SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 5, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 12,334 sq. ft. parcel in the R-40 Zoning District with 75 feet of frontage along Oyster Pond Lane. The parcel shares boundary lines with residential parcels having 75.36 feet along the easterly property line, 162.23 feet along the northerly properly line, and 167 feet,along the southerly properly. The parcel is improved with a one story single family dwelling as depicted in a survey prepared by Nathan Taft Corwin III,L.S., last revised October 30, 2013. BASIS OF APPLICATION: Request for Variance(s) from Article XXIII, Section 280-124, and the Building Inspector's May 17, 2016 Notice of Disapproval based on an application for a building permit to construct additions to a single family dwelling, at; 1)proposed addition is less than the code required front yard setback of 35 feet; 2) proposed addition is less than the code required single side yard setback of 10 feet, located at: 230 Oyster Ponds Lane, Orient,NY. SCTM No. 1000-17-6-12. RELIEF REQUESTED: The applicant requests a variance for a front yard setback measuring 23.4 feet instead of the minimum of 35 feet permitted by code, and a side yard setback of 4.4 feet instead of the minimum 10 feet permitted by code in order to construct a one story front entry and enlarged attached garage addition and a two story addition to a single family dwelling. ADDITIONAL INFORMATION: The neighborhood consists of some one story small ranch type homes built in the late 50's and 60's, as well as larger historical homes. The 4.4 foot side yard setback proposed for the first and second floor additions maintains the existing non-conforming first floor side yard setback. The previous owner of the subject property was granted variances for proposed additions and alterations to the existing dwelling on June 9, 2014(ZBA#6756)for a proposed 27 ft. front yard setback and a 4.3 ft. side yard setback. Page 2, September 15, 2016 #6983,Ferrer SCTM No. 1000-17-6-12 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 1,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many of the homes in the area have significant non- conforming front and side yard setbacks, on non-conforming lots, of 20,000 sq. ft. or less. Improvements will be consistent with other nearby village properties. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The front yard setback of the existing dwelling is non- conforming at 28 feet, so any proposed addition to the front of the house will require a variance. The existing side yard setback of the one story house along the northerly property line is 4.4 ft. so any proposed first or second story addition over this section of the dwelling will require a variance. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 56% relief from the code for the 4.4 ft. side yard setback and 32%relief from the code for the 23.5 ft. front yard setback. However, the existing dwelling was built very close to the northerly side of the property instead of in the middle of the subject parcel, thereby creating the non-conforming 4.4 ft. northerly side yard and leaving a very large 31 foot southerly side yard. Additionally, a portion of the proposed second story addition (toward the rear of the house) will have a conforming 10 foot northerly side yard setback. The existing dwelling was also built with a non- conforming front yard setback and the proposed first floor addition on the front of the house will increase the degree of non-conformance for that setback for approximately half of the width of the existing front elevation. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law§267-b(3)(b)(5). The difficulty has been self-created. Although,the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b(3)(b)(6). Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variances as applied for, as shown on site plan, elevations, and floor plans (pages Al through A4) prepared by Frank Uellendahl,Architect, dated July 9, 2016. SUBJECT TO THE FOLLOWING CONDITION: 1. The roof deck must remain open to the sky. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The amount of relief requested is not substantial because: We are requesting 2 area variances: One to the first floor and one to the second. -we wish to add 5 feet to Y2 of the front fagade on the first floor to create a covered entry,incorporating an extension to the garage which is needed both to cause the entry to be architecturally incorporated in the design,as well as providing a safe indoor entry to the garage,which presently has a step that could be dangerous,caused by space limitations when a car is in the garage. -We wish to add a second story to the existing structure.In order to do this we need an area variance of 6.4 feet on the(western) front facade and 5.6 feet on the northern side.Being able to add to the entire existing footprint will be more attractive than the need to cut up the facades creating several small unattractive roof structures.It will also provide needed interior space,while keeping more of the rear yard as open space. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: our need to build a larger home will have less impact if we are permitted to build a second story on an existing structure,as it will provide the needed interior space without too much additional land coverage. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's April 7, 2014 Notice of Disapproval based on an application for building permit to construct additions and alterations to existing single family dwelling, at; 1) less than the code required front yard setback of 35 feet,2) less than the code required side yard setback of 10 feet, 3) less than the code required combined side yard setback of 25 feet. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to the existing single family dwelling with a front yard setback of 27 feet where the code requires 35 feet, a minimum side yard setback of 4.3 feet where the code required 10 feet and a combined side yard setback of 24.16 feet where the code requires 25 feet. ADDITIONAL INFORMATION: The immediate neighborhood is comprised of lots that are significantly non- conforming in size. The agent for the applicant provided information on the character of the neighborhood and similar variances granted for setbacks in the area. During the hearing, the agent for the applicant was questioned regarding the proposed at grade stone patio which places the lot coverage at a conforming 19.75 percent. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variances will not cause a detriment to the immediate neighborhood. The immediate neighborhood is comprised of older homes with non-conforming properties with non-conforming setbacks. Information submitted by the agent for the applicant indicates that numerous variances have been granted by the Board of Appeals in the Orient Hamlet.There are many other two story dwellings in the area similar in size and style to what the applicant proposes to construct. 2. Town Law §267-b(3)(bN2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The home has existed for more than 40 years in its present location. The applicant is proposing to convert the attached garage to habitable space on the existing footprint. The proposed additions will have conforming setbacks;however the minimum side yard exists at 4.4 feet and will not be changed. Although the lot is non-conforming in size at 12,344 sq.ft. it has a rather large rear yard. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 56% relief for the minimum side yard setback and 18%for the front yard setback.The combined side yard setback is not substantial representing 3.4% relief. However, the substantialty is mitigated by the fact the footprint will not be changing where the non-conformity exists. 4. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to the existing dwelling while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
