There were present: Messrs. Robert W. Gillispie, Jr., Chairman, Robert Bergen, and Herbert Rosenberg. Absent: Mr. Charles Grigonis, Jr., and Mr. Serge Doyen, Jr. Also present: Mr. Howard M. Terry, Building Inspector. PUBLIC BE. ARING: 7:30 P.M,, Appeal No. 198 - Application of William T. Bie, Youngs Road, Orient, New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 306, for permission to reduce west front yard setback' on a corner lot. CHAIRMAN: Is there anyone present who wishes to spe~ for this application? MR. WILLIAM BIE~ Youngs Road, Orient, New York: Yes, I would like to speak on my own behalf. The proposed layout of the house by the contractor does not coordinate with the lbcation of the house on the lot. (Mr. Bie explained the layout of the lot with relation to the neighborhood.) By the zoning requirements the house would set in an akward position. (Mr. Terry, Building Inspector. stated that th~ building ~ermit was issued for a 3% ft. front yard and a 3% ft. side yard for-a corner lot~ and th~ cellar was dug and there was less than 30 ft~ approximately 25 ft. on the_side yard. CHAIRMAN: What will happen if we agrae to grant this variance? MR. BIE: Stanley W. will backfill the lot and place the house where the Board wishes. CHAIRMAN: Are there any other questions anyone wishes to ask? Is there anyone present who wishes to speak against this application? (No one wished to s~eak.) CHAIRMAN: Is there anyone present who wishes to speak for fhis application? MR. HOWARDM. TERRY, Building~ Inspector: I have been in contact with Mr. Frumenti and am familiar with the situation. (Mr. Terry explained the sketch that appeared in the file.) The setback and side yard requirements adhere to the0rdinance. CHAIRMAN: Is there anyone else present who wishes to speak for this application? MR. ROSENBERG: Should he be allowed to put two houses on the one lot? ME. TEB~Y: He has three separate deeds. MR. ROSENBERG: The Ordinance says you cannot build two houses on one lot. CHAIRMAN: We will continue this hearing and write a letter to Mr. F~umenti stating that his application will be denied unless he transfers the 50 ft. piece of property out of his name. PUBLIC HR.~RING: 8:00 P.M.~ Appeal No. 200 - Application of C. B. S. Marr, Salt Lake Village, Mattituck, New York, for a variance in accordance with the Zoning 0rdirance, Article III, Section 303~ and Article X, Section lO00A~ for permission to reduce frontage and sell as a single lot, property located on_the east side Rochelle Place, MattitUck, New York, Lots No. 28 30 on map of Lidi~ Bartley. Bounded north by Rochelle Place, east by other lands of the applicant, south by Ebinger, and west by 01d Salt Road. Fee paid $1~.00. CHAIRman opened the hearing by reading the letter from the applicant, notice of disapprovhl issued by the Building Inspector, legal notice of hearing, and affidavit attesting to its publication in the official newspaper. CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. C. B. S. MARR, Salt Lake Village, Mattituck, stepped Southold Town Board of Appeals July 23, 19%9 forward and explained the map of the property and stated he wishes to keep 2% to 30 ft. on the west side of his property, for his driveway would be part of this 2% ft. Mr. M_~rr's home is located on Lot NO. 31.- To make up the 2% or 30 ft. he would have to keep several f~et of 'Lot No. 30, and he~ would sell the r~mainder of Lot 30~ all of 29~ and the east part of 28. The size of the'lot he wishes to sell will be made approximately 123 ft. by 80 ft. Mr. Na~r stated that there are sever_~! small~ possibly smaller~ lots in the vicinity. CHAIRMAN: Will you have restrictions on the location of the proposed house? MR. MARR: Yes, the house woula have to be 2% ft. from the easterly side line, thus making %0 ft. between myhoUse and the proposed house. That will be a restriction in the deed. (The prospective purchaser c~me forward and stated that the house will conform with' all the ~etback restrictions in the Zoning Ordinance. The square footage of-the~hoUse and the~rag~ wo~d total approximately 1~200 square feet~ and it would be of colonial design in keeping with the neighborhood houses. CHAIRMAN: Will you sell this property by description? MAP=R: Yes. CHAIRMAN: We would like to have a copy of the description when you receive it from the surveyor. MR. MARR: I will be glad to furnish a copy. CHAIRMAN: Is there anyone else present who wishes to speak for this application? - Is there anyone present who wishes to spe~ against this application? -- Are there any questions the members of the Board would like to ask? (No one wished to speak.) Resolution was offered by Mr. Bergen, ~econded by Mr. Rosenber and carried, WHEREAS~ application of C. B. ~, Marr, havingbeen con~' ~idered at Public Hearing No. 200-on July 23, 19%9~ and the Board finding that strict application of the Ordinance would produce undue hardship because the lot as it now stands is larger ~han required by the Zoning Ordinance and is greater than the need~ of applicant. There is a house on one portion of the lot, therefore making it impossible to make proposed lot larger. The Situation is unique and would not be shared by ail properties alike in the immediat~ vicinity because this is the largest l~t in the subdivision and has frontage on two streetse The public convenience and wel*are and justice will be served and the legally established or permitted use of neighborhood Southold Town Board of Appeals -%- July 23, 19%9 property and adjacent use districts Will not be substantially or permanently ihJured and the spirit of the Ordinance would be ob- served, because the proposed lot would be used for residential p~r~oses similar to the others in the area and the architecture of this proposed building will conform with the area as a whole, therefore Be it RESOLVED, that the application be granted subject to Mr. Marr's furnishing an engineers description in accordance with the application. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen~ and Mr. Rosenberg. The minutes of the meeting of July 9, 19%9~ on motion o~ Mr. Rosenberg, seconded by Mr. Bergen and carried, were approved as corrected; the name of Mr. Psncoast being spelled incorrectly. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen~ and Mr. Rosenberg. The minutes of the meeting of July 16, 19%9, on motion of Mr. Bergen, seconded by Mr. Rosenberg and carried~ were approved as correcte~; the name of Mr. pancoast being spelled incorrectly. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Rosenberg~ seconded by Mr. Bergen and carried, it was RESOLVED that time and ~lace be set for hearing upon appli- cation of Stevan Banick~ Hyatt s Road, Hortonts Point~ Southold New York, for a variance'in accordance with the Zoning 0Mdinanc~ Article III~ Section 303~ and Article X~ Section lO00A~ for per- mission to reduce frontage and use as a single lot,-~roperty located on the south side of private road (Hyatt's Road)~ off Soundview Avenue, $outhold~ New York~ and bo~uded north by Private road, east by Neslage~ south by other lands of the~ applic~t~ and west by Witherspoon. (E.D.S.T.)~ Thursday, August 6, 19%9~at the Town Clerk'S Office, Main Road, Southold, New Yor~, was set for hear- ing upon application of Peter Karas, Bay Avenue~ mast Marion, New York, for a special exception in accordance with theZoning Ordinance~ Article III, Section SO0, Subsection ll, for permission to erect a~d maintain'a directional advertising sign on the northwest side of Main Road, Greenport, NeWyork~ on the property being in the estate of Ssm Ciacia, west of Chapel Lane. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. ROsenberg,~seconded by Mr. Bergen and carried, it was RESOLVED that the Board of Appeals set 8:00 P.M. (E.~.S.T.), Thursday~ August 6~ 19%9~at the Town ~lerk's Office~ Main ~oad, Southold, New York, as time and place upon hea~ing of application of ~homas LaColla, Main Road, Southold, New york, for a.special exception in accordance with the Zoning Ordinance~ Article IV~ SectiOn~O8, f6r p~rmission to erect and maintain a neon advertising sign on the roof of "LaColla's Tavern", north side Main Road, Greenport (Arsh~momaque)~ New York. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. An informal discussion was held relative tb the John and Rose Koroleski labor c~mp on the north end o~ their farm, north side Sound Avenue, Mattituc~. This building used for a labor csmp is approx- imately $00 fto from dwelling of Ha~bld Search and Mable Wolve~ton~ and other neighbors along Sound bluer, and approximately 3000~ft. from the Koroleski residence. The building in question was-moved from Mattituck approximately 19%6 an~ sets approximately S ft. from the property line o~ the Koroleski farm. Objection h~s been raised by the abovementioned neighbors to the camp or'use of the building. It was the opinion of the Board members that if this building were used as a labor camp it should be moved closer to the Koroleski residence th~ t~ any other residence in the area. If, however~ it was to be classified as a one family residence it would have to have a-minimum width access road approved by the Board and a building lot of 100 by 12% minimum~ and building must comply with the Health Department rules and regulations.
