Dear Mr. and Mrs. Copas:
After reviewing your recent application for a variance
from the requirements of Section 100-119.2 concerning setbacks
from the bulkheaded area, it is requested that an up-to-date
survey showing all structures, including pool and deck areas,
and the exact distances from all property lines, as well as
the total percentage of lot covered by such structures, be
submitted for further review.
It appears that the setback from the easterly property
line may be less than l0 feet and the lot coverage with
the pool and deck areas may be over 20%, both of which would
be in nonconformity with the zoning regulations.

Dear Mr. Copas:
The Trustees reviewed your application at their regular
meeting held on November 27, 1985. The following is the Board's
findings and determination recently rendered regarding this matter.
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area; and
WHEREAS, the Board has considered all the documentation submitted
concerning this request; and
WHEREAS, the Board made the following findings of fact:
1. By this request, appellant requests permission to construct
a 10' x 30' Solarium, that will replace an existing porch.
2. The solarium proposed is located approximately 50' landward
of the bulkhead.
3. Chapter 97, Section 97-13 (A-3) all lands immediately
adjacent to a tidal wetland as defined in Section 97-13 A-3 and
lying within seventy-five (75') landward of the most landward edge
of such a tidal wetland.
In considering this request, the Trustees find and determined:
(a) That relief requested is not substantial under the
circumstances.
(b) That by allowing the request as conditionally noted below,
that there will not be any adverse affects to the wetlands.
(c) That the safety, health, welfare, comfort, convenience
and order of the Town will not be adversely affected by the proposed
request.
Accordingly, on motion made by Trustee Bredemeyer seconded by
Trustee Bednoski it was
RESOLVED permission Be and Hereby is Granted as requested for
Robert E. Copas subject to the following provisions:

1. During excavation the fill must be contained so that it
does not wash into the creek.
2. Care should be taken so as to preclude the entry of any
construction material into the adjacent waters.
3. Immediately following construction, all areas of exposed
soil shall be properly protected with suitable erosion control
devices and/or vegetated to prevent entry of eroded soil into
the creek.
