SUFFOLK COUNTY ADMINISTRATNE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 6, 2016 stating that this application is considered a matter for local determination as there appears � to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 9,309 sq. ft. parcel in the R-40 Zoning District. The northerly lot line measures 125 feet, and the easterly line measures 50.96 feet along residential parcels. The southerly lot line measures 133.56 feet along Sound View Ave., and the westerly lot line measures 98 feet along Kenney's Road. The parcel is improved with a one story single-family dwelling and an accessory garage, as shown, along with the proposed wooden deck, on the survey drawn by Schnepf& Murrell, P.C., Land Surveyors, dated November 17, 2009, last revised May 3, 2016. The property is defined as having two front yard areas. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's March 8, 2016, amended June 2, 2016 Notice of Disapproval based on an application for building permit to construct a front yard wood deck addition to a single family dwelling, at; 1) less than the code required minimum front yard setback of 35 feet, 2)more than the code permitted maximum lot coverage of 20%. RELIEF REQUESTED: The applicant requests two variances in order to construct a 10 ft. 19.5 ft. wooden deck that will replace a 5 ft x 10 ft. concrete landing. The first request is for a front yard setback of 18 feet where 35 feet is required, and the second proposes lot coverage of 20.7%where 20% is permitted. ADDITIONAL INFORMATION: There were no letters from neighbors objecting to the project. Prior ZBA decision #2305, dated July 14, 1977, granted a variance to construct the accessory garage in a frondside yard location. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this applicatiori on August 4, 2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property Page 2,August 18,2016 #6972,Castiglione SCTM No. 1000-59-2-4 and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing single family dwelling was built in June 1957, with building permit #Z-25, and is one of the first buildings constructed after enactment of Zoning Code. The dwelling was located with a 24.8 ft. front yard setback on Sound View Ave., and was considered to be conforming at that time. Although the nearest corner of the proposed deck will measure 18 feet from the edge of the Right of Way of Sound View Avenue, the distance from the deck to the actual pavement, including the unpaved grassy roadside,will be+/-34 feet. 2. Town Law �267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling has a non-conforming front yard setback of 24.8 feet, and any replacement or enlargement of the existing entry landing requires a variance. The proposed lot coverage of 20.7% is more than 20%, and also requires a variance. 3. Town Law �267-b(3)(b)(3). The variance granted herein for the 18 feet front yard setback is mathematically substantial, representing 49% relief from the code. However, The proposed deck will be situated approximately 34 feet from the edge of pavement of Sound View Ave. The variance granted herein for the increase in lot coverage to 20.7% is considered to be de minimis. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law �267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new deck and entry landing,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the survey prepared by Schnepf & Murrell, P.C. Land Surveyors, dated November 17, 2009, last revised May 3, 2016. SUBJECT TO THE FOLLOWING CONDITION: 1. The deck will remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the ZoningBoard ofAppeals. Any deviation fi•om the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. The existing concrete slab porch is unsightly,and the new cedar-wood porch would bring the front of the home into alignment with the character of the surrounding homes. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: Any change to the porch would need ZBA approval, given the distance to the road of the existing home. And given the existing lot coverage, any non-minimal change to the size of the porch would likely bring the lot coverage over 20%. As planned,the overage is minimal (approximately.07 percent). 3.The amount of relief requested is not substantial because: � The proposed extension towards the property line is only 5 feet closer than the existing slab. There is not be no roof,overhang,or otl�er structure. There is also a buffer of lawn between the property line and the road of more than 10 feet,meaning that the new porch will be almost 30 feet from the actual road. Further,as noted above,the property coverage overage is only approximately.07 percent. 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: ' There is no evironmental impact at all in extending the porch alongside the existing home. No one, inlcuding neighbors,will be impacted. As the enclosed application materials show, the existing slab concrete porch was built with the house in 1950. It is approximately 5' deep x 10' long,with brick stairs and a metal railing. The slab porch is quite old,unsightly, and has begun to crumble from age and use. The proposed project would alter the porch by partially removing the concrete base and brick stairs, covering it with cedar planking. The new porch will be approximately 197.75 sq. ft. (10' deep by 23.5' long,minus chimney coverage and stairs),with cedar wood stairs and cedar wood hand railings. There will be no overhang, cover, or any other element. The project will be � a significant improvement to the aesthetics of the home, removing the unsightly slab and ' aligning the look with other wood porches in the neighborhood. � Two variances are requested: one for set-back, one for lot coverage. First, a variance for set-back is needed because the existing�porch is already closer to the property line on the • Soundview Avenue side then permitted under the Bulk Schedule. As I confirmed with the Building Department prior to making this application, essentially any work done to the porch— other than minor patch repairs,which would be insufficient to fix it—would require approval of the ZBA. The new porch as proposed will be approximately 18 feet from the property line, as . shown in the updated survey map. Second,the new porch will take total building coverage on , the property to approximately 20.7%;just beyond the lot coverage limit for the R-40 district.
