Dear Gary:
After consulting with town counsel, we have been advised
that the above variance application is not necessary since
your initial application for the same structure and same
location was approved prior to the adoption of Local Law #4
of 1985.
You may accordingly return to the Building Inspector
concerning your pending building permit application for this
accessory storage structure~ We will request that the Town
Board refund your filing fee of $75.00 under the circumstances.
A copy of this letter is being furnished to the Building
Inspector for his file.

SUBJECT: Appeal No. 3362 - Notice of Disapproval dated
April 17, 1985 and Subsequent Variance Application
We would like to request and recommend that Gary Doroski be issued
a refund of $75.00 for the filing fee paid for a variance application
that was made as required by the April 17, 1985 Notice of Disapproval
concerning the newly adopted Local Law #4-1985 "Wetland Setbacks."
Mr. Doroski initially applied for a building permit on September 21,
1984 for the subject accessory storage building at his residential
premises, 425 Monsell Lane, Cutchogue. On September 21, 1984, a
Notice of Disapproval was issued requiring a "zoning-building setback"
variance, which was granted on February 14, 1985, for the same
accessory building. We have been advised by town counsel that
since this project was initially approved prior to the adoption
of Local Law #4-1985 for the same structure and same location,
additional variances are not necessary.
Therefore, under the circumstances, a refund of $75.00 is recommended
to Mr. Doroski. Thank you for your time and consideration.

SUBJECT: Local Law #4-1985 "Wetlands Setback Restrictions"
Dear Jay:
At our Regular Meeting of May 2, 1985, the board discussed the
necessity of applicants who have received variance approvals
for a particular location of structures to be required to return
for a second variance since Local Law #4 was passed subsequent
to his initial variance approval.
Gary Doroski applied for a variance under Section 100-32 for
an accessory storage building in an area other than the required
rearyard 53± feet from the high marsh and 31 feet from Monsell
Lane, Cutchogue, and received conditional approval on 2Z14/85.
Mr. Doroski received N.Y.S. Dept. of Environmental Conservation
approval for the same location on April 9, 1985, and on
April 1, 1985 Local Law #4 was filed with the Secretary of State.
Mr. Doroski was ready to finalize his building permit application,
which was originally filed 9/21/84, and was referred back to the
Z.B.A. (and the Town Trustees) for additional variance and applica-
tions.

The Board members have requested that a recommendation be sent
to the Zoning Code Committee to consider grandfathering or
exempting this particular project at Monsell Lane, Cutchogue.
Additionally, the Board of Appeals would like to place in the
record their objection of the requirement of Local Law #4 for
each applicant to apply not only to the Town Trustees but also
to the Z.B.A. for the same relief. It was thought that one of
the two departments within the town could consider these
applications administratively and the other in an advisory
manner (one public hearing vs. two hearings, etc.).
Wetland criteria does not necessarily coincide with zoning and
therefore the board does not understand why we are a part of this
hearing process.
We are hoping this can be resolved in the Code Committee.

The following determination was made by the Board of
Trustees at their meeting held on May 1, 1985:
Whereas, Gary Doroski applied for a variance under

Re: Local Law No. 4-1985- Building Setback Restrictions
Dear Gerry:
This is in reply to your April 10, 1985 letter with respect to the
above local law.
Local Law No. 4 - 1985, amends Article XI of the Zoning Code by
adding thereto a new Section 100-119.2 which provides setback
restrictions with respect to buildings located adjacent to water bodies
and wetlands. The local law was adopted by the Town Board on March
26, 1985, and became effective upon its filing with the Secretary of
State. The local law was transmitted to the Secretary of State on
March 27, 1985, and it is presumed that it took effect on March 30,
1985.
There was no provision in this law which made any exceptions with
respect to building applications. Therefore, it would be my opinion
that the Board of Appeals, in considering appeals, must apply the law
in effect at the time it considers the appeal.

2. The permitted work shall be subject to inspection by an authorized
represeutative of the Department of Environmenlal Conservation who may

3. As a condition of the issuance of this permit, the applicant has ac-
ct.pied expressly, 1~¥ the execution of the applicalion, the full legal respon-
~ibilily for all damages, direct or indirect, of whatever nature, and by whom-
~.ver suffered, arising out of the projecl described herein and has agreed to
indemnify and save harmless the State from suits, actions, damages and
~ os~s of every name and description resulling from the said project.
4. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across the
bed of the walerway or flood plain or deep holes lhat may have a tendency to

GENERAL CONDITIONS
g. Thal the Stale of New York shall in no case be liable for any damaRe
or injury 1o 1he slruclure or work herein authorized which may be caused by or
result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to
compensation shall accrue from any such damage.
9. That if the display of lights and signals on any work hereby authorized
is not olherwise provided for by law, such lighls and signals as may be pre-
scribed by the United States Coast Guard shall be installed and maintained
by and al the expense of the owner.
10. All work carried out under this permit shall be performed in accor-
dance with established engineering practice and in a workmanlike manner.
11. If granted under Articles 24 or 25, the Department reserves the right
to reconsider this approval at any time and after due notice and hearing to
continue, rescind or modify this permit in such a manner as may be found to
be just and equilable. If upon Ihe expiration or revocation of this permit, the
modification of the welland hereby authorized has not been completed, the
applicanl shall, wilhout expense 1o the Slale, and to such extent and in such
lime and manner as the Department of Environmental Conservation may require,
remove all or any portion of the uncompleted structure or fill and restore the
site lo ils former condition. No claim shall be made against the Stale of New
York on account of any such removal or alteration.
12. This permit shall not be construed as conveying to the applicant any
right to trespass upon the lands or inlerfere with lhe riparian rights of others
1o perform the permilted work or as authorizing the impairment of any rights,
litle or inleresl in real ur personal property held ur vesled in a person not a
party to the permit.
13. The permillee is responsible for obtaining any other permits, ap-
provals, lands, easements and rights*of-way which may be required for this
project.
14. If granted under Article 36, Ihis permil is granted solely on the basis
of the requirements of Article 36 of the Environmental Conservation Law and
Part 500 of 6 NYCRR (Construction in Flood Plain Areas having Special Flood
Hazards - Building Permits) and in no way signifies that the project will be
free from flooding.
15. By acceptance of this permit the permittee agrees t~t the permit
is contingent upon slricl compliance with the special conditions on the
reverse side.

ted buffer zone shall be preserved. There shall be no disturbance to the
existing natural vegetation or topography within an area extending 50'
