BOUNDARY LINE AGREEMENT
AGREEMENT made as of this 29th day of March, 2016 by and between THE ROMAN
CATHOLIC CHURCH OF SACRED HEART, with an address of 27700 Main Road,
Cutchogue, NY 11935 ("RCCSH") and THE ROMAN CATHOLIC CHURCH OF SACRED
HEART, AT CUTCHOGUE, with an address of 27700 Main Road, Cutchogue, NY 11935
("Sacred Heart").
WHEREAS, the parties to this agreement are the present owners in fee of adjoining
parcels of improved real property and there is some confusion,doubt and uncertainty concerning
the precise location of the common boundary line between their respective properties, and the
parties wish to define and establish such boundary line for all time, it is agreed as follows:
1. Sacred Heart represents that it is the present owner in fee of the premises known
as 27700 Main Road, Cutchogue,NY 11935,County of Suffolk, District 1000 Section 102.00
Block 06.00 Lot 002.002, which property is more fully described in a certain deed dated
September 30, 1957, and recorded in the office of the of County of Suffolk on October 10, 1957
in Liber 4374,page 469. See Schedule "A" attached.
2. RCCSH represents that it is the present owner in fee of the premises known as
27 71„p Main Road, Cutchogue,NY 11935, County of Suffolk, District 1000 Section 102.00
Block 06.00 Lot 002.003, which property is more fully described in a certain deed dated as of
February 5, 1968, and recorded in the office of the of County of Suffolk on February 20, 1968 in
Liber 6306,Page 456. See Schedule "B" attached.
3. The boundary line on the northeasterly edge of Sacred Heart's property and the
southerly side of RCCSH's property (the "Boundary Line") is uncertain because of a walk
erected on the Boundary Line (the "Walk"), which Walk belongs to RCCSH.
4. RCCSH,and its heirs, successors and assigns forever, agrees to obtain the
approval of Sacred Heart or its heirs, successors and assigns forever,which approval shall not be
unreasonably withheld, conditioned or delayed, prior to repairing, removing or relocating the
Walk.
5. Annexed hereto and made a part of this agreement is a survey made and certified
by Nathan Taft Corwin III Land Surveyor and dated March 13, 2015, which establishes the
common boundary of the adjoining parcels in accordance with the agreement of the parties to
this agreement.
6. RCCSH hereby releases and quitclaims to Sacred Heart and its heirs, successors
and assigns forever, all right, title and interest in and to any and all land northeasterly of the
Boundary Line established by the above survey.
7. Sacred Heart hereby releases and quitclaims to RCCSH and its heirs, successors
and assigns forever, all right, title and interest in and to any and all land lying south of the
Boundary Line established by the above survey.

8. This agreement shall run with the land and be binding upon the parties hereto and
inure to the benefit of their respective heirs, representative, successors and assigns.

BEGINNING at a point on the southeasterly side of Main Road where the same is intersected by
the southwesterly side of land of the Roman Catholic Church; said point of beginning also being
distant 381 feet, more or less, southwesterly from New Suffolk Road; and
