SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated Aug. 5, 2016, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Aug.15, 2016. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available, it has been determined that the proposed action for "as built" construction approximately 14 feet from the top of the bank be considered INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP further advises that according to Policy 6.3 of the regulation requirements, the as built deck was constructed without a Board of Trustees Wetland Permit or Board of Appeals Review and that a vegetated buffer is not being proposed to protect water quality. These conditions are mitigated by the fact that the original deck was issued a CO in 1980, the deck will be re-built within the original footprint, the project will comply with Chapter 236 of the Town's Storm Water Management Code, and the current project is subject to Zoning Board of Appeals and Town Trustees reviews; and,therefore, is CONSISTENT with LWRP policy standards. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: The application was referred for an evaluation and recommendation. According to the information provided in letter dated August 31, 2016, and following an evaluation conducted on August 8, 2016, the Soil Technician advised that the bank appears to be stable and "well established with vegetation, and there are currently no signs of any significant erosion at the site." It is recommended that drywells be installed on the property to divert all rooftop stormwater to them via gutters and leaders and that sprinklers located along the top of the bluff be removed in order to prevent irrigation runoff from causing severe erosion. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming, 18,541 sq. ft. parcel in the R- 40 zone. The northerly lot line measures 262.39 feet, and the easterly lot line measures 76.10 feet along Eugene's Creek. The southerly lot line measures 266.63 feet, and the westerly lot line measures 75.00 feet of frontage along Page 2, September 15,2016 s #6980,Illuzzi SCTM No. 1000-137-4-5 Fleetwood Road. The property is improved with a single family house, a 362 sq. ft. accessory structure, wood decking, including the "as built" deck, retaining walls, and a wooden dock, as shown on the survey drawn by John T. Metzger, last updated on April 18, 2016. BASIS OF APPLICATION: Request for Variance from Article XXII, Section 280-116A(1), and the Building Inspector's June 2, 2016 Notice of Disapproval based on an application for a building permit to legalize an `as built' wood deck addition attached to an existing single family dwelling, at; 1) `as built' wood deck addition is less than 100 feet from the top of the bluff. RELIEF REQUESTED: The applicant requests a variance in order to legalize an existing "as built" two story wood deck constructed at 14 feet from the top of the bank,where a setback of 100 feet is required by Code. ADDITIONAL INFORMATION: Subsequent to Board members' request, the applicant's attorney provided the Board with copies of all certificates of occupancy and Pre-Co's issued for the property along with correlating permits,surveys and plans. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 1, 2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings:, 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant purchased the property in 2007. The existing house was constructed prior to 1957, and has a valid Pre-CO dated June 16, 1995.The original deck has a valid CO dated Aug. 25, 1980. The applicant is re-building the old decking entirely within the footprint of the existing deck. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant proposes to re-build the deck within the original footprint,which is+/- 14 feet landward of the top of the bank, and this requires a variance. 3. Town Law .4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 86%relief from the code.However, the original deck was issued a CO in 1980, and will be re-built within this footprint. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a re-built two story deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried,to Page 3, September 15,2016 #6980,Illuzzi SCTM No. 1000-137-4-5 GRANT the variance as applied for, and shown on the survey drawn by John T. Metzger, last updated on April 18, 2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The following recommendations made by the Soil and Water Conservation District will be implemented: a. Gutters and leaders shall be.installed on the existing dwelling to divert storm water/roof runoff into drywells on the subject property b. Applicant shall remove sprinklers installed along the top of the bluff 2. The deck will remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing-before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of-Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. At the time of the visit,the bluff appears to be in stablie condition. The bluff face is well established with vegetation and there are currently no signs of any significant erosion at the site. The deck is a two level construction with a screened in porch, an outer sitting area,and a sitting area above the screened in porch with access from the second story of the residence. Our recommendations,for the purpose of legalizing the as-built deck, are as follows. There is a railing missing on the second story deck that needs to be replaced,this is a safety issue not a resource concern. The main resource concern observed is stormwater management on the parcel. This is a narrow parcel that gently slopes towards the bluff. There are no apparent drywells on the property. The rooftop runoff is currently being diverted toward the bluff with corrugated pipe. Additionally,there are no provisions,gutters and leaders, made for stormwater capture concerning the second story sitting area. Our office recommends installing drywells and diverting all rooftop stormwater to them via gutters and leaders. An overhead sprinkler system is installed along the top of the bluff. It is never good practice to contribute any water on the bluff face. All water from irrigation should infiltrate into the ground where it is applied,our office recommends these sprinklers be removed. Irrigation runoff can eventually lead to severe erosion. The repairs Mr. Illuzzi was making to the existing decks were less tha 75% of the existing structure. The repairs to the existing deck was inspected and ertified to be less than 75% by Angel B. Chorno, Architect and his plans with the certific tion are herein attached ( Exhibit 2) The plans used by the builder to obtain building permit and certificate of occupancy required proper footings (Exhibit 3). The existing deck was suppose to have proper structural footings, however, when Mr. II uzzi was replacing the wood boards on the deck with trex, he found that the footings he d not been constructed to code, as the plans required. I have attached a photograph cf the inadequate footings which were at most 1' x 2' cylinders. (Exhibit 4) Mr. Fish appeared while Mr. Illuzzi was v�orking on the existing deck and directed him to get a building permit. Mr. Illuzzi did not elieve he needed a permit to make repairs to the deck in accordance with the origir al building permit and certificate of occupancy, particularly since the footings were already on the Town's approved plans. He was making the footings conform to the 997 architectural plans which were the basis of the Building Permit and CO. A letter to Gary Fish was submitted on October 23, 2015 detailing the work done and we hoped that this matter would be resolve . I was directed to file a building permit even though repairs were made in conformity w th an issued permit. After an initial review, the building department did not know if variance was required so they asked me to refer the matter to Chairperson Weisman to determine if the retaining wall of boulders to retain the soil was considered a "m rine structure". I submitted a letter to Chairperson Weisman on December 10, 2015. At about this same time the Town of Sou hold was amending the zoning regulations to remove the 75' setback to man m de structures, bulkhead, etc. from water bodies. Therefore, the boulders were not going to be an issue and the building department believed that a building permit appli ation could be issued. At the public,hearing the Town of Southb d code change was intended to treat a property containing a bulkhead the same as a p operty without a bulkhead leaving setbacks to wetlands up to the Trustees. In this same code amendment, the Town Board retained the 100 zoning setback from a bluff (bluffs are found along Long Island Sound and Fishers Island Sound). The issue of whether a bank and a bluff are synonymous was now left without a definition. Ii is subjective and on a case by case inspection of the building department. Town Code 280-116 (A) (1). The original house and deck has a certificate of occupancy. The rear deck was constructed in 1980 (Permit#10840Z). The owner purchased the house with the deck, repaired the deck and merely wants to retain the same deck which was made conforming to the specifications in the building permit plans. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The owner wishes to retain the existing structure,the Town Code changes adversely affect the preexisting lot and places the house and deck into greater nonconformity. 3. As you know, the existing house, addition, and all decks have certificates of occupancy. My client was making "in kind and in place" repairs to the existing decks (second story and first story 16 year old decks). The determination of"inconsistent" is based on inaccurate facts. The original house and 9980 first floor deck pre-dates Trustees jurisdiction, the additions and second story deck have Town Trustee's "wetland permits". The permits were transferred into Mr. Illuzzii's name after he purchased the house. The Zoning Board jurisdiction was recently revised ( setback from bulkhead) requiring the owner to await a determination if a variance would be required. As to buffers, the entire rear yard landward of the bulkhead is a natural buffer. The bark is naturally vegetated and "achieves high filtration efficiency of surface runoff'. Greater buffers could not be achieved. The bank is along the channels to Haywater's Q.6v16,& Mudd Creek and not subject to flooding or erosion. Due to the fact that the existing structures had certificates of occupancy &,W re merely being repaired and maintained, the project is "exempt" from LWRP.
