SUFFOLK COLTNTY ADMINISTRATNE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 1, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIl'TION: The subject parcel conforms to the R-80 Zoning District comprising of 80,001 square feet in area and having 175.00 feet of frontage on New Suffolk Avenue. The applicanYs property shares a 395.81 feet westerly property line and a 236.26 feet northerly property line with an active farming operation, and 461.52 feet with residential lots to the east. Further, the parcel is improved with a two story frame home with an attached wood deck, an in-ground swimming pool surrounded by a slate patio, and two storage buildings as shown on a survey prepared by Nathan Taft Corwin III,Land Surveyor, dated March 17, 2016. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15 and the Building Inspector's May 2, 2016 Notice of Disapproval based on an application for building permit for two `as built' sheds, at; 1) accessory frame shed in other than the code required rear yard, 2) accessory frame shed is less than the code required setback of 25 feet from the rear property line, located at: 4725 New Suffolk Avenue, Mattituck, NY. SCTM#1000-115-4-8.4. RELIEF REQiTESTED: The applicant requests variances to allow for two "as builY' accessory sheds; the first measuring 12.3 feet by 8.3 feet is located in the side yard instead of the code required rear yard, and the second shed measuring 20.3 feet by 12.5 feet is located 19.1 feet from the rear property line instead of the code conforming 25 feet distance. ADDITIONAL INFORMATION: An adjacent neighbor, Kathleen McNiffin, indicated in her letter, dated July 22, 2016 that she had no interest in commenting on this public hearing. Page 2,August 18,2016 #6971,Dellaquilla SCTM No. 1000-115-4-8.4 FINDiNGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4, 2016at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law �267-b(3)(b)(1). Grant of the variance(s) will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. It is evident that both accessory sheds have been in there respective locations for years without adverse impact and neither is visible from the public road on this large 1.837 acre parcel. The large shed is screened from view by the owners dwelling and the small shed by mature trees and a sloping grade that is below the road level. 2. Town Law �267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although both buildings could conceivably be relocated to conforming locations on this large residential properiy, the large shed is old and would likely be demolished if it had to be moved, and the small shed is surrounded by large trees and on sloping terrain that make it very inaccessible to moving equipment . 3. Town Law&267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 100%relief from the code for the shed in the side yard location and 23.6%variance for the shed with the non-conforming setback from the northerly property line. However,the large shed was built in its current location prior to updates in the bulk schedule and the small shed appears to be in the conforming rear yard because the property is irregular in shape and the house is sited at an angle to the property lines which then technically dictates the determination of the rear and side yards. 4. Town Law �267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The di�culty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The applicant has clearly indicated the difficulty in moving either of the two sheds. 6. Town Law &267-b. Grant of the requested relief (with conditions) is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of two existing non-conforming storage buildings while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Dantes , and duly carried,to GRANT the variances as applied for, and shown on the survey prepared by Nathan Taft Corwin, III, dated March 17, 2016. Page 3,August 18, 2016 #6971, Dellaquilla , SCTM No. 1000-115-4-8.4 SUBJECT TO THE FOLLOWII�TG CONDITIONS: 1. Applicant must either remove or replace the non-conforming deteriorated 5 to 6 foot high+/-portions of as built stockade fencing located east of the stone driveway with fencing that will not exceed the code conforming 4 feet in height. 2. Applicants shall submit to the ZBA, by December 31,2016, a sworn affidavit or signed letter of agreement indicating that the location of the as built chain link fence along the easterly property line,which is partially located on the adjacent neighbor's property and not on the subject property, is acceptable to both parties (the applicant and the neighbor), as depicted on the survey prepared by Nathan Taft Corwin III, dated March 17,2016. Alternatively,the applicant must move the portion of the existing chain link fence, currently on the neighbor's property, onto his own properiy by December 31,2016. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authoriaed under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of r�ppeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. REASONS FOR APPEAL(additional sheets�reav be used with preparer's signature): ` ZONING BOARD OF APPEALS AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted,because: The properiy is 1 sq.ft.Over 2 acres and the lot was subdivided off of the adjacent Miska Farm. When te larger shed was placed on the property the prior owner believed that the shed was sufficiently set back from the property line. Tom Goeller provides an affidavit stating the year the shed was constructed and I have attached a copy of the side yard setbacks required at that time. The larger shed has been located on the property for over 20 years and the smaller shed less years. The land is adjacent to the Miska farm containing standard agricultural structures. The sheds do not affect the rural character of the neighborhood. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The sheds are used for residential storage and due to their age could not be moved without risking loss. The larger shed would be costly to replace and has several more years of useful life. The location,at 19 feet from the property line would be the preferred location for the shed. (3) The amount of relief requested is not substantial because: The shed,when placed on the property,required a 20'setback. Now the code requires a 25'setback. The location,as built,is a good location for the family and�or the purposes for which it was constructed. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: No impact,either physical or environmental,is caused by the two residential sheds. (5) Has the alleged difficulty been self-created? ( )Yes,or (X)No. The applicant purchased the property with the shed. It was never an issue raised at the closing.
