The findings of the Board are that the applicant has ignored the Zoning Ordinance with regard to obtaining a timely building permit. However, the Board's procedure is not to inflict pena].ties for this type of violation since many people are excusably unaware of all of the rules and regulations and red tape that exist in today's living. The 8oard finds that strict application of the Ordinance would produce praotical difficulties or unnecessary hardship; he hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance wi11 not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion af Mr. Gillispie, seconded by Mr. Douglass, it was RESOLVED that George L. Penny, IV, Soundview Avenue, Southold, New York, be GRANTED permission to construct a stabl.e in the front yard area closer than 40 feet to any 7.ot 1ine. This approval sha11 not become final until the matter is resolved.
