As this storm represented an unusual rain event and the hole you wish to fill is relatively�small, this office has no objection to filling in the hole with clean fill and considers the repair a de minimus action not requiring a town wetland permit provided: Only the minimal amount of soil needed to fill 4n the hole is to be used, matching the grade either side, and the finished soil surface is to be stabilized by staking with jute fabric/burlap and left as is and allowed to naturally re-vegetate. With respect to the concrete block retaining wall, by copy of this letter you are authorized to perform a de minimus repair consisting of minimal repair/replacement of an individual block or two and to re-point the missing mortar. Any work in excess of this will require a wetland permit as additional drainage and stabilization of the wall and/or new construction would be more appropriate. My,property is on East Creek and has a'seawali/retaining wall on the water side which I understand was'permitted and built in or about 1960. When I purchased the home the wall had some minor nonstructural cracks which I had intended to repair, with permit, and had consulted with Chris Mohr Lawncare & Landscaping,.Inc.. Recently, on August 10, 2016 and again on August 20, 2016 during heavy rain storms the storm drain on Oak Street contiguous to my property over flowed causing major flooding and significant erosion of the fill behind and underneath the wall and steps exacerbating what were previously minor cracks to the wall and steps and the dislodging of one concrete block. Upon my investigation with the Town Highway Department, it was discovered that the storm drain on Oak Street was never cleaned and cleared thereby causing the flooding on August 101 and August 20, 2016. I have been told by Mr. Orlando at the Highway Department that the drain was cleaned on or about September 2, 2016 which I am hopeful, solves any problems of flooding in the future. I-am now.in the position where I need to back fill with "clean fill" and repair the wall. My property is on East Creek and has a seawall/retaining wall on the water side which I understand was permitted and built in or about 1960. When I purchased the home the wall had some minor nonstructural cracks which I had intended to repair, with permit, and had consulted with Chris Mohr Lawncare & Landscaping, Inc.. Recently, on August 10, 2016 and again on August 20, 2016 during heavy rain storms the storm drain on Oak Street contiguous to my property over flowed causing major flooding and significant erosion of the fill behind and underneath the wall and steps exacerbating what were previously minor cracks to the wall and steps and the dislodging of one concrete block. Upon my investigation with the Town Highway Department, it was discovered that the storm drain on Oak Street was never cleaned and cleared thereby causing the flooding on August l Ot" and August 20, 2016. I have been told by Mr. Orlando at the Highway Department that the drain was cleaned on or about September 2, 2016 which I am hopeful, solves any problems of flooding in the future. I am now in the position where I need to back fill with "clean fill" and repair the wall. I am told I need a permit to do the work for which I have engaged Chris Mohr. Please let this letter serve as my permission to you and your agents to enter upon my property for the purpose of inspecting and verifying the information set forth above.
