Domino: The Board of Trustees reviewed the Anthony Campo compliance inspection request for Permit#8772, 1165 Haywaters Road,Cutchogue—SCTM#: 1000-111-24,25&26 after the area trustee expressed concerns. Accordingly,the Trustees are referring this matter to your office for consideration of: 1. Drainage calculations related to the new non-permeable driveway located near the area on the survey labeled "existing driveway to remain"; 2. Final elevations of the septic system retaining wall as the increased volume of fill to final grade and slope will impact run-off and infiltration rates; 3. Increased run-off will impact neighboring properties to the East, and the creek to the north of this property; 4. Extensive lawn east of the septic system wall with fertilizer and irrigation dependant grasses may—considering the depth to groundwater-contribute to run-off issues and impact surface and sub-surface water. The Zoning Board of Appeals issued a variance (6411) for the action on November 2010. The decision has since expired (See section 280-146 (B)). Mark Schwartz, Architect on behalf of ANTHONY CAMPO requests a Wetland Permit to demolish existing dwelling and construct new 1,650sq.ft. two-story dwelling with a 1,572.8sq.ft. wrap-around deck; abandon existing sanitary and install new sanitary system with retaining walls varying in height from 2.5' to 4.2' above grade; abandon and remove sanitary system to existing shed which will not to be replaced; and install gutters to leaders to drywells on the dwelling to contain roof runoff. Located: 1165 Haywaters Road, Cutchogue. SCTM# 1000-111-1-24, 25 & 26. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the 'Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. In the event the action is approved: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater.wetlands. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The adequacy of the buffer depends on the following factors: 1. Potential for adverse effects associated with the use. Uses such as those involving hazardous materials, on-site sewage disposal, or mineral extraction have high potential for adverse effects and may require substantial buffer. 2. The nature and importance of the wetland and its benefits. Substantial buffers may be necessary to avoid adverse effects from adjacent or nearby uses based on the nature of the land use and the characteristics of the affected wetland. 3. Direction and flow of surface water between a use and adjacent or nearby wetland. Buffer widths may be reduced in areas where drainage patterns normally do not lead directly to the wetland and where adverse affects on the wetland, other than those due to runoff, are not likely. 4. Buffer width necessary to achieve a high particulate filtration efficiency of surface runoff as determined by vegetative cover type, soil characteristics, and slope of land. 5. Other management measures or design,alternatives to protect wetlands from adverse effects where site constraints do not allow sufficient buffer width. -E: Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided. 1. Maintain buffers to achieve a high filtration efficiency of surface runoff. 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas. The site plan shows a non- disturbance buffer, however, the limits-of the buffer are not clearly shown, is the landward limit intended to be the "limits of clearing"? It is recommended that the Board clarify and memorialized the location of the buffer and the activities permitted within the buffer area. Note that the non-disturbance buffer should not be located in the right- of-way unless proof of abandonment and ownership has been submitted. NON- DISTURBANCE BUFFER -- a land area containing existing vegetation of varying-widths located seaward of the "limits of clearing" depicted on the site plan titled Campo House, last dated July 14, 2010. Clearing and/or grading activities or applying fertilizers and pesticides within the buffer area are prohibited. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, replanting of native, drought tolerant vegetation and establishing a four foot (4') wide access path constructed of pervious material for access to the -water-body.
