SCTM No. 1000-116-1-1.2
Dear Mr. and Mrs. Wiseman;
We are in receipt of your correspondence, received July 15, 2024, requesting a de minimus approval
related to ZBA determination#5138, dated July 25, 2002, in which variance relief was granted to
construct an in-ground swimming pool, upon the above referenced premises.
In your letter, you described your meeting with the Southold Town Board of Trustees and your
discussion with them about relocating the swimming pool more than 100 feet landward of the wetlands,
which would place the pool outside of Board of Trustee's jurisdiction. In this proposed location, the
pool will continue to be located in the side yard of the property.
I have reviewed your request, the hand drawn edits to a survey that you provided, and have determined
that the relocation of the swimming pool as depicted, is de minimus in nature.
Please provide this Board with two (2) original updated signed and scaled surveys of the proposed
change, and contact our office if you have any further questions.

Zoning Board of Appeals
Attention: Leslie Kanes-Weisman, Chairperson
And the Zoning Board of Appeals
By email
Ladies and Gentlemen,
We are writing to you in connection with a de minimis-update to a variance that was granted on
a property that we are purchasing at8581 New Suffolk Avenue, Cutchogue. The variance that
was granted in 2002 is attached to this letter and was a variance for a 20 x 40 pool to be located
in the side yard of the residence at a distance of 85 feet from the wetlands that are behind the
house. At the time the variance was granted, the Trustees also granted a permit to install the
pool; however, that permit expired after two years, while the variance granted by the Zoning
Board remains in effect.
The de minimis changes that we would like to make are as follows: we would first like to situate
the pool further away from the wetlands by placing the pool at approximately the midpoint of the
center of the side of the house, more than 100 feet from the wetlands, which would situate the
pool completely in our side yard (see attached proposed mock-up). We also would like to install
a small, five-by-five foot hot tub in the pool, thus increasing its length by five feet (20 x 45
instead of 20 x 40).
We met with the Trustees on July 9th and discussed our thoughts with them about relocating the
pool landward of the wetlands, which was met with a favorable response, as they encouraged
us to place the pool outside their jurisdiction.
We are excited to become members of the Southold community and look forward to many years
in our new home. Please let us know if you require additional information for us to make these
small changes to the approved permit, and thank you in advance for your consideration.
Sincerelly yours,

BOARD OF APPEALS
TOWN OF SOUTHOLD
FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF JULY 25, 2002
Appl. No. 5138 - NANCY BRUSH
Property Location: 8581 New Suffolk Avenue, Cutchogue
CTM #116-1-1.2
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type Il category of the
State's List of Actions, without an adverse effect on the environment if the project is implemented as
planned as a setback or lot line request.
PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the easterly side of a
private right-of-way which extends north from New Suffolk Avenue in Cutchogue. This lot is shown
as Lot 3 on the Minor Subdivision Map of Winds Way with a total lot area of 2.46 acres (upland and
marsh areas). The lot is improved with a 1-1/2 story frame house with deck as shown on the survey
prepared by Roderick VanTuyl, P.C. dated October 4, 1994, last amended June 7, 1995.
BASIS OF APPLICATION: Building Department's April 1, 2002 Notice of Disapproval denying a
permit to construct an accessory swimming pool on the grounds that the pool is proposed partly in a
side yard instead of the required rear yard, provided under Zoning Code Section 100-33.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 25~ 2002, at which time
written and oral evidence was presented. Based upon all testimony, documentation, personal
inspection of the property and the area, and other evidence, the Zoning Board finds the following facts
to be true and relevant.
AREA VARIANCE RELIEF REQUESTED: Applicants request a location of an accessory 20' x 40'
in-ground swimming pool behind the house, in the south yard area, with setbacks of 85 feet from the
westerly lot line and approximately 115 feet from the easterly (rear yard) line at its closest point.
REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and
personal inspection, the Board made the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties. The property is a large wooded lot. The topography
of the land consists of marsh land and restricted non-building areas, regulated under the wetland
ordinances by other agencies. Applicant is proposing placement of the pool in an area that is best
suited since this area is more level and provides a buffer between the structure and woodland adjacent
to the marsh on this 2.6 acre lot.
2. The benefit sought by the applicant cannot be achieved by some method, possible for the applicant
to pursue, other than an area variance. There is a steep slope from the residence to the meadow land
in the rear yard, a conforming area, which makes it difficult to locate a pool. In addition, the
ZBA Appl. No. 5138 - Nancy Brush
Parcel 116.-1-1.2 at Cutchogue
applicant's have tried to maximize the distance between the pool and the meadow lands to mitigate
potential impacts to the environment.
3. The variance granted herein is not substantial in relation to the code's required rear yard location
because only part of the in-ground pool will be located in the side yard. A major part of this pool
structure is behind the dwelling, at the south side of the site.
4. The alleged difficulty has been self-created and is due to the applicant's desire to enjoy an in-ground
swimming pool.
5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact
on physical or environmental conditions in the neighborhood. The variance granted is not substantial.
A major part of this pool structure is behind the dwelling, at the south side of the site.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a~in-ground swimming pool while pres~erving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Chairman Goehringer, seconded by Member
Orlando, it was
RESOLVED, to GRANT the variance, as applied for in accordance with the pool location
shown on the survey prepared by Roderick VanTuyl, P.C. dated October 4, 1994, last amended July 7,
1995.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other features
as are expressly addressed in this action.
VOTE OF THE BOARD: AYES: Members Goehringer (C~orgc~I~nd Orlando.

Dear Mrs. Wiseman;
We are in receipt of your email correspondence, dated January 5, 2025, requesting an amendment to a de
minimus approval related to ZBA determination#5138, dated July 25, 2002, in which variance relief
was granted to construct an in-ground swimming pool, upon the above referenced premises.
A de minimus approval was granted on July 25, 2024 to allow the relocation of a swimming pool
located in the side yard in order to place the pool outside of the Board of Trustee's jurisdiction. After
review of the Board's de minimus approval, and upon a site inspection, the Town's Building Inspector
determined that the relocated swimming pool will require additional variance relief for"partial front
yard location and distance from the Right of Way".
I have reviewed your request for additional variance relief and have determined that the relocation of the
swimming pool as depicted, is de minimus in nature subject to the following conditions:
1. A continuous row of evergreen plantings shall be installed along the right of way to screen the
in-ground swimming pool.
2. The applicant shall submit two signed and sealed surveys/site plans to the satisfaction of the
Zoning Board of Appeals depicting the proposed evergreen screening prior to the issuance of a
Certificate of Occupancy.
Please `ntact our office if you have any further questions.

Ladies,
Thanks so much for responding and clarifying your request that we send a letter asking for an
amendment to the de minimus approval to include relief for the partial front yard location and distance
to the right of way. I also want to sincerely apologize that the location was in anyway not fully clear- it
was never our intention to fail to disclose any information and we are committed to complying with all
town requirements. The architectural drawing attached to the request(which appears below), shows the
road and the house in location to the pool, and we have followed those plans exactly as approved. For
what it is worth,we were told that our location is side yard, not front yard, and we were also told that
since we own the road (and our neighbors have a right of way to travel on it) and we own property on the
far side of the road, that the pool is not set too close to our property line.
And if I may ask, our building permit application was filed in September and were told that it would take
approximately eight weeks to be reviewed, but with the holidays, that was obviously a bit aggressive a
timeline. Do you have any sense of when that permit application might be reviewed? We are trying to
figure out timelines, to the extent possible.
Thanks so much,
Susan and Stephen Wiseman

Dear Ms. Fuentes,
I am writing to update the request for a de minimis variance letter that my husband and I
sent to the ZBA on July 15th,which appears below. We just received the updated survey
and we had our architect draw in the relocated pool that is the subject of our July 15th
Letter. As we explained in that letter,we are seeking a variance to move the pool further
away from the wetlands, outside the jurisdiction of the Board of Trustees. The updated
survey is attached below.

Thank you so much for your assistance in seeing that the ZBA receives this additional
information.

Hi Susan,
The ZBA approved the amended location (in the side yard) of the swimming pool in our letter
dated July 25, 2024, but it was later determined that the amended location requires additional
relief from the Zoning Board of Appeals. Nancy and I are asking that you send us a request in
writing to amend the de minimus approval to include zoning relief for "the partial front yard
location, and distance to the right of way".
Once we receive your communication, we will be happy to respond by a letter regarding an
amendment to the de minimus approval.

Hi Nancy,
Happy New Year to you as well. We are so excited to be new homeowners in the fabulous town and can't
wait to be part of the community.
I'm so confused by your email. There has been no "shift" in the location of the pool,as shown on the
approved plans submitted and already approved byyour office. The pool is exactly where the plans show
it to be. Additionally, my understanding is that you spoke with my pool contractor and told him to
continue with his work last week, prior to emailing me this morning. Can you please confirm tome in
writing that there is nothing required by me at this point, and if you are looking for something from me,
can you clarify what you are referring to since the pool is exactly what we received approval to build.
I want to be a good citizen of the town as a new homeowner there and greatly appreciate your response
and clarification.
Thanks so much!

BOARD OF APPEALS
TOWN OF SOUTHOLD
FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF JULY 25, 2002
Appl. No. 5138 - NANCY BRUSH
Property Location: 8581 New Suffolk Avenue, Cutchogue
CTM #116-1-1.2
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of the
State's List of Actions, without an adverse effect on the environment if the project is implemented as
planned as a setback or lot line request.
The Zoning Board of Appeals held a public hearing on this application on July 25, 2002, at which time
written and oral evidence was presented.
In addition, the
Page 2 - July 25, 2002 ·
ZBA Appl. No. 5138 - NancyB~ush
Parcel 116.-1-L2 at Cutchogue
applicant's have tried to maximize the distance between the pool and the meadow lands to mitigate
potential impacts to the environment.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of aRia-ground swimming pool while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Chairman Goehringer, seconded by Member
Orlando, it was
RESOLVED, to GRANT the variance, as applied for in accordance with the pool location
shown on the survey prepared by Roderick VanTuyi, P.C. dated October 4, 1994, last amended July 7,
1995.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other features
as are expressly addressed in this action.
VOTE OF THE BOARD: AYES: Members Goehrin~er (C '~or~0rni'fi~3and Or. Ado.
(Absent was Member Oliva.) This Resolution was duly-~ med~~/-JgdO~pted (4-0). J :////~~.~/~ j
