WHEREAS, the public hearing on the appeal application of ROBERT A.
CELIC, Appeal No. 3314, was held and concluded on January 24, 1985,
at which time all testimony was taken, including written opposition
from an adjoining property owner along the southerly property line;
and
WHEREAS, the board members have each viewed the premises in
question as well as its surrounding area and are familiar with
the character of the immediate zoning districts; and
WHEREAS, the board made the following findings of facts:
1. The property' in que~tion'contains an area o~ 3i',451 sq. ft.
and is located in the "B-l" General Business Zoning District;
2. The subject premises is known as 10200 Main Road at its
intersection with Marlene Drive, Mattituck, and is more particularly
identified as District 1000, Section 143, Block 03, Lot 001;
3. The subject premises is improved with a one-story building
presently used for a real estate office and beauty parlor with a
setback from the westerly front property line at 7.5± feet at its
nearest point, and set back from the northerly front property line
at 80 feet at its nearest point;
4. Abutting the subject parcel on the south are premises
located in the "A" Residential and Agricultural Zoning District
and on the east, premises also located in the '!B-I" General Business
Zoning District.

Code requires a minimum sideyard setback of 25 feet and minimum
rearyard setback of 35 feet for a principal structure;
6. Applicant has requested permission to vary the easterly
setback to 18 feet for a proposed 2,750 sq. ft. addition, extending
43± feet easterly from the northeast corner of the existing building
and thence extending northerly 45 feet (30 feet northerly from the
northwest corner of the existing building);
7. Applicant has a proposed site plan pending before the
Planning Board for consideration of the elements required under
Section 100-134 of the Zoning Code;
Also, in considering this appeal, it is the opinion of the
board that:
1. The relief as requested is not substantial in relation
to the zoning requirements since, the parcel in question is a
corner lot as defined by Section 100-13, and as such, Section
lO0-119 allows a yard other than a frontyard to be deemed a side
yard, which is 28% of a variance from the 25' requirement, or
deemed a rearyard;
2. The proposal is consistent with the existing character
of the use(s) established, and there will be no substantial change
in the character of the zoning district, since the addition is
proposed for expansion of the present use(s);
3. There will be no effect on population density and thereby
will not effect available governmental facilities;
4. That in view of the manner in which the difficulties arose,
justice will be served by allowing the variance applied.
NOW, THEREFORE, on motion by Mr. Sawicki, seconded by Mr.
Grigonis, it was
RESOLVED, that the relief requested under Appeal No. 3311 in
the matter of ROBERT A. CELIC for permission to construct addition
with an insufficient setback from the easterly property line at
18 feet, BE AND HEREBY IS APPROVED AS APPLIED.

Dear Gentlemen:
I am herein requesting a waiver of the provisions of Article XVI
regarding the moratorium outlined in Section 100-162 & Section 100~
163 of the Southold Town Code.
The plan entitled "site plan for Robert A. Celic" was originally
submitted in February, 1985 and is presently awaiting certification
by the building department. This plan has been reviewed (numerous
times) by the planning board and is a request for an addition to
my existing building located at Main Road and Marlene Lane, Mattituck.
The proposed zone in the master plan remains the same - "B-I".
! would appreciate a "go-ahead" so construction can begin before
winter arrives.

Dear Mr. Celic:
The Planning Board reviewed the above mentioned site plan
at the regular meeting of February 4, 1985.
Enclosed, for your review, is a survey map with the Board's
recommendations regarding this plan.
The Board also had the following recommendations:
1. Narrow the size of the addition in the east/west direction.
2. In doing this, connect the two parking areas.
The Board noted that the configuration of the addition would change
slightly, however, the same square footage could be used.
The Board's main concerns are that there be off-street parking,
that there be curbing to control the entrances, and that there be
no backing out into Marlene Lane.
If these changes are agreeable to you, please submit six copies
of the survey reflecting them for the Board's review. If you have
any questions, please don't hesitate to contact our office.

Dear Gentlemen:
With regards to the letter dated January 2, 1985, addressed to you by Mrs.
Jean E. Vitale, the following explanations will hopefully answer her conments:
1)
As you know, the new addition under law must conform to all Suffolk
County Board of Health standards regarding well water and septic system
controls. Mrs. Vitale is therefore automatically protected.
2)
This parcel was cleared of all tree growth in 1983 due to the constant
"root blockage" problems we had experienced in our sewer lines. It
should be noted that the tree clearing was done at considerable cost to
me and fortunately has since eliminated all blockage problems.
3) The property is zoned B-1 (comnercial) in it's entirety and has been
maintained as such for well over 25 years.
4)
The bui]ding was completely painted (rear included) to "spruce up" it's
previous appearance. Although the rea~ portion of the building does not
face the highway, it was painted primarily to express neatness and care
to all surrounding neighbors.
5)
The garbage which exists to the East of subject property is not my
doing. It belongs to a tenant of the adjoining owner. I don't like
the litter any more than Mrs. Vita]e and I have even called the owner
to see if he could have this problem resolved. Our lawn is littered
as much as, if not more than Mrs. Vitale's.
6)
Upon my purchase of this property I gave Mrs. Vita]e permission to
plant a pine tree "shielding" line on the Southerly most portion of
my property. This buffer has since been planted and taken root.
7)
I have absolutely no objection to Mrs. Vita]e placing a fence along
the Southern boundary of my parcel. I did not zone this property nor
any of the surrounding properties (the Town did) and should therefore
not be penalized for ~t by being required to install a fence at my own
cost.

Since this building was "uplifted" our office has had hundreds
of favorable cormmnts as to it's neatness and eye appeal by
chanber members, civic groups, office clients, and n~nerous
Mar]ene Lane Associationmembers.
I sincerely hope that these clarifications will help allay M_rs. Vita]e's
concerns and I look forward to our continued, friendly relationship.

I amir tiring this letter in conuern for the request of a variance.
Calic real estate agency has applied for a variance for insufficient
rear yard set back. I am not under objection on his addition as it ia
closer to the maLn road. I am under the impression that the addltion

no added sewage or well8.
I have had several problems with my well water as it is and X
do not naed anymore. X am severely objecting to what Mr. Cello has
done to the lot adjoining my property~ when he cleared the treed lot
he created an eye sore. He opened the lot Joining business property
for parking and such to residential housing. The trees blocked his
business closin$ off sight of the main road,-now I have to loQk at
the unappealtn$ back of Mr. Cellcs business and the hideous piles of
sarbage from the house behind the office. Nol I get all the litter
from the main road and surrounding areas mentioned above.
I do;~ot like the fact, that now this property is a parking lot
and I think that Mr. Cellc is obligated to put a fence up to ,block
out th~s unpleasent view he has created for me.

Dear Gentlemen:
I am herein requesting a waiver of the provisions of Article XVI
regarding the moratorium outlined in Section 100-162 & Section 100-
163 of the Southold Town Code.
The plan entitled "site plan for Robert A. Celic" was originally
submitted in February, 1985 and is presently awaiting certification
by the building department. This plan has been reviewed (numerous
times) by the planning board and is a request for an addition to
my existing building located at Main Road and Marlene Lane, Mattituck.
The proposed zone in the master plan remains the same - "B-I".
I would appreciate a "go-ahead" so construction can begin before
winter arrives.

an application to the N.Y.S. Department of Environmental Conservation, Environmental
Analysis Unit, Building 40, S.U.N.Y., 5tony ~3rook, NY 1179u,, (tel. 516-751.-7900), if
you have checked Box ~1 and/or Box #6 below. Please either call their office or
personally visit them at their 5tony Brook office for instructions and application
forms. Once you have received written notification of approva please provide our
office with a copy (with the conditions) as early as possible in order that we may
