THURSDAY, MAY 16, 2002 PUBLIC HEARING
NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100
(Zoning), Code of the Town of Southold, the following application will be heard at public
hearings by the SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main
Road, Southold, New York 11971, on Thursday, May 16, 2002, at the time noted below (or
as soon thereafter as possible):
6:20 pm Appl No. 5099 - Mattituck Historical Society. This is a request for a Lot
Waiver under Section 100-26 to unmerge Mattituck Estates Subdivision (vacant)
Lot 57, from combined Lots 58 and 59. Based on the Building Department's
February 12, 2002 Amended Notice of Disapproval, Lot 57 is merged with Lots 58
and 59. Property Location: West Side of Cardinale Drive and 18200 Main Road,
Mattituck; Parcel 115-4-18.1. Zone District: R40.
The Board of Appeals will hear all persons, or their representatives, desiring to be heard
at each hearing, and/or desiring to submit written statements before the conclusion of
each hearing. Each hearing will not start earlier than designated above. Files are
available for review during regular Town Hall business days from (8:00 a.m. to 3:00 p.m.).

c.The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit

Dear Mr. Goehringer,
The Board of Trustees and Board of Directors of the Mattituck Historical Society have once
again reviewed the proposal to sell lot 18.1,AKA lot#57.
Even though the Mattituck Historical Society is unable to meet the cost of major repairs at
this time without revenue from the sale of the lot, after careful consideration we have decided first
' to attempt to raise the funds through other methods. We therefore would like to cancel our
application for merger determination for the time being,but leave the option open to reapply at a
future date if the necessity arises.

Gentlemen:
Following our inspection of the deteriorated floor structure systems under
the east end of the Society's house on Route 25, Mattituck, we offer the
following estimates:
A. - To reinforce the floor system under the Dining Room -- $ 6,400.00
Includes:
-- Gaining access to the shallow crawl area
-- Temporary structure support as required
-- Supply and install new floor beams
either side of existing rotted beams
-- Supply and install new girders
-- Chisel out and replace rotted sills
-- Clean out crawl space and remove debris.
B. - To reinforce the floor system under the entire old
east end section -- $17,200.00
Includes:
-- Gaining access to shallow crawl space
(includes removing and reinstalling
some heating ducts)
-- Items as above -- new floor beams, girders and sills
-- Add new foundation vents for air circulation
-- Clean up and debris removal .
This work will all be done from the very limited space below the floor
to avoid damage to the antique floor boards or the historical integrity of
the rooms.

Chapter 100 -Zoning
§ 100-24. Lot recognition. [Added 11-28-1995 by L.L. No.23-1995; amended 7-22-97 L.L. 22-1997]
A. A lot created by deed or town approval shall be recognized by the town if any one (1) of
the following standards apply and if the lots have not merged:
(1) The identical lot was created by deed recorded in the Suffolk County Clerk's office on
or before June 30, 1983, and the lot conformed to the minimum lot requirement(s) set forth
in Bulk Schedule AAEN as of the date of lot creation.
(2) The lot(s) in question is/are approved by the Southold Town Planning Board.
(3) The lot(s) in question is/are shown on a subdivision map approved by the Southold
Town Board prior to June 30, 1983.
(4) The lot(s) in question is/are approved and/or recognized by formal action of the Board
of Appeals prior to June 30, 1983.
B. All lots which are not recognized by the town pursuant to the above section shall not
receive any building permits or other development entitlements.
C. All lots are subject to the merger provisions of§ 100-25.
§ 100-25. Merger. [Added 11-28-1995 by L.L. No.23-1995]
A. Merger. A nonconforming lot shall merge with an adjacent conforming or
nonconforming lot which has been held in common ownership with the first lot at any time
after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course
of fifty (50) feet or more in distance. Nonconforming lots shall merge until the total lot size
conforms to the current bulk schedule requirements.
B. Definitions. "Common ownership" shall mean that the parcel is held by the same
person in the same percentage of ownership as an adjoining parcel.
C. Exceptions. Lots which are recognized under § 100-24 and meet any of the following
categories shall be exempt from the merger provision set forth above and shall not be
deemed merged by operation of this chapter:
(1) The nonconforming lot has a minimum size of forty thousand (40,000) square feet, or
(2) The nonconforming lot obtained a lot size variance from the Zoning Board, or
(3) If the lot is not on the maps described in former § 100-12,EN the nonconforming lot
has been held in single and separate ownership from July 1, 1983 to date, or
(4) [Amended 3-4-1997 by L.L. No. 4-1997] If the lot is on the maps described in former§ 100-12,
the nonconforming lot has been held in single and separate ownership from January 1,
1997, to date.

(5) Each lot is currently developed with a one-family dwelling with a minimum 850 square
feet which falls within the existing lot lines and which has a certificate of occupancy or
would qualify for one. [Added 3-4-1997 by L.L. No. 4-1997]
D. [Amended 3-4-1997 by L.L No 4-1997] Proof of merger. The town shall require a person
seeking determination of merger to provide any or all of the following documents for
evaluation:
(1) Proof of the date when the lot was created and the size of the lot, together with a copy
of a legal description of the parcel, all to the satisfaction of the town.
(2) A copy of the current tax map and survey of the lot.
(3) A copy of the original survey of the lot.
(4) A title search showing single and separate ownership of the property from July 1,
1983, to the present time, prepared by a Suffolk County title insurance company
indemnifying the Town of Southold with $25,000 of insurance.
(5) Other additional information or documentation as may be deemed necessary.
E. Effect of merger. No building permit or other development entitlement will be issued by
the town until this section has been complied with. The Building Department will issue a
written determination whether a property falls within an exemption to the merger provision.
§ 100-26. Waiver of merger.
A. If a lot has merged, the Zoning Board of Appeals may waive the merger and recognize
original lot lines upon public hearing and upon finding that:
(1) The waiver will not result in a significant increase in the density of the neighborhood.
(2) The waiver would recognize a lot that is consistent with the size of lots in that
neighborhood.
(3) The waiver will avoid economic hardship.
(4) The natural details and character of the and character of the contours and slopes of
the lot will not be significantly changed or altered in any manner, and there will not be a
substantial filling of land affecting nearby environmental or flood areas:

your request, by Wedneday, May 1St, to all owners of land (vacant or improved) surrounding yours,
including land across any street or right-of-way that borders your property. Use the current
addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or
the County Real Property Office in Riverhead. If you know of another address for a neighbor, you
may want to send the notice to that address as well.
When picking up the sign, a $15 check will be requested for each as a deposit. Please post the
Town's official poster/sign no later than May 8th. Securely place the sign on your property facing
the street, no more than 10 feet from the front property line bordering the street. (If you border more
than one street or roadway, an extra sign is available for the additional front yard.) The sign(s)
must remain in place for at least seven (7) days, and should remain posted through the day of
the hearing. If you need a replacement sign, please contact us.
By May 8th, please either fax or deliver to our office your Affidavit of Mailing (form enclosed) with
parcel numbers noted for each, and return it with the white receipts postmarked by the Post
Office. The original Affidavit is due not later than the date of the hearing. Also, when the green
signature cards are returned to you by the Post Office, please mail or deliver them to us before the
hearing, if possible. If any signature card is not returned, please advise the Board at the hearing.
These will be kept in the permanent record as proof of all Notices.
By May 15th, after the signs have been in place for seven (7) days, please submit your signed
Affidavit of Posting to our office. A copy may be faxed to us, with the original furnished during the
hearing.
If you do not meet the deadlines stated in this letter, please contact us promptly. Thank you for

The- Chairman opened the hearing by reading the application
for a special exception, legal notice of•hearing, affidavit
attesting to its publication in the official newspaper, and
notice' to the applicant.
THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
ALEXANDER CHASE, ESa.: I would like to add something. I
am the Secretary and Counselor for the Subdivision. I would like
to add into the record,, I have a letter signed by Martin Sidor
and Frank' Sidor. One of the signs is on their property. They
have no objection to the placing of the sign on their property.
I have a similar letter from the Mattituck Historical Society.
There is no objection to the placing of that- sign.
THE CHAIRMAN: These are the only two of the several signs
that- are located on property that is sold? •
.ALEXANDER C1ASE, ESQ.: That is correct.
THE CHAIRMAN: We have granted reduction in setback in
other cases.
ALDER CHASE, ESQ.': These signs are not overly large,
just- large enough to be seen.
MR'. HULSE: How far back' are the signs placed?
FIR. BERGEN: Fromthe center of the Main Road they are KU
63 feet. From New Suffolk Avenue they are 45 feet.
SHE CHAIRMAN: Do you intend to dedicate the roads in the
subdivision?

MR. HULSE: How far from that road line are the signs?
- TSR. BERGEN: There is 63 feet between the two signs. They
are on- private property five to seven feet from theroad line.
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(There was no response.)
After investigation and inspection the Board finds that
- the appellant request permission to retain subdivision identification
signs with insufficient setback. Three of the identification
signs axe on the property of the appellant. Two of the signs
are on ether private property. There is one •sign on lot number
59 in Mattituck- Estates Subdivision, oWned•by Mattituck Historical
Society. Appellant has permission from said owner to maintain
a sign on lot number 59. There is also a sign- on lot number 30
in Mattituck- Estates Subdivision, owned by Martin and Frank- Sidor.
Appellant has permission from said owner to maintain a sign on
lot number 30. The Board finds that the signs in question do
not obstruct the vision for traffic and the signs are in no "
way a traffic hazard. It is the opinion of the Board that it
is better to have the type of signs which the appellant is
applying for, rather than have one double face sign at- the
entrance to the subdivision.
.-, The Board finds that the pbulic convenience and welfare
and justice will be served and the legally established or
_ pe pitted: use of neighborhood property and adjoining use
districts will not be permanently or substantially injured
and the spirit of the Ordinance will be observed.
- On motion by Mr. Gillispie, seconded by Mr. Grigonis, it was
RESOLVED that Mattituck Estates Subdivision, Mattituck, New
York, be granted permission to retain subdivision identification
mtgg signs with insufficient setback at the followin g locations:
