassing them or intimidating them? SUPERVISOR RUSSELL: It's not a question of being afraid of anybody, it's trying to run an evenhanded government. MR. SHIPMAN: I am not saying afraid as in... SUPERVISOR RUSSELL: I am not afraid of anything, Bill. MR. SHIPMAN: I am just saying you are not concerned anymore about... SUPERVISOR RUSSELL: There's no need to maintain a communication with them to resolve the issues because clearly they cannot be resolved. MR. SHIPMAN: Right. Because this is 2016 and it started 2011. SUPERVISOR RUSSELL: And we are done talking to them. MR. SHIPMAN: Very nice. I am sure you have the back to school night to get to. SUPERVISOR RUSSELL: Yes, the orientation.
