WHEREAS, a public hearing was held and concluded in the Matter of the Application of WILLIAM AND HELEN COSTER on April 11, 1985; and WHEREAS, the board members have personally viewed and are familiar with the subject premises as well as its surrounding area, and WHEREAS, the board has considered all testimony, both in favor and in opposition to the subject application, and documentation entered into the record herein; and WHEREAS, the board made the following findings of fact: 1. The property in question is located in an "A-80" Residential and Agricultural Zonin~ District, and more particularly at the south side of the Main Road (S.R. 25) at an intersection with the west side of Harbor Lane, Hamlet of Cutchogue; 2. The property in question contains a lot size of 95,400 sq. (2.190 acres) and 187.32 feet along the Main Road and 275 feet along Harbor Lane, and is identified on the Suffolk County Tax Maps as District lO00, Section 103, Block 01, Lot 015; ft. 3. By this application, applicants request a Special Exception to the Zoning Ordinance, pursuant to Article III, Section 100-30(B)[13] which permits funeral homes and undertaking establishments subject to site plan approval from the Planning Board in accordance with Article XIII and the Bulk and Parking Schedule; (CONTINUED ON PAGE TWO) DATED: June 5, 1985. The site plan under consideration is dated as amended Feb- ruary 5, 1985, and proposes a three-parlor funeral home of a size of 5680 sq. ft. and a portico addition with a setback of 55 feet from the easterly property line, 35 feet from the northerly property line, 39 feet from the west property line (at its nearest point) and 138 feet from the south property line (at its nearest point); 5. Existing on the premises at the present time is a large barn structure which is located approximately 127 feet south of the Main Road and set back approximately seven feet from the south property line of premises now of Fogarty~ 6. It is noted for the record that the Southold Town Planning Board by action of April 1, 1985, made certain recommenda- tions concerning the site plan, particularly the buffer area against the residential properties, elimination of the "head-on" parking along the west side, and certain "street" screening and asphalt-base parking areas. In considering this application, the board has determined: (1) that this proposed use is in harmony with the zoning plan and is a use not forbidden by this zoning regulation; (2) that the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts, which are as follows: (a) north side of the Main Road [opposite these premises] are the "B-I" General Business Zoning Districts, (b) the east side of Harbor Lane [opposite these premises] is a pre-existing cemetery, (c) the subject "A" Residential and Agricultural Zoning District [abutting these premises on the westerly and southerly sides]; (3) that the use will be in harmony with and promote the general purposes and intent of the present zoning ordinance. In passing upon this application, the board has also considered items (a) through (1) of Article XII, Section 100-121(C)[2] of the Zoning Code. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Douglass, it was RESOLVED, that a Special Exception pursuant to Article III, Section 100-30(B)[13] for a funeral home establishment as applied under Appeal No. 3326 in the Matter of the Application of WILLIAM AND HELEN COSTER, BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOW- ING CONDITIONS: 1. Screening, commencing at a point along the west side of Harbor Lane (approx. 248 feet from the Main Road) and 25 feet to the west of Harbor Lane into the 10-foot buffer area [between the 14-space parking area and the northerly line of land now of Bakow- ski] with four-foot high evergreens a distance of 25 feet; and thence extending to the west another 150 feet with six-foot high evergreens [to the northwesterly corner of land now of Bakowski]; and 2. Screening, commencing at a point 28 feet south of the Main Road along the west side of the entrance, extending 90 feet to the 8-space parking area, with six-foot high evergreens, and with six-foot stockade fencing extending 30 feet within the buffer area (between the 8-space parking area and the east side of land now of Fogarty); with six-foot high evergreens extending to the edge of this parking area (a distance of 55± feet). 3. Screening to be maintained at all times in good condition; 4. Lighting shall be of a mushroom-type close to ground cover as possible and not obtrusive to neighboring properties; 5. Lighting on building shall also be unobtrusive to neigh- boring properties as recommended by the Building Department; 6. Olsen and contains a law office and other commercial space. The parcel is bounded on the east by Harbor Lane, and directly across Harbor Lane is the old Burying Ground Cemetery which is in an "A" Residential and AgriculturalDistrict. Gehringer and Board Members: Last year we were part of the seven individual property owners seeking a zone change from residental to business along the south side of the Main Road opposite the Key Food shopping center, the proposal was denied. The Town Board's point of insistance was that they wanted to keep the business area located within the hamlets and to eliminate "spot zoning" which they considered the application to be. Now to the east and south of our property on the corner of the Main Road and Harbor Lane and a strip running south behind the res- idence of John Bakowski, E. Austin and S. P. Sahu is proposed as a "special exception" to the zoning requirements. Nestling a funeral home-a business enterprise-into a residental community is clearly an example of spot zoning. This parcel that will clearly bring a negative effect on the four residental proper- ties that it borders on and the four home owners that oppose it. This business will operate as a business without the benefit of being Business Zoned. Our property to the west and north of this is still zoned res- idental. This situation is condemning the value of our property. Not only will our property value decrease but our limited pri- vacy as it exists right now will be completely destroyed. The proposed parking is herendous: There are parking stalls proposed along our property line such that when the cars are parked they will face directly into our backyard. Further parking is pro- posed along the fence bordering Bakowski property all facing into the fence, into their backyards, and behind Austin and Sahu stalls are proposed also ruining any privacy they might have in their back- yards. A four foot hedge is outlined to seperate our property from the mortuary property. Four feet does not eliminate the visibility-both properties activities can be viewed. A four foot hedge does not eliminate the increased noise factor nor does it modify it. Light fixtures are planned on the building and in the parking areas. There is no feasible way to direct these lights so that they do not become a nuisance to our normal daily living, especially those properties that were sheltered previously from backyard lighting along Harbor Lane. We really feel that our daily living will be negatively effected by the granting of this "special exception" and hope that you will consider the effects on our property and lives. We are young enough that we could probably sell and move if the situation lives up to it's negative potential. However consider the retired people along Harbor Lane who had no conception that such negative change could ever occur in their backyards. These residents have lived aggrevated, unsettled lives ever since they signed for the certified mail announcing the proposal. Mr. Gehringer, I invite you and your board to please bring the proposed plans and visit our neighborhood. Come meet us, the Bako- wski's, Austin's, Mr. Sahu, stand in our backyards and then make your decisions.
