WALTER and BARBARA FITZGERALD#6878 - Request for Variance from Article III Code Section
280-15F and the Building Inspector's October 27, 2014, renewed June 16, 2015 Notice of Disapproval
based on an application for building permit for an accessory in-ground swimming pool; at: proposed
accessory in-ground swimming pool located in other than the code required rear yard or front yard for
waterfront property, located at: 8915 Soundview Avenue (adj. to Great Pond) Southold, NY.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
� Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. ,
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the actions is
CONSISTENT with the below denoted Policy Standards and therefore is CONSISI'EN'f with the LWRP
provided the following best management practice is considered:
1. It is recommended to preserve existing vegetation on site that a 50' wide NATURAL
VEGETATED BUFFER landward from the wetland line. The purpose of the buffer is to lessen
water quality impacts from residential development on Great Pond.
NATURAL VEGETATED BUFFER -A land area of a certain length and width where existing
vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation
shall be maintained to achieve a minimum percentage of ground cover of 95%. To achieve the �
percentage of ground cover, indigenous, drought-tolerant vegetation shall be planted. Survival
of planted vegetation shall be 90% for a period of three years. Maintenance activities within the
• buffer are limited to removing vegetation which is hazardous to life and property, trimming tree
limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a
four-foot-wide access path constructed of pervious material for access to the water-body.

Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed action

Enclosed you will find an application for relief from Article III, Section 280-15,F to
construct a 16'x30' inground gunite pool with cartridge filter system in the side
yard. A plan showing the shape and depth of pool, location of pool amenities.
Also, enclosed are copies of similar prior approvals from the ZBA on 2 other
properties in the neighborhood.
Due to DEC set backs, the location of the Septic for the house and the lines running
into the house, this is the only location that the pool can be placed.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfi�ont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

WNEREAS, a public hearing was held and concluded on May 22 , i986

WHEREAS, the board members have personally viewed and are
familiar with the premises in question_;"� its present zoning , and
the surrounding areas ; and
WHEREAS, at said hearing al7 those who desired to be heard
were heard, and their testimony was recorded ; ,and

and documentation submitted concerning this app7ication; and
WNEREAS, the board made the fol7owing findings of fact :
l . By this app7ication,"appellants request permission to
locate a 16 ' by 16 ' accessory storage building in the frontyard
area, requiring a variance from Artic7e III, Section i0Q-32.
� The proposed accessory �ril7 : be for �torage incidental to the
residental use of �the premises and not operated for gain and
is proposed to be set back three feet at its closest point to
the northeasterly side property line and five feet at its
closest point to the southerly (front) property line along
the private road. ,
' 2. The premises in question is ]ocated along the north
side of a private road which extends from the north side of
Sound View Avenue, Southold. T,he subject premises is improved
with a single-family one-story frame dwel1ing set back 57± feet
from the front property 7in� and consists_ of ane-quarter
( . 24) of an acre, more or less. The lot width of this parce1

3. The dwelling as exists has a setback from the tie �
line along the shoreline of Great Pond of 47± feet. Locating
this accessory building in the rearyard wiil require a variance
under the provisions of Article XI , Section lOQ-119.1.
In considering this appeal, �the board finds and determi.nes : �
(a) that the relief requested is not unreasonab]e and is not
substantial in relation to the zoning requirements ; (b) there
will be no substantia7 change in the character of the area�;
(c ) the circumstances of this parce] are unique; (d) the
practical difficulties are sufficient to warrant the granting
of a variance ; {e) there is_ no other method feasib7e- for
appel7ants to pursue other than a variance; (f) in view of the
manner in whfch the difficulties arose and in consideri.ng a] 7
the above factors, the interests of justice will best be served
by allowing the variance, as noted be7ow. .

After investigation and inspection the Board finds that the
applicant wishes to construct a stable in the front yard area which
is 40 feet from any lot line. The findings of the Board are that
the applicant has ignored the Zoning Ordinance with regard to obtaining
a timely building permit. However, the Board's procedure is not to
inflict pena].ties for this type of violation since many people are
excusably unaware of all of the rules and regulations and red tape
that exist in today's living.
The 8oard finds that strict application of the Ordinance
would produce praotical difficulties or unnecessary hardship; �he
hardship created is unique and would not be shared by all properties
alike in the immediate vicinity of the property and in the same use
district; and the variance wi11 not change the character of the
neighborhood and will observe the spirit of the Ordinance.
On motion af Mr. Gillispie, seconded by Mr. Douglass, it was
RESOLVED that George L. Penny, IV, Soundview Avenue, Southold,
New York, be GRANTED permission to construct a stabl.e in the front
yard area closer than 40 feet to any 7.ot 1ine. Location of property:
Soundview Avenue, Southold, New York, bounded on the noxth by Great
Pond; east by E. Schriefer; south by Soundview Avenue; west by Charnews,
subject to the following condition:
(1) The applicant shall obtain a building permit for the stable
and will also get a variance for the other accessory building presently
in the tront yard area (play house} . This approval sha11 not become
final until the matter is resolved.
