E., filed in the Suffolk County Clerk' s Office May 10th, 1940 as map number 1310, distant sixty-two (62) feet southerly from the center of the monument at the intersection of said westerly side of Old Salt Road with the northerly boundary of Salt Lake Village; running thence Westerly, at right angles to Old Salt Road, one hundred (100) feet; thence Northerly, parallel with Old Salt Road, forty-seven (47) feet more or less to the south side of property shown on "Map of Lida Bartley", and being also the northerly boundary line of the property of Emma S. Richards, one of the parties of the first part; thence Westerly, along said (i northerly boundary line, sixty-two (62) feet more or less to the monument on the division line between the land of said Bmma S. RICHARDS dated April 30th, 1942 Rochelle Place) , and together with a like interest in the bed of Rochelle Place in front thereof, subject to the right of way of o m Q the owners of numbered lots on the Map of Salt Lake Village over h the same, and together with a right of way over Salt Lake Lane (sometimes called Rochelle Place) to Bay Avenue . )p "The Commons" above described is that plot of ground ap- proximately 311 x 7919" lying between the :^lag Pole Circle and the Village Dock and between the two paths on either side thereof run- ning to and from said circle and dock as shown on "Prap of Salt Lake village". Subject to such easements appearing of record as have heretofore been granted by The Fraward Corporation, Inc. , one of the parties of the first part, to the Long Island Lighting Company and/or the New Vork Telephone Company to lay gas mains , electric conduits, erect poles and stretch wires and cables thereon over the roads shown on said "Map of Salt Lake Village" to provide public utility service to owners and tenants. i i The party of the second part covenants and agrees to share in the proper upkeep and repair of the roads, paths, Village Dock i and Boat Landing, such contribution not to exceed the sum of $2.00 , i per month per lot during the term of such ownership, which contribu- tion shall be paid to The 7raward Corporation, one of the parties of I the first part, or its assigns, which covenant shall run with the i j land and be binding upon each and all the present and future owners of numbered lots shown on "Plop of Salt Lake Village" and property to the north and west thereof. The property hereby con- veyed, for the purpose of determining, the rate of contribution, shall be regarded as the equal to one (1) lot of "Salt Lake Village" property. EM1,,1A S. RICHARDS and RCSINA J. RICHARDS, adjoining owners of property fronting on the Great Peconic Bay, (which property ad- joints the property hereinbefore described) do hereby covenant and agree each with the other that neither they nor their successors in title , will, without written consent of the other duly acknowledged and filed, erect or permit to be erected any building of any kind, nature or description within twenty-five (25) feet of the division DEE line running north and south between their said properties as con- stituted and owned after the delivery of this conveyance. `-Phe Fraward Corporation, Inc. , is made party to this agreement for the purpose of conveying to the party of the second part, title to or an interest in certain roads, easements and property owned by said Fraward Corporation, Inc. as hereinbefore { described. The parties of the first part covenant that they will i receive the consideration for this conveyance as a trust fund to i be applied first for the purpose of paying the cost of any improve- went upon the demised premises, now incomplete or completed less i i than four months prior to the date hereof, and that they will apply ' I i the same first to the payment of the cost of said improvement before i using any part of the total of the same for any other purpose.
