No. 5098—GEERT MARTENS,RAYMOND MURRAY Property Location: 5028 New Suffolk Avenue,Mattituck CTM Parcel: 115-10-2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Unlisted category of the New York State List of Actions, without an adverse effect on the environment if the project is implemented as planned as a fence height request. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on a private right-of-way which extends off the east side of Marratooka Road in Mattituck. The property is improved with a single-family dwelling with deck addition, inground pool and accessory building, as shown on the survey prepared December 23, 1999, last amended January 29, 2002 by Joseph A. Ingegno, L.S. The property consists of 46,012.16 sq. ft.with 274+-ft. of water frontage along Deep Hole Creek. BASIS OF APPLICATION: Building Department's February 5, 2002 Notice of Disapproval for a permit to increase the height of fence areas greater than the code limitations of Section 100-231. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 25, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: The applicants have an existing fence to the side of the house that they would like to extend to 10 ft. 7 inches in height, aligned with an existing accessory building. (Please refer to drawings prepared by William Bialosky, Architect, dated July 27, 2001 (A-1, A-2). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. The grant of an area variance to this applicant would produce an undesirable change in the character of the neighborhood, and would be a detriment to nearby properties. The height and magnitude of the applicants' proposed fence exceed that allowed by Town Zoning Code. The height requested at 10 ft. 7 inches would result in a fortress-like appearance from neighboring lands and roads, that will be very noticeable and rise up from an otherwise open vista across a rural landscape. 2. The benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance. The alterative for plantings of evergreen hedgerows would accomplish the same desired effect of privacy without compromising the intent of Town Zoning Code. VPage 2—July 25, 2002 /131CcZBA Appl. Both the height and the length of the proposed fence greatly exceed what is allowed for by Town Zoning Code, at 50% or greater than that allowable by code in the township. 4. The variance if granted would have an adverse effect and impact on the physical and environmental condition in the neighborhood and district. The proposed fence height is extreme and is massive, at odds with those existing in the community and area. This would not be within the residential appearance of the Residential Zone District in which the property is located. 5. The difficulty is self-created and is personal to the owners, rather than uniquely related to the property, or to the standards of law which apply to prohibited height variances. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Orlando, and duly carried,to DENY the variance as applied for.
