Zoning District, known as 730 Love Lane, Mattituck, NY; County Tax Map
District 1000, Section 140, Block 2, Lot 18.
WHEREAS, a public hearing was held on November 14, 1985 in the
Matter of the Application of FRANK AND DIANE AMMIRATI under Appeal
No. 3407; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question and the surrounding area; and
WHEREAS, the board has considered all testimony and documentation
submitted concerning this application, including testimony from an
adjoining property owner and to which reference is made for the
record; and
WHEREAS, the board made the following findings of fact:
1. The property in question is located in a "C-Light Industrial"
Zoning District at the east side of Love Lane, Mattituck, New York,
consists of an area of 34,578 sq. ft. with frontage (lot width) of
183.67 feet along Love Lane~ and is identified on the Suffolk County
Tax Maps as District 1000, Section 140, Block 2, Lot 18.
2. This is an application for a Special Exception in accordance
with Article VIII, Section 100-80(B)[13] for permission to establish
a "country store selling take-out prepared foods and specialty items"
including a catering-service business and in conjunction with the
owners' primary single-family residence use on the second floor and
separate single-family apartment use existing on the first floor
along the east side of the existing structure as shown on survey
dated September 25, 1985 prepared by Peconic Surveyors & Engineers,
P.C.

3. The premises is presently improved with: (a) a two-story
three-family dwelling constructed of wood with two porches; (b)
an accessory storage shed, all as indicated by the Pre-Certificate
of Occupancy issued under #Z-13881 dated September 25, 1985.
4. It is noted for the record that a Waiver under the provi-
sions of Article XVI, Section 100-160 was granted on October 8, 1985
by the Southold Town Board to the extent of permitting these uses,
and on November 18, 1985, the Southold Town Planning Board indicating its
position of no objection to this proposal.
5. It is the opinion of the board that applicants' request
to discontinue one apartment dwelling use at the west side of the
existing structure in order to establish the take-out prepared food
and specialty items services within the 470 sq. ft. floor area as
outlined on sketch received November 14, 1985, will be consistent
with the intent of Article VIII of the Zoning Ordinance.
In considering this application, the board has: (a) considered
items Ia] through [1] of the zoning code; (b) determined the use
will not prevent the orderly and reasonable use of adjacent properties
or of properties in adjacent use districts; (c) determined the
safety, health, welfare, comfort, convenience and order of the town
will not be adversely affected by the proposed use and its location,
(d) determined that the use is in harmony with and will promote the
general purposes and intent of zoning since this is a use permitted
by legislative action and will meet the requirements of the zoning
regulations.
Accordingly, on motion by Mr. Goehringer, seconded by Mr. Sawicki,
it was
RESOLVED, to GRANT a Special Exception use as applied under
Appeal No. 3407 in the Matter of the Application of FRANK AND DIANE
AMMIRATI to establish a "country store selling take-out prepared
foods and specialty items including a catering-service business"
within the westerly half of the first-floor area as exists of
470 sq. ft. SUBJECT TO THE FOLLOWING CONDITIONS:
1. Any further expansion of the business use of these
premises for more than 470 sq. ft. floor area as applied will
require a new application to this board for consideration;
2. The business use granted shall be only for the selling
of take-out prepared foods and specialty items including a
catering service which is limited to the westerly half of the
existing building of 470 sq. ft. as applied;
3. The dwelling uses of the subject premises shall be
reduced from three to two single-family dwelling units, one
on the first floor and the other on the second floor.
4. This project shall receive all approvals from the
Suffolk County Department of Health Services and other agencies
as may be required by law.
Vote of the Board: Ayes: Goehringer, Grigonis, Douglass
and Sawicki. (Member Doyen of Fishers Island was absent due to
weather conditions.) This resolution was adopted by unanimous
vote of four of the members present.

Regarding
Inc.
Regarding your recent request for a confirmation of outstanding
issues that exist at the William Gasser/Armored Foundation,
Inc. I submit the following:
There are a number of changes recommended by the Planning Board,
to be made to the site plan and are listed in the attached
letter. The letter was sent to Mr. & Mrs. Gasser and is dated
1/21/94.
Regarding the tower location and height, it is required to be
in the rear yardand meet all requirements oran accessory
building as set forth in Article IX Chapt. 100-91C.(1)
Considering the unique shape of this lot, there is a question as
to what is the front yard. I see the lot as having two front
yards and the tower would be required to be moved to be in
compliance. I am almost compelled to request an interpretation
from the Board regarding this matter and may in the future.
As far as the use of the property goes, a museum is clearly a
permitted use in a HB District. Article IX Chapter 100-91
A.(17) It is subject to site plan approval however, and the
Gasser's are fully aware of this and have assured me that they
will make every effort to comply with any and all
recommendations fromthe Planning Board regarding their site
plan.
The Town Board approved the Zone change from a LI and RO to
a HB District on Sept. 21, 1993. The State Environmental
Quality Review (SEQR) process, as requested by the Town Board,
was successfully completed and a negative declaration was
adopted.
In regards to outside storage, I cannot find anywhere in the
Town Code, under Hamlet Business, where it restricts outside
storage. The Town Code does however, address this issue in
the residential districts.
As you are well aware, there is a dissapproval now pending
for two signs. The application was disapproved because the
signs are too close to the road and do not meet the required
set back.
I spoke with Mrs. Gasser by phone on 4/25/94, and she indicated
to me at that time that she is diligently pursuing a resolve to
this whole matter. She has been in contact with the Health
Dept. a number of times and is submitting a revised site plan
to the Planning Dept. by the end of the week.
The Building Dept. is monitoring the progress'of this project,
as we do all other projects of this nature and is well aware of
the outstanding issues.
I trust this memo clarifies most, if not all of the issues in
question. I look forward to any future correspondence from the
ZBA.

The Planning Board has reviewed the conditions, contained in the
Town Board's rezoning decision and reviewed the Site Plan dated
September 9, 1991.
The following changes must be made before the Board Can proceed
with its review:
1. The scale of the plan must be 1" = 20'.
2. The height and type of fence must be shown.
3. Screening must be placed between the museum property
line and the residential properties to the north east
and the northwest and to the Hamlet Density property to
the northwest.
4. The tower must be moved to a point not closer than one
hundred feet from the Love Lane entrance and shown on
the plan.
5. Handicapped space and paved surface must be accessible
to building.
6. Parking calculations and a notation regarding
accessibility of public parking must be shown on the
plan.
7. Zone must be indicated.
8. Percent landscaped and percent lot coverage must be
shown on the plan.
Key map showing the location and owners of all adjoining
lands within five hundred (500) feet, as shown on the
latest tax records, at a scale of one (1) inch equals
one hundred (100) feet.
10. Any proposed outdoor lighting must be shown. This
lighting must indicate type and wattage and must be
shielded to the premises.

Board, Monday, November 18, 1985.
RESOLVED that the Southold Town Planning Board forward the
following comments to the Board of Appeals regarding the site
plan for Frank and Diane Ammirati:
The Planning Board has no objection to this proposal
for conversion of an existing three-family house to a take
out food and catering business with a dwelling use. The
Board noted that there would be no adverse impact to the
neighborhood and there would be buffering along the residential
property.
