AREA VARIANCE REQUESTED: Applicant requests a variance for a 32 ft. by 14 ft. as-built deck addition, part of which,approximately 7.6 ft. by 14 ft is set back less than the code's 15 foot minimum. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 25, 2002 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence,the Zoning Board finds the following facts to be true and relevant PROPERTY FACTS: Applicant's property is located on the north side of a Village lane in Mattituck. The lot is improved with applicant's one story house and garage and the as-built attached deck addition, all as shown on the site plan prepared by Young and Young, P.E, dated January 29, 2002, and the survey prepared by Peconic Surveyors dated June 8, 1988. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1: Grant of-the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The deck addition has existed in its current location for at least seven years with no apparent ill effects to surrounding neighbors. The deck is screened from view of the adjoining property owners by evergreen hedges, and follows the existing side yard setback of the residence. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The deck addition is built. The only remedy would be to remove the approximately 7.6 ft. by 14 ft of nonconforming deck area which would be costly and serve no public benefit since the nonconforming area of the deck aligns with the nonconforming area of the residence. The variance grantedherein is substantial in relation to the code's, 15-foot-nvnimum single side yard. requirement and represents a 50 percent reduction. However, the code also requires total side yards of 35 feet for this size lot and the applicant exceeds the minimum with a total side yard setback of+/-57.7 feet. 4. The alleged difficulty has been self-created because construction took place without the required town permits. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck addition to a single-family residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Chairman Goehringer, and duly carried,to GRANT the Variance authorizing, a 14 ft. by 32 ft. as-built open deck addition with a single side yard setback of+/- 7.6 ft. at its closest point to,the south property line; and on CONDITION that the deck remain unenclosed and open to the sky. The deck is screened from view of the adjoining property owners by evergreen hedges, and follows the existing side yard setback of the residence. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The deck addition is built. The alleged difficulty has been self-created because construction took place without the required town permits. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. The Ordinance permits a five foot porch and this type of porch the applicant is asking for is eight feet. This is a self imposed hardship/ We have given this man a side yard variance for the garage. This is a flagrant violation of the Zoning Ordinance and this porch must be reduced to five feet, After investigation and inspection the Board finds that the applicant requests permission to reduce the front yard setback by erecting a front porch which will project eight feet. The Zoning Ordinance of the Town of Southold permits a five foot porch. The''' Board finds there is no hardship involved, The hardship is a self- imposed hardship. The Board finds that strict application of the Ordinance will not produce practical difficulties or unnecessary hardship; the hardship created is not unique and, would be shared by all proprties alike in the immediate vicinity of this property and in the same use district; and the variance would change the character of the neighborhood, and would not observe the spirit of the Ordinance.
