Russell SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. I am going to ask everybody to please stand for a moment of silence in recognition of the veterans who gave their all, in recognition of the Memorial Day holiday. Thank you. Before I get to the regular business of the agenda, I would like to welcome, we have a very special guest sitting in the audience tonight. John Stype, thank you for being here tonight. Legislator Albert Krupski. Oh, I am sorry, would anybody like to address the Town Board on any of the agenda items? Benja Schwartz, Cutchogue Southold Town Board Regular Meeting May 31, 2016 page 4 BENJA SCHWARTZ: Good evening, how are you doing tonight? Benja Schwartz, Cutchogue. And I have been thinking about Joan Egan today and (inaudible) of this agenda. People accuse me of doing what she used to do and I wish I was that good and dedicated but a couple of things caught my eye on today's agenda and I don't know, I just figure I would like to hear an explanation of what it means. Particular I am looking first here at, I don't know, maybe you are going to talk about it later, the two vehicle transfers. Apparently the town has a 2017 Ford Escape... COUNCILMAN RULAND: That's true. MR. SCHWARTZ: I find that hard to believe but then I looked it up and they went on sale last month, or this month. Right, it's the last day of May so they just went on sale. The town got one and is transferring it, you want to address the two transfers that are in the agenda? COUNCILMAN RULAND: Sure. It's all about realigning the motor pool, putting the efficiencies where the most miles are. MR. SCHWARTZ: Okay. So what are these two cars.... COLTNCILMAN RULAND: So the newest vehicles are going to be running the most miles. MR. SCHWARTZ: So the 2017 Ford Escape is going to the Human Resource Center. And the 2012 Ford Escape is going into the central garage fleet. COLJNCILMAN RULAND: That is correct. MR. SCHWARTZ: What does the vehicle in the central garage fleet do? COLTNCILMAN RULAND: It is for use by anyone on town business. MR. SCHWARTZ: Okay, thank you for that information. I see by resolution 560 that the town is buying a new computer for $36,000 and change. I am wondering what is the, are we replacing an old computer? What is going on here that we are spending $36,000 on one new computer? COLTNCILMAN RULAND: I believe it's the server. SUPERVISOR RUSSELL: I will clarify, actually we are updating our server because we are expanding our capabilities of a variety of applications and progranls. Our computer technology grows and our need for more space grows. MR. SCHWARTZ: So I am guessing that most of the weight of the computer business of the town is handled by this server and the other computers on desks etc. are basically being used as terminals... SUPERVISOR RUSSELL: Work stations, yes. We have more than one server. Southold Town Board Regular Meeting May 31, 2016 page 5 MR. SCHWARTZ: Okay, well, the way things are going these days, we are trying to reduce the need for infrastructure like that by partitioning out some of the load to other servers. COiJNCILMAN DINIZIO: There are four servers in the town, they all offer redundancy, so on an ongoing basis we upgrade them, along with software that has been, is going obsolete. You know, windows 10 is coming up, you know, we are an XP kind of generation and this is a kind of advanced of that. Next year, I have spoken to Lloyd and there is going to be some serious software upgrades, following windows 10, so that is why... MR. SCHWARTZ: Well, I am glad the town is keeping up with the times but I think there's more people than Lloyd that know something about computers in town and maybe if they got a chance to review the plans, maybe they could make some suggestions that would be useful. COLTNCILMAN DINIZIO: Well, that's what we pay Lloyd for. MR. SCHWARTZ: Well, see,just relying on just one person... COLJNCILMAN DINIZIO: Well, Lloyd doesn't rely on one person, he goes for bids, he investigates different companies and comes up with the best proposal. MR. SCHWARTZ: And he is in charge of the information technology, I guess they call it now, for the town. Is he also in charge of the website? COUNCILMAN DINIZIO: There's a committee for the website. MR. SCHWARTZ: A committee. COLTNCILMAN DINIZIO: And there's a company that we hire, they are hosts. MR. SCHWARTZ: Company, yeah. See, I don't think that company or that committee is really paying attention to what's on the website and how to improve it. I have spoken with you about that before. I think we should have someone dedicated to it. Even if Lloyd was qualified and competent to manage a website, which I don't believe he is, had some experience discussing the matters with him but even if he was, I think his job entails other responsibilities that take his attention away. I think we are sorely in need of a.... COLTNCILMAN DINIZIO: I don't disagree with that.... SUPERVISOR RUSSELL: Let me just interrupt for a second, I do not think that it is appropriate for you to stand at that podium and disparage or diminish the department heads or the people that work for this town. That's what we are here for, swing away when it comes to us. We are elected officials. Southold Town Board Regular Meeting May 31, 2016 page 6 MR. SCHWARTZ: Let me talk about you, then, Scott. What is this here, retirement resolution, specifically the line for the Supervisor that talks about you working 32 days a month now. That's what it appears to be. SUPERVISOR RUSSELL: Can you give me a number? MR. SCHWARTZ: 31.93. SUPERVISOR RUSSELL: No, the resolution. MR. SCHWARTZ: Oh, 537. I am sure that number means something but it surprised me that there were 32 days in the average month. SUPERVISOR RUSSELL: No, actually it is calculated on an 8 hour workday, so if you are working 10 hours, it accumulates on to be more than 31 days. MR. SCHWARTZ: Oh, so you are being clocked at 6 hours so if you are working more, it looks like you are working more days even though it's not, it makes sense now. Thank you very much. I have here an affidavit that the announcement of this hearing was placed in a public area, to whit the Town Clerk's bulletin board. I also have an affidavit here that this has been noticed in the Suffolk Times. I have a memorandum from the head of the Planning Board `Thank you for the opportunity to provide comments on the above referenced local law. The Planning Board supports the adoption of this resolution. Note that the Planning Board recommends that alternative wastewater sanitary systems be required for future developments at higher densities." I also have a memorandum here from our LWRP coordinator and Planning Board Assistant Director, Mark Terry. "This action has been reviewed to New York State Department of Environmental Conservation and as proposed is not subject to SEQRA review." And I do have a letter here from the Suffolk County Department of Economic Development and Planning that says there is no apparent no significant county-wide or inter-community impacts, this is to be considered a matter of local determination. Supervisor Russell SUPERVISOR RUSSELL: I am going to invite anybody that would like to address the Town Board to please feel free. Please? Raymond Fedynak, Mattituck RAYMOND FEDYNAK: Good evening, my name is Raymond Fedynak and I have a home in Mattituck. I am new to this game, okay. The question is, you said that there could be more housing in a defined area? SUPERVISOR RUSSELL: What the current code allows is up to six units per acre. This code is to, that is out for public hearing is to increase that to 12 per acre. However, there's a limit to 24 u nits in any one project. MR. FEDYNAK: That's really cramming people into smaller areas. Is that really what the Town of Southold wants? Is overcrowding in the sense? Whereas, if there is room between homes it doesn't look like Queens, it doesn't look like Manhattan, it doesn't look like Brooklyn. SUPERVISOR RUSSELL: It's a very fair point. This doesn't pertain to single family homes, this pertains to apartments, town houses. Things like that. MR. FEDYNAK: It's also, I mean, the more people you have you have more water uses, more sanitation. You have a lot more things going on when you have an increase in the population in an area. It also affects our tax base and everything else, schools. And do we really, really want that in the Town? Is that what the town, is that the direction the town is going in? SUPERVISOR RUSSELL: Let me just address the first issue. Actually the town has an affordable housing program, guidelines on who can qualify and the first priority would be for people who already live in the school districts. That mitigates impacts on school populations. The second would be for town residents. You have to remember this is multi-generational housing, this isn't about young families with kids, it's about everybody. It's about seniors that are over the age of 55 and need to scale back, it's about middle income people who simply can't afford $2400 a month to rent a house. And obviously for young people just starting out. MR. FEDYNAK: I think it's just detrimental when you start putting more apartments into an area that actually should only be with that first number that you gave me and not doubling it. it's just I think it's inconsiderate to people that are living here in town and don't really want growth, it's not good. COLTNCILMAN DINIZIO: I have been involved in the town for 30 years. When we started out, we started looking at how we could stop or at least deaden the incoming site plans that were coming in and subdividing our land to the point where it might look like what you said it might look, Levittown and such. We decided that we were going to encourage farming, encourage vineyards and we were also going to take 2 percent of a certain amount of money and buy as much land as we possibly could. You know, we did that. And that helped down school taxes, it held down just about every tax, too. If you look around the country, you know, with 2008 when the market was just falling out, you have got to think that we had a really good base where we didn't feel the hurt like the rest of the country did. Like Florida did, like Texas did. You know, it's time now that we have to start finding places where our workers can live, we have an aging fire department and go to any fire department and you will be hard pressed to see mare 10 or 15 guys that are old enough to pull hose off a truck, you know, pull 1500 feet of hose off a truck or hold a two inch hose and those things are all going to be, 10 or 15 years from now when we don't have enough young people, you are going to be paying those guys. So you want to pay the guys, it's volunteer for you now, that's what's going to happen. I know in my school district in Greenport, my fire district I probably heard that siren go off 15 times this weekend, okay? Most of them were rescues. One of them was a house fire that they spent probably 7 or 8 hours at. We are at the end of our rope here as far as that is concerned and the reason is our kids have to go someplace else, they can't afford it. You know, the government, our tax dollars are competing against our own children. So, we have been trying to put in affordable housing, we have been trying to make, get it from somewhere. Most of the laws we have made just simply haven't worked. They just haven't produced a single affordable housing. We have tried putting apartments in garages, and down in basements and none of that seems to work because building codes have to be complied with and they have to be a certain size, now we have got people they basically buy a house and rent it out every weekend so they can afford maybe in 10 years to come here and live and all those homes are off the market for our kids and they increase the value of all of our homes when they do that because when they are off the market, it makes it harder, it makes my house more valuable. I get all that. But we have got to start somewhere and I am not so sure that what we pass today, we are going to see one development out of it. I really don't see it. Honestly, I have been involved here 30 years. I just don't see it, sir. But I see a lot of preserved land, I see a lot of farms that are up and coming. We just had a chicken farm, guy wants to do a chicken farm. Those things were, back when I was a kid, those were pretty prevalent but they aren't anymore. Maybe that's coming back and that's going to help us but the new farming is going to be greenhouses and things like that and hopefully that's going to give us some good economics. It's going to give us buildings that our electricians and our plumbers and HVAC people can work on and make a living out here because it's darn hard. So I beg to differ with you about it ever looking like Levittown. We own most of that land and if we can keep the farms here, we are going to have a darn nice community but we do need people, we need places for people to live and I hope you can, it can encourage you to look a little closer at what you said. They need to be a resident of the town for I believe three years, so you need to be an already established person in the town. It won't be an influx of people coming from up west. They are already a part of the community, secondly, this is not as a matter of right. Any project that wants to be built needs to be presented to the town board and it needs to be subject to public hearing and adoption of a change of zone to what we call affordable housing district. Once the occupants are in this, they are carefully vetted. Each and every year they have to reestablish, re-verify their income, re-verify their residency. It's an ongoing process. COIJNCILWOMAN DOHERTY: And it has to go through site plan approval through the Planning Board as well. SUPERVISOR RUSSELL: Would anybody else like to address the Town Board on this particular local law? Benja Schwartz BENJA SCHWARTZ: Benja Schwartz, Cutchogue. I haven't been following this that closely, I saw something about it in the agenda tonight but it was buried under some technicalities. I absolutely support provision of affordable housing in the Town of Southold but I am not convinced that the current registry is sufficient to carefully vet applicants who deserve essentially public subsidies for their housing. I don't think we can do what Fishers Island is done which is pay for the actual housing for them. I applaud the town board and the people who are working with the town board for trying to develop a formula that will work. But I think that we have a long way to go and it should be in the context of the comprehensive town plan that will permit the town to guide the developments to be more compatible. Not only to be more affordable but to be appropriate for people living in the Town of Southold. Apartments are fine if they are done in a particular way but we don't want the kind of buildings that belong in the city. I think we need to consider what's going to happen with the sewage but not just think about the prohibitions and the negative regulations that we need to make. I think the last recipient that I know of under the affordable housing of the town code, his first comment reported in the paper was that he couldn't wait to put a swimming pool in. Well, I hope that wouldn't be permitted, I don't know if it will be. But swimming pool, we don't even have a municipal swimming pool and we would have affordable housing with swimming pools? The town is going to subsidize that? Alright, thank you for your efforts and I hope we can continue to work on these issues. SUPERVISOR RUSSELL: Thank you. There's just a couple of points that you had mentioned, and I want to make crystal clear for the public. This is not subsidized housing, this is regular apartments. These people need to come in, they have to verify their income and they have to go through credit checks because we need to make sure they are going to be responsible tenants. In no instance will the town be subsidizing any of this. Not the incomes, not the rents and not the purchase of the property itself. We don't have money to do that anyway but that is not the intent of this legislation. Albert? Suffolk County Legislator Albert J. Krupski, Jr. Southold Town Board Regular Meeting May 31, 2016 page 49 LEGISLATOR ALBERT KRUPSKI: Good evening, A1 Krupski, Cutchogue. Just a couple of comments. I wondered if you considered and I know the hamlet stakeholders did an awful lot of work and there are well-defined hamlets in town and I wondered if you considered the placing of these being limited to those hamlets, where you are closer to the services. Public transportation, whether it is the light rail or the scoot train or libraries, post offices, delis. Those sorts of things, within walking distance, whether that would be a consideration? I think another important factor and you read it within the description was with the alternative wastewater treatment systems that the county will be approving soon, and the county health department now and the board of health are considering a new article 19 and there is a lot of concern now about that changing, possibly changing the density requirement that article 6 sort of regulates right now because once you, these alternative systems are going to treat the waste to a much higher level, therefore the fear is that they might increase, enable people to increase density based on the limits of article 6. So I think you should look at the existing density in all the hamlets as per zoning and make sure that those densities and I know there was one in Mattituck and they couldn't meet their as of right density because of the health department, because they were limited by wastewater treatment, with these alternative systems, that might not be the case and you should look at the density in each hamlet as of rights, before you look at any other increase density in those areas. And to consider that. SUPERVISOR RUSSELL: Thank you, Albert. COLTNCILMAN GHOSIO: I have come across some of that in my research to address some of the issues of affordable housing and maybe allowing more density in the hamlet business zones. You know, we have some small, irregular lots that we could potentially have a little bit more density, that are right in the hamlet, closer to walking distance to everything but until we get these alternative treatments, we run into roadblocks and between that and cul de sacs and things of that nature, so we have been working on that, so it's a good point. I just want to raise the one issue going back to what Mr. Fedynak was talking about, I have to say that I agree with the notion that we have done an awful lot in terms of land preservation and trying to maintain the traditional character of our town but part of that tradition is also the small businesses that we have here and those small businesses are struggling with getting and keeping employees. Because by and large the work and the jobs that are available, particularly seasonal jobs, aren't high paying jobs where you can afford mortgages over $2500 or rents over $2500 a month. These people are critical to the functioning of the town that we live in and they have asked us many, many times in various formats, perhaps it was a seminar or a meeting that we had, asking us to try to address this because they need employees that can afford to live here, and it's getting harder and harder and if we don't take some kind of action or present some ideas so that the folks that build homes here make is so that they can be incentivized to do something with us on this, we are never going to get anywhere and I think that this is just another step to trying to make it attractive to those that can bring us those affordable units. Anne Murray, East Marion ANNE MURRAY: I have a question, I am glad that the Town Board is doing this but how do you ensure, I mean, obviously you are doing this to attract developers who may want to build apartments, correct? Southold Town Board Regular Meeting May 31, 2016 page 50 SUPERVISOR RUSSELL: Yes. MS. MURRAY: So how do you ensure that they will make them affordable? SUPERVISOR RUSSELL: They would have to follow the guidelines established in the town code which requires that they meet or they keep the rents at a certain level and I believe that it's for 1, 2, 3, 4 people and the income can go up and again, that's verified annually, we verify it with the landlords, we verify it with the tenants, we verify it with their income, their residency... MS. MURRAY: Okay, so a developer from out of town couldn't come in and say, well I am going to pack 50 families in 32 units and charge a lot of money for them. SUPERVISOR RUSSELL: No, the state building code limits how many people you can have on a square foot basis... MS. MURRAY: But would they be inspected? SUPERVISOR RUSSELL: Yes, annually. COLJNCILMAN DINIZIO: But the law, the Board has to grant them that density. So it has to go through a public hearing. It's not just a guy coming in looking at a piece or property. MS. MURRAY: And would these apartment buildings be affordable in perpetuity? SUPERVISOR RUSSELL: Yes. MS. MURRAY: They would be? Well, then I applaud you for doing this. Thank you. SUPERVISOR RUSSELL: Robert? Robert Dunn, Peconic ROBERT DLTNN: Robert Dunn, Peconic. Scott and I have talked about this on a number of occasions and I just have a personal experience. One of my seasonal jobs, going to the Hamptons, 5:00 in the morning, I deliver plants, six weeks a year. Going to the Hamptons 5:00 in the morning on a Wednesday, Thursday or Friday this time of year, takes you as long to get to Manhattan now because the people who work in the Hamptons cannot afford to live in the Hamptons, so this is a real good thing, about, unless we want to find ourselves with Long Island Expressway kind of traffic on the Main Road, five or ten years down the road, because the people we need to do our electric work, do our plumbing work, do our landscaping work, have to drive in from eastern Nassau or western Suffolk. And that's just, it's mind boggling to me. I mean, the first few times I did it, I just couldn't believe. And the thing reverses in the afternoon so you could say, I don't care, I am not up at 6:00 in the morning, but you are up at 3:00 in the afternoon and try to go shopping at any one of those towns along Montauk Highway or Sunrise Highway at 3 in the afternoon, Wednesday, Thursday or Friday at this time of the year, it's just impossible. It's not the people coming out from the city, it's the people trying to support what's there. So, a little bit of housing for the people who do that kind of work is important. Southold Town Board Regular Meeting May 31, 2016 page 51 COLTNCILMAN GHOSIO: And what's worse, Bob, down there... MR. DUNN: You would know it. COLJNCILMAN GHOSIO: Because I work down there, is all of the back roads are now the bypasses. MR. DUNN: Oh, sure. COUNCILMAN GHOSIO: And you will have just as much traffic on a...I could just see Oregon Road becoming a bypass. MR. DUNN: It's crazy. Crazy. It's, you have to do it. You have to do it. SUPERVISOR RUSSELL: Also, I wanted to mention, you know people have, so you have a clear understanding of who we are building these apartments for, you really need to go to your fire departments and meet them because that's where they are. You need to go to Eastern Long Island Hospital and meet the LPN's. People that are 55 and over that are still a substantial part of the work force in Southold Town not to mention the volunteerism that we see from Southold seniors, all these people, they are all part of the current framework of Southold Town. They are, you know, this isn't going to alter the character of this community. By limiting it to 24 units and through architectural review, we believe that we can make sure that they are consistent with the vision and the character of each of the hamlets. And it's also important to remember that our goal is to scatter these throughout the town. We are not interested in building a lot of units in one location, which is why we capped it at the 24. These proposals of 40 or 50 or 70, that's never going to be accepted by the community and it shouldn't. We can scale these to the hamlets, we think, due to architectural review, we think that we can make sure that the character of the building absolutely capture the character of that hamlet. Catherine Sepenoski rep.Port of Egypt Marine & Sep's Farm CATHERINE SEPENOSKI: Catherine Sepenoski. I am here to say thank you for considering this and moving forward with this. I represent Port of Egypt Marine in Southold. We have over 30 employees, in the height of the season. Heron Harbor Suites at the height of the season is 6-8 employees and Sep's farm in East Marion. So we understand the need very strongly, I just hired one gentleman who is driving from Setauket daily to help at the marina. I have two sons who left here with a wonderful education from our local schools, to get educated in Boston. One is an architect, so your architectural review, having architects coming back to the area and build and keep the character of who we are because they grew up here would be a wonderful thing. My older son is working on his PhD for writing and would like to come back here and be an educator here. He just had his first son and we want our family to come back, we want them to be part of the fabric of this community and from the receptionists at my front desk at the marina, to the mom with three kids who manages my hotel, these are the people, as you said Bob, that need to have someplace affordable to live without this stigma attached to the word affordable. This is reality housing, this isn't affordable housing. This is keeping these people here and keeping our Southold Town Board Regular Meeting May 31, 2016 page 52 businesses going because it is going to disappear, there is going to be nobody to help take care of it. So, I thank you very much. I appreciate it. SUPERVISOR RUSSELL: Thank you, Kate. When I ran for office last fall, we had the debate with the chambers and I also heard this from time to time, is that the number one issue that they identify which is the most important to everybody in the room was affordable housing and that comes up in every forum that I am at. to be candid, based on this last winter and the condition of the roads, we might have a new winner but affordable housing is usually number one. Would anybody else like to address the Town Board? Matthew Edwards, F.I. Walsh Park Benevolent Corp MATTHEW EDWARDS: I am Matthew Edwards, I am with the Walsh Park Benevolent Corparation on Fishers Island which was established in 1987 to build affardable and attractive year round housing to help sustain the year round population on Fishers Island. As of right now, we have 27 living units. Eleven are owner occupied and out of those 27 units, the population that live in those units make up 30 percent of the year round population, 50 percent of the fire department, the EMT's and the sea stretcher crew. And 40 percent of the year round students in Fishers Island schools live in Wolf Park housing. We are looking to do more, I am the first employee, the organization was founded in 1987 they hired me in January. We are hoping to grow it. Louisa can attest to the importance of having year round affordable housing on the island to maintain that population base and hopefully grow it and so we just wanted to thank you for presenting this and hopefully it gets approved and hopefully we will have some new properties going up that benefit from this. Thank you. SUPERVISOR RUSSELL: Thank you. JUSTICE EVANS: And can I just say, some of you introduced yourself to Matt, he knows who you are, like Denis, it is just good for him to know who he can be talking to about this. Thank you. SUPERVISOR RUSSELL: Would anybody else like to address the Town Board on this particular local law? Benja Schwartz BENJA SCHWARTZ: Very briefly, I just couldn't find an agenda. Section B says notwithstanding (inaudible) there should not be more than 24 dwelling units on any site and you have been sighting that number but then the next section says the Town Board shall have the authority to reduce the minimum square foot and increase the maximum number of units, notwithstanding this foregoing (inaudible) but the Town Board may not increase the number of units per site above 36 units per site. This seems a little roundabout, if you are going to put a limit of 36, put a limit of 36 but why start with a limit of 24 and then we can vary that to 36? SUPERVISOR RUSSELL: What I had actually envisioned and I am not sure this actually captures that, was a separate component to give the town the ability to notice for the other 12 Southold Town Board Regular Meeting May 31, 2016 page 53 with an understanding that the mass of the structures wouldn't change. That's a fair point, Benja. Would anyone else like to address the Town Board? Please. Debra O'Kane, Orient DEBBIE O'KANE: Debbie O'Kane from Orient. I am actually a member of the Housing Advisory Commission but I am speaking on behalf of myself and not on behalf of the commission. I would just like to recommend that sustainable building practices always be considered when it comes to these types of developments along with energy efficient standards. I think those two things are very, very important and if there is some way to incorporate this into the legislation, that would be very good. Thank you. SUPERVISOR RUSSELL: Fair point, thank you. Sir? Raymond Fedynak MR. FEDYNAK: Just a quick question on the type of housing you would plan to put in. Would it be one story, two stories or three stories? SUPERVISOR RUSSELL: It would be no more than two story. MR. FEDYNAK: That's if you are considering that for older people, that's not good. Some older people need elevators, that's a problem. SUPERVISOR RUSSELL: The proposal is to allow for someone to come forward and say I want to build 55 and over community. In just about every instance, they need to make that one story to make it attractive because seniors really don't want to rely on stairs in the building. We get that. this legislation is trying to be all encompassing. MR. FEDYNAK: The best example of housing for elderly people and I am one of them is Founders Village. That's laid out nicely and people can walk to town, it's not that far because there really is no public transportation out here. I mean, when a bus comes once an hour or once an hour and a half and the train only comes out here twice a day, that's not public transportation, that doesn't allow people to go from point a to point b. so it's cars and there are no busses and sometimes you have the senior citizen center and they send out a bus and it helps people get around but there are a lot of other issues to take care of other than density. I mean you can pile people up and that's one of the biggest faults in Manhattan and a lot of places in the city, it leads to neighbors not knowing each other and getting along. So, it's, and I grew up in those areas. SUPERVISOR RUSSELL: I am going to be honest. I am not sure you envision the goals of this legislation. This isn't going to create the communities like you see up west. I have to be honest, there is a community being built in Southampton right now, Georgian style structure, little outbuilding in the back, a barn style garage, it's a stunning structure. The people, the traffic and all of that, they are already driving around Mattituck. If we were to build it there because the component to the affordable housing requires that they live in Mattituck first, so those houses are already part of the road system, they are already pulling into the shopping center and all those Southold Town Board Regular Meeting May 31, 2016 page 54 things. This isn't going to create influx. It is going to house the people who are already part of the community wherever it's built. COiJNCILWOMAN DOHERTY: We have been trying to engage local builders to construct or refurbish places to make them affordable and it is not attractive enough for them to make any profit on it to do it, so we have been continued discussion on how we could expand the field and do things a little different to make them more attractive, so a builder would build them and he could make a little money and somebody could afford to live here. And in a perfect world, yeah, let's put Founders Village here, let's put it there, but we don't have the property, there's a lot of little pieces land that maybe could be turned into some units, affordable housing. We are trying to be creative and attract people to want to do this and you know, if it doesn't work, we can always change it again but like Jim said, we are at the end of our rope here and we need to develop legislation have people live here and work here. SUPERVISOR RUSSELL: And no proposal can go in without a separate proposal, public hearing, a change of zone. This process that we have tonight will have to be repeated should any proposal come down the pike. MR. FEDYNAK: I am not totally opposed to it, I am just saying, that when you just stack people in, you go from 24 units to 36 units, you can go to 42 units. JUSTICE EVANS: And many of them won't even be 24 units, if it happens. MR. FEDYNAK: But I am just saying, well, you haven't said that. I mean, like I said, I just came tonight because I figured I would come here and see what's going on, okay? COUNCILWOMAN DOHERTY: It could be an existing building that somebody retrofits and works with this, along as it... MR. FEDYNAK: Well, there are probably a lot of places in the Town of Southold that could probably do that. COLTNCILWOMAN DOHERTY: Right and this code allows that and opens the possibility up. I found out that one of the pipes that's going in on Route 48 is actually a water pipe. I thought it was a sewer. And today, I was surprised on a trip I was making down to the south fork, there is a similar pipe going down 105. Which leads me to believe the possibility that the water that comes out of the pumping station on Mill Lane, maybe finding its way to the south shore. Fortunately, tonight we have someone from the County here that might know something about that. That pumping station on Mill Lane is going to be pumping a whole lot of water out, if in fact that's true, yet I just find it amazing that we may be pumping water out of Peconic or somewhere in Southold that's going to find its way onto the lawns of the south fork, when there are areas on the north fork that are going foul because of saltwater intrusion. You can't take water out without coming in from somewhere else. You know where I am going on this. In fact, my house specifically because I know, I can't get county water and they won't bring it there unless a number of people sign up and I happen to know some houses in the neighborhood already have a problem with saltwater intrusion into wells. It seems to me that the county ought to be prepared to remedy that fact, if they are going to be sucking water out of Mill Lane in Peconic to send it elsewhere, specifically the south side, they ought to be at least provide us the option to street water. Which I don't even have, I am willing to pay for hookup, they won't put water in front of my house. Sorry I keep looking at you. COLTNCILMAN RULAND: If I might address some of your comments, you made quite a few comments and you're partially right on some of your comments. MR. DUNN: I am sure I am. COUNCILMAN RULAND: That the pipe you referred to along CR 48 is in fact, a water pipe. There is also work being done down there with underground electric conduit as well. MR. DUNN: Right. COUNCILMAN RULAND: Okay. The pipes you refer to on CR 105 is welded gas pipe. MR. DUNN: There's some pipe that I saw there this morning for the first time and I travel down there twice a week. COUNCILMAN RULAND: Yes, yes. MR. DLJNN: it looks identical. It (inaudible) it's not welded pipe. No, no, no. COUNCILMAN RULAND: Along 105? MR. DiJNN: On 105. COLINCILMAN RULAND: On which side? MR. COLJNCILMAN RULAND: Okay, the only other thing I want to say to you is that Suffolk County doesn't have anything to do with that water company. They just have a catchy name. MR. DUNN: Okay. COUNCILMAN RULAND: That's something you would have to ask the water company. SUPERVISOR RUSSELL: If only we knew someone that in the county, that could get us the answers to our questions, Albert? MR. DiJNN: So Suffolk County, so I misunderstand, Suffolk County Water Company is not Suffolk County? COUNCILMAN RULAND: It's called Suffolk County Water Authority but I would equate it to Suffolk County National Bank, okay? That's a catchy name. But it has nothing to do with Suffolk County, alright? And this Suffolk County Water Authority.......... MR. DUNN: Is private? COLTNCILMAN RULAND: Is a municipal fiefdom, it is very private, alright? They don't answer to anybody. MR. DUNN: But it's publicly owned? COUNCILMAN RULAND: No. It's a public benefit corporation. Like the MTA, they are first cousins. SUPERVISOR RUSSELL: I have to say that your concerns are concerns that have been raised in the past. You are 100 percent right, there actually is a large well field, in and around Laurel Lake and our concern was is that water going to go to Riverhead because I think it links up right around where Farmveu is. And we have always been assured that Riverhead has more water than us, okay? We need to start putting directionals on, to see which way the water is...... MR. DUNN: Okay, if Suffolk County Water Authority, whoever they are, owns that water, they can do whatever they want to do with it. But if they are going to take it somewhere else, then they should at least give me the option to hook in and I am willing to pay my share to hook in. Southold Town Board Regular Meeting May 31, 2016 page 57 When and if I need to but it's got to be there. I can't hook into Peter's house because he has the same water l do and I just, I know in the neighborhood, I am not going to mention names but I know there are a few people now, they are on the edge of whether they have got salt water coming out and it just seems to me that if the water that we are putting into the system can come out in other areas in the system, then we ought to all at least be able to share in that system. And I am just really looking for a discussion here, I am not looking for you to say, okay tomorrow you can hook up but, who is in charge? SUPERVISOR RUSSELL: I agree. MR. DUNN: Who owns it? and if in fact they are going to take water and they are going to connect the water into that pump station on Mill Lane, then there are ways, I don't care who they are, we can find a judge right now that will tell them you can't hook in until you guarantee everybody in this neighborhood at least has the opportunity to tie in. SUPERVISOR RUSSELL: Can we look at that, perhaps have a discussion, to look into the legality of perhaps pursuing that. MR. DUNN: I mean, a simple injunction, don't hook the pipe up until everybody gets the opportunity to avail themselves to it. SUPERVISOR RUSSELL: That's an issue we will look at. I like the idea, Robert. We will look at it. The one thing I should point out to everybody that who owns the water, we own the water. MR. DUNN: We own the water. SUPERVISOR RUSSELL: They pull it out, filter it and sell it back to us. MR. DUNN: Right. COLTNCILMAN DINIZIO: We just got something from them. MR. DLJNN: Inaudible. If somebody can use it to keep five acres green elsewhere, then I ought to at least take a shower with it here. COLINCILMAN GHOSIO: That isn't the worse, Robert, it's not so much keeping the lawns green, they are pumping millions and millions and millions of gallons through geothermal systems so that they don't have to have outdoor condensing units for their air-conditioning. So they don't have to see them. MR. DITNN: But geothermal units, they use street water for that? COUNCILMAN GHOSIO: Not everybody but an awful lot, they use the street water. I service them. Southold Town Board Regular Meeting May 31, 2016 page 58 MR. DUNN: Okay, alright. So that just gets...... COLTNCILMAN DINIZIO: We got this work thing from them, every once in a while they send us the thing where they are working. The one in Babylon, Cutchogue is the one you mentioned, Lindenhurst and Sayville. Flushing mains, flushing mains and new water main and water main replacement. Nothing in Riverhead. MR. DL1NN: The problem that I am describing, there's a lot of areas that are going to be subject to the same thing with salt water intrusion along our shorelines. So... SUPERVISOR RUSSELL: we agree and we will certainly look into that. Who else would like to address the Town Board on any issue? Benja, I am going to ask you to be succinct. Benja Schwartz BENJA SCHWARTZ: Alright, I have got some notes, so I won't roam around too much. But same as you wouldn't publish a book without a name, you really shouldn't publish a webpage without a title, it's like part of each webpage. We need a web master in town, not somebody who disrespects and disregards advice from local web designers. We need a functional website committee/web presence committee. The committee we have right now is not even on the web site let alone using the website to gather input. Okay, I could go on all night, I am not going to but I want to just mention that in our current comprehensive planning effort, there has been a decision made not to include planning for the local government and this is not unusual in comprehensive plans. However, there are forms of comprehensive planning which are designed for municipal agencies. One in particular, started around over 25 years ago, the New York State Police Department became accredited. Twenty four years ago, the East Hampton Town joined them. Eighteen years ago, Southampton Town became accredited. Seven years ago, Shelter Island Town became accredited, five years ago, Riverhead Town. Southold Town is not only the only one who is not accredited, it has never applied for accreditation to my knowledge. And I haven't updated my information in two or three years. It was about five years ago that I asked the then constituted Town Board whether they would consider applying for accreditation. I would like to ask the same question to you. COLJNCILMAN DINIZIO: I don't know what that is. COLJNCILMAN RULAND: Accreditation from where? MR. SCHWARTZ: New York State was a leader in accrediting police agencies. Basically what they do is subsidize the development of a comprehensive plan for the agency. They don't impose any requirements on the agency, they just work with the agency to make the agency more efficient, more economical, more effective and more compatible and able to work with other government law enforcement agencies. The police accreditation program, I can send you a link with information on it if you like. We can continue this discussion another time. I don't know how long Southold Town Police has had a police department, I sort of remember when the Greenport Village abolished their police department, I was surprised last week when I was looking through the town code on the police that the Southold town code. still provides in section Southold Town Board Regular Meeting May 31, 2016 page 59 51.1 `does hereby establish the police department for the portion of the town outside of the incorporated village of Greenport' so I think, you know, when Southold started policing Greenport, they never really cleaned up the loose ends and it's not just loose ends.
