PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the north side of Sound View Avenue, Southold. The property contains 31,645 sq. ft. in area with 115 ft. frontage along Soundview Avenue and 111 linear ft. along Great Pond (lake frontage). This lot is improved with an existing dwelling centered near the northerly half of the property, as shown on survey prepared by John T. Metzger of Peconic Surveyors May 20,2002. BASIS OF APPLICATION: Building Department's May 30, 2002 Notice of Disapproval, amended June 4, 2002, denying a permit for additions and alterations to a single-family dwelling on the grounds that the new construction will have a rear yard setback of+- 42 feet instead of the code-required 50 foot minimum pursuant to Article XXIV, Section 100-244, and less than 75 feet from a water body pursuant to 100-239 (4)(C). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 25, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence,the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: Applicant was disapproved in his building permit application dated February 26, 2002 to the Building Department to construct additions shown on design plans dated 11/23/01 prepared by John A. Barbiere, Architect, with variable setbacks at 29+-feet, +-42 ft and 66 ft. at the closest points to the rear property line (tie line) along Great Pond. Great Pond is a freshwater body of water regulated under Zoning Code Section 100-239.4C for a minimum setback of 75 feet REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection,the Board makes the following findings: T1, Page 2 -July 25, 2002 ZBA Appl. No. 5173 - R. Meyer Parcel 59-6-1 at Southold 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicant wishes to construct a second-story addition and an attached deck to gain additional space and to accommodate the special needs of applicant's mother, who is wheelchair bound. The lot is heavily wooded, and shrubs and landscaping provide screening and privacy from neighboring properties. The house is well established in the center of this irregularly shaped lot with a 37+- acre parcel (Peconic Dunes) on the west side and a similar shaped lot of the same size on the east side. Only the setbacks to the northerly property lines are non-conforming in this request. The proposed additions will enhance the residence with no ill effects on the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue other than an area variance. The house is set back 50 ft. from the water's edge instead of the code required 75 ft. minimum. No second-story addition would be possible without a variance. The small deck addition will provide access to the outdoors, fresh air and enjoyment for a handicapped individual. Without the deck, such access would be unnecessarily difficult. Also, the house is existing and cannot be moved to allow for a greater setback without a financial hardship for the applicant. 3. The variance granted herein is substantial in relation to the code's 75-foot required setback to the water's edge, and 50-foot required rear yard setback. However, the variances granted will modestly decrease the structure's existing setback by only 8 feet. Similar circumstances exist for other lots to the east of this property. 4. The alleged difficulty has been self-created and is due to the applicant's reasonable desire to gain additional living space, and to provide handicapped outdoor access for applicant's mother. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to this board to suggest that this minor variance will have any adverse impact. Also, the applicant has submitted information with regard to a Board of Town Trustees determination issued under Permit 145532 on or about May 23, 2002. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions to their single-family residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Orlando, and duly carried to GRANT the Variances as applied for in accordance with the survey prepared by John T. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the north side of Sound View Avenue, Southold. The property contains 31,645 sq. ft. in area with 115 ft. frontage along Soundview Avenue and 111 linear ft. along Great Pond (lake frontage). This lot is improved with an existing dwelling centered near the northerly half of the property, as shown on survey prepared by John T. Metzger of Peconic Surveyors May 20, 2002. BASIS OF APPLICATION: Building Department's May 30, 2002 Notice of Disapproval, amended June 4. 2002, denying a permit for additions and alterations to a single-family dwelling on the grounds that the new construction will have a rear yard setback of+- 42 feet instead of the code-required 50 foot minimum pursuant to Article XXIV, Section 100-244, and less than 75 feet from a water body pursuant to 100-239 (4)(C). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 25, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: Applicant was disapproved in his building permit application dated February 26, 2002 to the Building Department to construct additions shown on design plans dated 11/23/01 prepared by John A. Barbiere, Architect, with variable setbacks at 29+-feet, +-42 ft. and 66 ft. at the closest points to the rear property line (tie line) along Great Pond. Great Pond is a freshwater body of water regulated under Zoning Code Section 100-239.4C for a minimum setback of 75 feet REASONS FOR BOARD ACTION:, Based on the testimony and record before the Board and personal inspection,the Board makes the following findings: V s G D - t � Page 2 -July 25, 2002 • _ . ZBA Appl. No. 5173- R. Meyer Parcel 59-6-1 at Southold 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicant wishes to construct a second-story addition and an attached deck to gain additional space and to accommodate the special needs of applicant's mother, who is wheelchair bound. The lot is heavily wooded, and shrubs and landscaping provide screening and privacy from neighboring properties. The house is well established in the center of this irregularly shaped lot with a 37+- acre parcel (Peconic Dunes) on the west side and a similar shaped lot of the same size on the east side. Only the setbacks to the northerly property lines are non-conforming in this request. The proposed additions will enhance the residence with no ill effects on the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue other than an area variance. The house is set back 50 ft. from the water's edge instead of the code required 75 ft. minimum. No second-story addition would be possible without a variance. The small deck addition will provide access to the outdoors, fresh air and enjoyment for a handicapped individual. Without the deck, such access would be unnecessarily difficult. Also, the house is existing and cannot be moved to allow for a greater setback without a financial hardship for the applicant. 3. The variance granted herein is substantial in relation to the code's 75-foot required setback to the water's edge, and 50-foot required rear yard setback. However, the variances granted will modestly decrease the structure's existing setback by only 8 feet. Similar circumstances exist for other lots to the east of this property. 4. The alleged difficulty has been self-created and is due to the applicant's reasonable desire to gain additional living space, and to provide handicapped outdoor access for applicant's mother. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to this board to suggest that this minor variance will have any adverse impact. Also, the applicant has submitted information with regard to a Board of Town Trustees determination issued under Permit 45532 on or about May 23, 2002. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions to their single-family residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Orlando, and duly carried to GRANT the Variances as applied for in accordance with the survey prepared by John T. KENNETH SCHOLD, Southold, New York: My purpose in doing this, as stated by the application, I have five build- ings in existence there which are buildings built over a period of at least 20 years, pond less, some were built 30 years ago. They were built on the ground, more or less, on blocks, and are now at the point beyond practical repair. (The Board examined the sketch and discussed same. ) MR. SCHOLD: This will replace and will not add to any space which we had. (The Board discussed the previous layout and just what buildings this new building will replace. ) MR. SCHOLD: In the past 25 years we have grown from a camp of 50 to 150 campers and a total camp family of 210 people. MR. DOYEN: Where do the campers come from? MR. SCHOLD: long Island, the metropolitan area, New Jersey, Connecticut. MR. DOYEN: Is it privately operated? MR. SCHOLD: Yes, it is. TERRY: The narrowest point is 15 ft. MR. SCHOLD: The access will be improved by tearing down one of the buildings.
