(over) n5-1V5-o 1 CORRECTION PARKING AREA EASEMENT THIS INDENTURE, made this 3rd day of March, 2016, between ISLAND'S END GOLF AND COUNTRY CLUB, INC., with offices at 4675 Main Road, Greenport, New York 11944, hereinafter referred to as the "Grantor," and ROBERT J. HEANEY, with offices at 4545 Main Road, Greenport, New York 11944, hereinafter referred to as "Grantee," made to correct the fact that the original Parking Area Easement dated April 24, 2007 and recorded on September 14, 2007, in the Office of the Suffolk County Clerk in Liber 12522, Page 474, failed to include / the distance of the first course of the description; to wit: 246.86 feet. WHEREAS, the Grantee owns and operates the restaurant known as "Skippers," which is located at 4545 Main Road, Greenport,New York, immediately adjacent to the west and south of property owned by the Grantor on which the Grantor maintains and operates a golf course; and WHEREAS, the Grantee wishes to acquire an easement over a portion of the property owned by the Grantor for use as a parking area in connection with the Grantee's ownership and operation of the aforementioned restaurant. Now, therefore, WITNESSETH: The Grantor, in consideration of Ten ($10.00) Dollars and other good and valuable consideration paid by the Grantee, does hereby grant and convey unto the Grantee, its successors and assigns, an easement for the parking of vehicles on the following described premises: ALL that certain plot, piece or parcel of land, lying and bearing near Greenport, Town of Southold, County of Suffolk, and State of New York, more particularly bounded and described as follows: BEGINNING at a point on the northerly side of Main Road (NYS Route 25), which point forms the intersection of the easterly boundary line of the Grantee's property and the westerly line of the Grantor's property and the northerly side of Main Road (NYS Route 25); RUNNING THENCE, North 32 degrees 07 minutes 30 seconds West, a distance of 246.86 feet, along the boundary line between the properties owned by the Grantor and the property owned by the Grantee to a point on said boundary line; 1 RUNNING THENCE North 66 degrees 07 minutes 40 seconds East, a distance of 89.95 feet to a point; RUNNING THENCE South 32 degrees 07 minutes 30 seconds East, a distance of 210.00 feet to a point on the northerly side of Main Road (NYS Route 25); RUNNING THENCE along the northerly side of Main Road (NYS Route 25), South 66 degrees 19 minutes 45 seconds West, a distance of 90.00 feet to the point of place of BEGINNING, said premises consisting of an area of 18,680 square feet as depicted on the attached survey of John Metzger,Peconic Surveyors, P.C. dated May 5,2004. AND the said Grantee covenants as follows: FIRST: To limit the use of said premises as and for a parking area for vehicles of the Grantee, its agents, employees, guests and invitees in connection with the operation of the Grantee's restaurant. SECOND: To repair and maintain said premises as may be consistent with the use of said premises as a parking area for such vehicles. THIRD: To indemnify and hold the Grantor harmless from any and all liability, responsibility, cost, or expense, including attorneys fees and litigation costs, incurred as a result of the use of said premises by the Grantee, his agents, employees, guests,or invitees. FOURTH: To purchase and maintain liability insurance for the subject premises naming the Grantor as an additional insured on said insurance policy and to furnish the Grantor with a copy of said insurance policy as well as with proof of the payment of the premiums thereon.
