Kimack Attorney at Law 321 Riverside Drive Riverhead, New York, 11901 Tel. 516-658-6807 E-mail: mkimack2averizon.net March 17, 2016 To: New York State DEC and Southold'Town Trustees Re: !984 /2004 Aerial Photos of 1025 Gull Pond Road, Greenport, N.Y. Tax map No. 1000-35-04-28.40 Enclosed with the applications are two aerial photos of the above referenced property. One was taken Jan. 17, 1984 and shows a relatively straight shoreline and vegetated bank. The other was taken in the spring of 2004 and it clearly shows the degree to which the bank westerly of the walkway and to the property line has been eroded. This erosion has significantly closed the line between the new top of bank and the existing dwelling We respectfully propose the construction of a bulkhead to restore a good portion of what was lost and to protect the property from further ongoing erosion which is inevitable to occur. The proposed location of the bulkhead is in line with the existing bulkheads on both sides of the property and is located no further seaward. Thank you for your consideration in this matter. Sincerely, Michael A. Kimack Al. r ♦ 3> b- C 'ti..iltr,s •FsB 6y ,r,4Y fi dy' r.r tr ? F e.+?'t'- 7 1 ,T+tzr s4- a '1 ' c -;. Located: 1025 Gull Pond Lane, Greenport. SCTM# 1000-35-4-28.40 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP provided the following: The proposed action doesn't comply with Policy 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction (h) New bulkheads in creeks and bays are prohibited, unless the operation involves construction of a low-sill bulkhead. The action is proposed in Fordham Canal part of Gull Pond Inlet which is a Creek by definition. In the event that action is approved, clarify why the bank would be cleared of all vegetation. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. tgpFFOt,cd Peter Young,Chairman ti Town Hall,53095 Main Rd. Remove existing wood walkway from end of concrete'walkway to proposed bulkhead location. Construct 138' bulkhead with (2) 15' returns for a total of 168' at 10.2' elevation.
