NOTICE is HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100 (Zoning), Code
of the Town of Southold, the following application will be heard by the SOUTHOLD TOWN BOARD OF
APPEALS at the Town Hall, 53095 Main Road, Southold, New York 11971, on Thursday, July 25, 2002,
at the time noted below(or as soon thereafter as possible):
7:10 pm Appl No. 5137 - DAVID AND LISA CIFARELLI. This is a request for Variances under
Section 100-101 and 100-243A, based on the Building Department's February 15, 2002 Notice of
Disapproval, for proposed window cleaning business, and proposed additions and alterations
to a commercial building/single-family residence. Zone District: B General Business. Location
of Property: 11160 Main Road, Mattituck; Parcel 1000-122.-3-9.
The Board of Appeals will hear all persons, or their representatives, desiring to be heard at each
hearing or desiring to submit written statements before the conclusion of each hearing. Each hearing
will not start earlier than designated above. Files are available for review during regular Town Hall

In addition,the proposed addition/alteration is not permitted pursuant to Article XXIV 100-243.A.
which states.,
"A nonconforming building with a non-conforming use shall not be enlarged reconstructed or
structurally altered or moved, except as set forth below,unless the use of such building is
changed to a conforming use."
Total lot coverage, following the proposed construction is eight (8)percent.
Note to Applicant: Any change or deviation to the above referenced application, following any

After Board Member review of the above determination of Disapproval, it was noted that
the information provided is not sufficient for processing as the basis of an appeal. Would
you please include the following when issuing a determination about zoning use of a
parcel:
a) history of Building Department records—copy of C.O. or Pre-C.O.'s of the present use
(or uses),and status of the use(s)of the above-referenced property and building(s).
b) copy of the applicant's request which clearly indicates the use being requested. (For
example, is it a business office for a window cleaning service, or is it a different use?
c) does the property have a dwelling use,or is the applicant requesting a dwelling use?
d) where are the areas with use change on the property (map does not reflect floor
areas and uses of building areas). Information is necessary to clarify the basis
upon which the Notice of Disapproval is written, the specific details relied upon,
and reasons that do not conform to the provisions of the zoning code.

for a variance,. legal notice of hearing, affidavit attesting
to -its publication in the official newspaper, and notice to
the applicant.-
THE CHAIRMAN: Is there anyone present who wishes to
speak in favor of this application?
MR. BERGEN: I was there to get the present-building
dimensions which weren-1t on the application.
THE CHAIRMAN: The living xoom is '101-'by 12% The rest

N.R. BERGEN: It will improve the building.
THE- CHAIRMAN: By 'chaggi.ng this building from an office
to• a residence the area is being up-graded. The change will
also reduce "the amount of'traffic.

After investigation and inspection the Board finds that
the applicant'xequest permission to erect an addition to an
existing building with insufficient- sideyard"ori a corner lot.
Tl'e Board finds-that the proposed addition will be five feet
-by -twelve feet. , The Board finds that visibility to the west
from'the private right-of-way of-Boucher will' not be reduce by
this proposed addition. The Board points out that'the "change
in use of this building from 'an' office to, a residence will up-
grade the area and further reduce any traffic hazard. In '
general, the Board agrees with the reasoning of the applicant
as presented in the application to, the Board of'Appeals.

permission to add onto the A&P Potatoe House in Mattituck.
The present-building is a non-conforming building which is
