BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose. The purpose of these Amendments is to allow more flexibility in the design of Affordable Housing Districts in order to expand the opportunities for the creation of moderate income housing within the Town. PERMANENT FIXED IMPROVEMENT An improvement to a lot or a moderate-income family dwelling unit which cannot be removed and which provides value to the property above and beyond repairs done to maintain the property in good condition. A permanent fixed improvement must be approved in advance of construction or installation in writing by the Government Liaison Officer Special Projects Coordinator. The employee of the Town who is responsible for the development, implementation and coordination of the housing registry and affordable housing initiatives for the Town of Southold. § 280-26. Applicability. AHD Districts shall be established by the Town Board on parcels of land that have been identified through the accepted principles of Smart Growth planning as being appropriate and desirable locations for affordable housing. Such locations include, but are not limited to: land within Hamlet Locus Zones, as may be determined by the Town Board; land within walking distance of services, shops, schools, and public transportation; land that adjoins existing centers of business and residential development(as opposed to land adjoining farm and open fields); and other locations where the project has been shown to meet a demonstrable need. AHD Districts shall be designated by Town Board resolution after a public hearing thereon, upon 10 days' notice thereof by publication in the official Town newspapers. 280-28. Notwithstanding the bulk schedule set forth in subsection (A) of this section,there shall be no more than 24 dwelling units on any one site. C. B7 Authority to amend requirements and specifications. (1) The Town board shall have the authority to reduce the minimum required square foot per unit requirements set forth in subsection(A) and increase the maximum number of units per site set forth in subsection(B). Notwithstanding the foregoing,the Town board may not increase the total number of units per site above 36 units per site. (2) (1) The Planning Board shall have the authority to reduce or amend yard setback requirements, lot dimension requirements, parking requirements, and highway specifications. In making this decision,the Planning Board shall take into consideration the benefit to the applicant, as weighed against the detriment to the health, safety and welfare of the neighborhood or community. In making such determination, the Planning Board shall also consider: (a) Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the amendments; (b) Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the sought variance; (c) 'Whether the variance is substantial; (d) Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district; and (e) Whether the alleged difficulty was self-created, which shall be relevant to the decision but shall not necessarily preclude the proposed amendment or variance. (3) (2) This provision supersedes and amends New York State Town Law §§ 267, 267-a, 267-b and 267-c insofar as these sections give such authority to the Zoning Board of Appeals. Any amendment to highway specifications shall meet with the approval of the Southold Town Regular Board Meeting June 14, 2016 page 9 Highway Superintendent. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. There actually was a provision in there that allowed the town by special action to increase the 24 limit to 36. We had a lot of public comment on that, they raised the issue that we had already put a limit of 24 on there. Thirty six seemed to be getting away from the very intent of this legislation which is to promote affordable housing projects that would be consistent with the hamlet centers in scope and scale. Revenue Anticipation Notes (herein called the "Notes") of the Town of Southold, in the County of Suffolk, New York (herein called the "Town"), in the aggregate principal amount of not to exceed $525,000.00, and any notes in renewal thereof, are authorized to be issued pursuant to the provisions of Sections 25.00 and 39.00 of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called the "Law"). Section 2. The Notes are authorized to be issued in anticipation of the receipt of moneys anticipated and/or expected to be received by the Fishers Island Ferry District from the United States of America, acting through the Federal Emergency Management Administration (FEMA), on account of storm-related damage affecting the Fishers Island Airport. The proceeds of such Notes shall be used only for the purposes of paying the current expenses for the current fiscal year payable from the revenues in anticipation of which they are issued. Section 3. The following additional matters are hereby determined and declared: (a) The Notes are not issued in renewal of other notes. (b) The Notes shall mature within the period of one year from the date of their issuance and may be renewed from time to time in accordance with the provisions of the Law. (c) No revenue anticipation notes have been heretofore issued in anticipation of the revenues specified in Section 2 hereof. (d) The Notes are issued in anticipation of the collection of revenues other than real estate taxes or assessments. A permanent fixed improvement must be approved in advance of construction or installation in writing by the Government Liaison Officer Special Projects Coordinator. ' The employee of the Town who is responsible for the development, implementation and coordination of the housing registry and affordable housing initiatives for the Town of Southold. 280-26. Applicability. AHD Districts shall be established by the Town Board on parcels of land that have been identified through the accepted principles of Smart Growth planning as being appropriate and desirable locations for affordable housing. Such locations include, but are not limited to: land within Hamlet Locus Zones, as may be determined by the Town Board; land within walking distance of services, shops, schools, and public transportation; land that adjoins existing centers of business and residential development (as opposed to land adjoining farm and open fields); and other locations where the project has been shown to meet a demonstrable need. AHD Districts shall be designated by Town Board resolution after a public hearing thereon, upon 10 days' notice thereof by publication in the official Town newspapers. § 280-28. In making such determination, the Planning Board shall also consider: (a) Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the amendments; (b) Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the sought variance; (c) Whether the variance is substantial; (d) Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district; and (e) Whether the alleged difficulty was self-created, which shall be relevant to the Southold Town Regular Board Meeting June 14, 2016 page 41 decision but shall not necessarily preclude the proposed amendment or variance. (2) This provision supersedes and amends New York State Town Law §§ 267, 267-a, 267-b and 267-c insofar as these sections give such authority to the Zoning Board of Appeals. Any person desiring a license under this chapter shall first register with the Town Clerk of the Town of Southold and shall file with said Town Clerk an application, in writing, containing the following information: A. The name of the applicant. B. The applicants permanent home residence. C. The name, address and telephone number of the person from whom goods making the stock, if any, were or are to be purchased. D. Three bona fide business references. E. The place or places of residence of the applicant for the previous preceding three years. F. III. The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 197, Peddlers, Solicitors and Transient Retail Merchants"reads as follows: LOCAL LAW NO. 2016 A Local Law entitled, "A Local Law in relation to Amendments to Chapter 197, Peddlers, Solicitors and Transient Retail Merchants". BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose. The purpose of these amendments is to require that, prior to the issuance of a license, the criminal histories of all peddlers and solicitors, and those that assist them, be fully vetted by the New York State Division of Criminal Justice Services and the Police Department so as to protect the health, safety, and welfare of the community. II. Chapter 197 of the Code of the Town of Southold is hereby amended as follows: 4 197-6. Application for license. Any person desiring a license under this chapter shall first register with the Town Clerk of the Town of Southold and shall file with said Town Clerk an application, in writing, containing the following information: Southold Town Regular Board Meeting June 14, 2016 page 50 A. The name of the applicant. B. The applicants permanent home residence. C. The name, address and telephone number of the person from whom goods making the stock, if any,were or are to be purchased. D. Three bona fide business references. E. The place or places of residence of the applicant for the previous preceding three years. F. Two recent photographs of the applicant, approximately 2 1/2 inches by 2 1/2 inches in size. [Amended 6-30-2015 by L.L.No. 5-2015] G. A description of the goods, wares or merchandise to be sold and offered for sale and/or the purpose of his proposed canvassing or solicitation. H. The length of time for which the license is required and registration is to be effective. I. Details of any arrests or convictions for misdemeanors and crimes, including the nature of the offense for which arrested or convicted, the date of conviction and the place where said conviction was had. J. To said application and as a part thereof,there shall be attached a letter from the firm or corporation for which the applicant works, authorizing the applicant to act as its representative. K. A statement by a reputable physician, dated not more than 10 days prior to the submission of the application, certifying the applicant to be free of contagious infections or contagious diseases. L. An authorization certification from the New York Sales Tax Bureau. M. In the event that any other license or permit shall be required by any other governmental agency in connection with the applicant's business, it shall be produced by the applicant, and a copy of same shall be submitted with the application. [Added 6-30-2015 by L.L. No. 5-2015] N. Where a person enlists the assistance of another person whether as an employee~ agent, or contractor, to peddle, solicit, or operate a transient retail business, all applicable personal information specified above shall be required to be given for each person, and an individual license shall be required and issued to every such person.No license issued under this article shall be transferable from one person to another. 197-7. Investigation of applicant. A. Each application shall be referred to the Police Department, which shall, without delay, institute such investigation of the applicant's business and moral character as it deems necessary for the protection of the public good and complete the same within a reasonable time. The Police Chief, or his designee, shall cause the fingerprints of any applicant for a peddling or soliciting license, and any applicable fee payable by the applicant, to be forwarded to the Division of Criminal Justice Services (DCJS) in the form and manner as prescribed by DCJS for a complete criminal background and investigation. The Police Chief, or his designee shall review the criminal history record information disseminated by DCJS in connection with the applicant's criminal background and Investigation. D. In making the determination of the applicant's fitness for the requested license, the Police Chief, or his designee shall give due consideration to the information provided by DCJS, New York State Correction Law §§ 701 through 703b and §§ 751 through 753. III. SEVERABILITY If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. That is really the only change the rest of this is changes to existing to allow for that to happen. A full copy of this has been published, I have an affidavit here that the notice was printed and it has been affixed to the Town Clerk's bulletin board. And I also have a copy of the notice in the Suffolk Times on June 9, 2016 and that is it. Supervisor Russell SUPERVISOR RUSSELL: Would anyone like to address the Town Board on this local law? Just as a clarification, this isn't new, actually this is simply transferring responsibility of the background checks from Suffolk County to Southold Town. This isn't something that the town just dreamed up that we just started needing. No, what happened was that we are assuming that responsibility to make sure it gets done. This hearing was closed at 5:03 PM Closing Comments Supervisor Russell SUPERVISOR RUSSELL: That completes the agenda. Would anybody like to address the Town Board on any issue? Dean Sambach, New Suffolk DEAN SAMBACH: Dean Sambach, New Suffolk. I was watching on TV and the gentleman from Southold was talking about the trees. SUPERVISOR RUSSELL: Yes. MR. SAMBACH: Have you made a law to protect trees because that's a part of the North Fork as, you know, wineries or.... Southold Town Regular Board Meeting June 14, 2016 page 52 SUPERVISOR RUSSELL: No, what he had asked for,is we consider a law and that's what we are doing now. I suspect we will have a code committee meeting in the near future but as I explained to him, I don't think it's going to be a simple as simply taking legislation or code from another village somewhere that says you can't cut down trees without permission. We are trying to look for some reasonable standard, so that people get full use of their property but recognize that maybe severing every tree has an impact on the community, particularly stormwater runoff. So that's what we are looking at now. MR. SAMBACH: Yeah, because I just think like in New Suffolk if everybody wanted to cut down trees, it would destroy the neighborhood. Yeah, to protect them. And with the workforce housing, save that for July? I see there is a hearing then. Don't bring it up now? SUPERVISOR RUSSELL: We, no, no, by all means, feel free to bring it up now what it is, we had a public hearing on it, we made revisions that would be considered substantial, so we are required to re-notice it and have another public hearing. But feel free. MR. SAMBACH: Just one quick thing on it. Can you have pictures of possibilities of what this will look like? SUPERVISOR RUSSELL: Artists renderings. MR. SAMBACH: Yeah. SUPERVISOR RUSSELL: In any instance where the town is going to vote to layer an AHD over existing property, we already have to have approved that project. That would be subject to a public hearing and that's where artists renderings and etc. would be presented to the public. MR. SAMBACH: Okay, because somebody like me, a picture you know.... SUPERVISOR RUSSELL: Yes, I would agree 100 percent. Actually there's one being built in Sandy Hollow Southampton that I think if people saw the structure itself, they would be amazed at how nice it is. it's a Georgian colonial that fits right in with the community. But again, that won't be done, it's not a matter of right in a traditional context, it would be as-of-right after we have the public hearing on a rezone. MR. SAMBACH: Okay. And just the aggregate, that was from the streets, you are putting that up for bid? You can't use it that again? No? SUPERVISOR RUSSELL: I am going to defer to Mr. Ruland. COUNCILMAN RULAND: We can't. It can be used for fill but DEC won't let you reuse it. MR. SAMBACH: Okay. That's it. SUPERVISOR RUSSELL: Thanks Dean. Would anybody else like to address the Town Board? Southold Town Regular Board Meeting June 14, 2016 page 53 Bill Shipman, Cutchogue BILL SHIPMAN: Bill Shipman, Cutchogue. I have a couple of questions regarding enforcement in the Route 48 area near Vineyard 48. AS of this month, there's been two alcohol overdose calls at that particular location. On May 22 and June 5, so I'm, it kind of baffles me that at 30 some odd other wineries across the North Fork we don't experience alcohol overdose calls but at that particular place probably over the last 3 to 4 years, you are experiencing almost 20 alcohol overdose calls at that one location. I was just wondering if any notification has been made to the state liquor authority regarding this since it has been addressed before? SUPERVISOR RUSSELL: Oh, absolutely. In fact, every infraction gets forwarded to the state liquor authority, including the recent issue that your wife Beth had raised which was the opening of the cigar bar which we took immediate action, we closed it down. And then we forward that, all issues to the state liquor authority as a matter of policy. MR. SHIPMAN: But that cigar bar was supposed to be closed last year. SUPERVISOR RUSSELL: Well, it's closed now. MR. SHIPMAN: Under the agreement. SUPERVISOR RUSSELL: Yes, it's closed now. MR. SHIPMAN: I did notice that. And about the traffic in the area that we have been trying to address since 2012, obviously channel 7 News sat at that location and filmed 8 to 10 limousines and our busses attempting the same u-turn, failing to accomplish that turn and do you agree with me now that there's a SUPERVISOR RUSSELL: Oh, I don't think we have ever disagreed with you, Bill, I think you are misrepresenting our view. You need to understand and I think you do, that that's a county road. Any effort to change that signal to a 5 phase, to a you know, green arrow, would need the Suffolk County Department of Public Works and the Suffolk County legislature to probably make that happen for you. MR. SHIPMAN: I am not talking about the signal, the signal is pretty much useless anyway. I was talking about the traffic violations that are occurring . SUPERVISOR RUSSELL: I am pretty sure the Chief covers it as best he can. Given the manpower. MR. SHIPMAN: Right but I have been asking since 2012. SUPERVISOR RUSSELL: And it's been covered longer than that. We have brought patrols there as much as we can, given we have a town that's very large with a lot of dangerous intersections. So they try to bring attention to all of them. Southold Town Regular Board Meeting June 14, 2016 page 54 MR. SHIPMAN: Right. I am not the best manager of things but usually if you do enforcement and we have discussed this before, in a particular area for a short time, usually the limo drivers, since they are repeat drivers to that location, are going to get tired of getting a ticket and they are not going to do that anymore. COUNCILMAN GHOSIO: I saw the police posted there just this past weekend. Just down from there, watching what was going on. MR. SHIPMAN: Right. But the weekend channel 7 News filmed, there was two highway patrol cars in that area. So I am wondering, I understand somebody might miss something but they sat there for three hours and that's what they came up with. And I have been coming here ten times a year, eight times a year, to address that same thing. So with the cigar bar also, I came here in March and I told you, this is happening. People told me that it was shuttered, people told me they hadn't seen it open. Well, I had to go out on my own, I had to get my own evidence, I had to present that to the news media and they put it in the news and then action takes. So maybe if you listened to a little input from people and then take that input, it might be a little more productive and then people like me maybe don't have to come here. SUPERVISOR RUSSELL: Actually, the cigar bar was closed for a while. They more or less violated the spirit of the ongoing discussion and the settlement. We went out, Beth had posted it on Facebook and we heard about it, we took immediate action to close it down again. But with regard to your own enforcement, what you need to do is bring those to us, we can't cover it, people say well, why should I be code enforcement. You shouldn't be but it's a large town with a lot of violations, so we take all those violations and we act on them. MR. SHIPMAN: Okay. SUPERVISOR RUSSELL: You told me at a Board meeting about a week before that, I saw her post the receipt on Facebook and we took action. MR. SHIPMAN: I know that but these are the same things that I have been complaining about. Yeah, they might have violated your agreement, whatever term you put, towards it but that agreement was violated last year. People have stopped complaining about certain things because at times, nothing is being done and I understand you, like you said, you work with limited resources and whatever but we are telling you, for an extended time that this has been happening. It makes me feel that either I have to track down and present my own evidence to make somebody help me or Newsday has to go and film what's happening, what I have been saying what is happening. SUPERVISOR RUSSELL: With regard to what? The turns or the cigar bar? MR. SHIPMAN: The attempted... SUPERVISOR RUSSELL: The turns? Southold Town Regular Board Meeting June 14, 2016 page 55 MR. SHIPMAN: The turns. I have emails to you and the chief from 2012, saying that I took a picture of this happening. SUPERVISOR RUSSELL: And the chief sends patrols to cover it as best he can. It's a large town with a lot of dangerous intersections. It's not the only one. MR. SHIPMAN: I understand that but I wouldn't be coming back and asking you repeatedly over five years if it was being addressed. SUPERVISOR RUSSELL: And it was, it's just not to your satisfaction and unfortunately, we would love to address every intersection 24/7. Certainly for over the course of every weekend, we don't have the manpower to do that. We have explained it to you 100 times. I have bad intersections out in Greenport, I have them in other locations. We try to cover them as best we can, in addition to enforcing regular motor vehicle law which is speeding and everything else, drunk driving and all those other things. MR. SHIPMAN: Okay. Let's put it at this because I am tired of coming back and forth. I told you something was going to happen and it happened and then, I am telling you now, if it is still not addressed, something is going to happen again. I stated that in an email of August 12, 2012. That that was going to happen. So now, what I am asking you more or less, I am telling you that people in this community don't want that to happen again. So if News 7 is showing you that that particular thing is happening, which damn near was a photocopy of the traffic accident re- enactment, the limousine attempting to turn, not making the turn, backing up and being broadsided by a vehicle. So what I am telling you, as of two weeks ago, this still happens 8 to 10 times a day, in the same location, the same area. So what we are doing is we are asking you still for target enforcement in that particular area. SUPERVISOR RUSSELL: And we have been bringing it. MR. SHIPMAN: I understand that this is a big town and there are a lot of other problems but four people died because of the problems. Nobody listens. SUPERVISOR RUSSELL: Would anybody else like to address the Town Board? Robert Dunn, Peconic ROBERT DUNN: Robert Dunn, Peconic. Over the last week, I have been speaking with the Supervisor and emailing regarding something that seems to have slipped through the cracks and I believe that if it is not addressed and I don't mean this funny like but I could be here in the same mood as Mr. Shipman is now. There's been an RV appearing at one of the beach parking lots. I mean, it's 40 feet long. I was kind of surprised. I went out and looked at it, it's got a beach parking sticker and it seems that our beach parking rules allow for the registration of a registered motor vehicle and that's the only qualification. So the vehicle has a legal sticker now. It seems to me, when you have cracks like that, and I have said this before, you leave a crack there and I am a little cynical given where I grew up, a snake will crawl through it. And the gentleman who owns the RV is very nice, he comes down and fishes every day and he goes home but sooner or Southold Town Regular Board Meeting June 14, 2016 page 56 later, somebody is going to be bringing an RV and staying on the beaches overnight, whether it's at Goldsmiths or Town Beach or any of the other beaches. You need to address this now, under that rule that it's registered motor vehicle. That would include a bus. So if somebody in the town owned a bus, they could drive the bus to the beach. Who knows what it could lead to? This is a hole in our system that needs to be addressed. SUPERVISOR RUSSELL: I would agree. I would say from a basic level we can't accommodate those type vehicles. We have difficulty accommodating cars with trailers as it is and they are not as long as some of those RV's. It's a glitch in the code, I forwarded that section to you, it's something I think we need to close. We just can't accommodate, we don't have the infrastructure to accommodate RV's at our beaches. MR. DUNN: Well, as it reads, it would include trucks, you know, anything that's registered as a motor vehicle. It's just too broad. Well, we have answered that one. I hope it gets addressed. SUPERVISOR RUSSELL: I agree. MR. DUNN: If it doesn't, I am sure, you know, growing up in the city, I am probably more cynical than you guys that spent all or most of your lives out here and I grew up in a wonderful place as a child. It just decayed. I mean, I learned to shoot a gun in Times Square. Honestly. You were able to go to an arcade and pick up a 22 and shoot ducks on a chain. My father would take me there, there were just these things that, they decayed. And by the 70's it was hard and it's because of things that slipped through the cracks that that's allowed to happen. You don't want or I don't believe, anybody wants to see that happen here. I don't believe anybody wants to see any more Mr. Shipmans'. As I had mentioned at the last meeting, I have a seasonal job driving out here and I find that our police are very efficient. If you are driving 2, 3 in the morning, you can get stopped regularly. It is very easy to slip, so I have learned a lot about the rules driving here because I was stopped a few times. Normally they, honestly, they are really just checking at 3:00 in the morning to see who is sober and who is not. In any case, do you know what the speed limit is in this town on the Main Road? SUPERVISOR RUSSELL: On the Main Road? It varies, 55, 45. MR. DUNN: 20, 25, 30, 35, 40, 45, 50, 55. That's a little neurotic. It's a little hard for an officer, it's a little hard for the public. Why not just have two? 30 and 45. Bingo. I mean, if you drove our whole town from one end to the other, 25 miles? If the difference between 45 and 55 might take you six minutes, the hamlets be 30, outside the hamlets, it's just confusing. You know, I made it a point to learn what it is. There actually, I haven't seen anything that's marked 55 but there's one section in Cutchogue, Mattituck that doesn't have any signs for a long period, so I inquired and most of the officers that I asked all agreed 55 would be appropriate. It just seems to me that that's a little neurotic with speed limits all over the place. That's something to be thought about. COUNCILWOMAN DOHERTY: That's the state highway, so.... Southold Town Regular Board Meeting June 14, 2016 page 57 MR. DUNN: Well, we control the speed limits, don't we? COUNCILWOMAN DOHERTY: No, we don't. Like for instance, the 20 miles an hour in front of Mattituck High School, we asked... MR. DUNN: Twenty miles an hour in front of a school is (inaudible). COUNCILWOMAN DOHERTY: Right. But it's not the same as the Cutchogue School and we asked the state to make them both the same. Whether they are 20 or both 30, make them the same and make them uniform and they won't change them. So we don't have too much pull on that. SUPERVISOR RUSSELL: We can make requests but then that's the extent of our authority, to make requests to the New York State DOT, they usually will send engineers out to evaluate the request and sometimes they act on it, most times they don't. MR. DUNN: So we accept their government then. SUPERVISOR RUSSELL: Well, you know what? We wage war with New York State all the time and we have to pick our battles and right now, our focus is the DEC. MR. DUNN: Okay. Okay, no, you guys know best on that. And now I am going to talk about something that's really uncomfortable for me. Bad government. PSEG put in some pipes on 48 and at one point they crossed Mill Lane. They dug a hole, put a pipe through, filled the hole, did a horrible job patching it. There's a pot hole. So I called the highway department and I was told our highway Supervisor if busy and I need to call PSEG or the county and I said, no, I don't need to call PSEG and the county and if you want to find out why, watch channel 22, because I am going to be talking about that. What I need to do in this town is two things. Pay my taxes and vote. I pay my taxes and I do vote and I don't need to be told that I need to follow up with other agencies to correct inequities on our roads. Bye bye. Subsequent to that call, oddly enough, I got a cracked windshield, chipped windshield driving on 48, where Suffolk County Water Authority put in a pipe. They didn't clean up anything there. It's like a dirt track and I am sure it will be on the Main Road when they finish, how do we feel about that? I mean, if the public has to take care of these things than maybe we need to move some budget and some responsibility away from this department if he's too busy to take care of this sort of thing or I was just going to say it's not our job, I don't, you know what I am saying. SUPERVISOR RUSSELL: Oh, I agree 100 percent and frankly, I guess it's a style of how you do your job but what I think in every instance, whether it's within the scope of their scope of responsibility or not, given that it's a related issue, they should be making a call for you and reporting back to you. If there is a party... MR. DUNN: That's the way I see it. I don't think the town ought to be out repairing things... Southold Town Regular Board Meeting June 14, 2016 page 58 SUPERVISOR RUSSELL: Right. But to make a phone call on your behalf is more than reasonable. MR. DUNN: That contractors do or that somebody else did, again, referring to the city, I know in the city when you make a cut in the street, you are required to put a little patch on the street so it's identified forever as to who did that. I don't believe that the town should have the responsibility to go in and repair things that people should have done right in the first place but I think it's the town's responsibility to make sure that these things are done correctly,s o they don't have to repair it five months or five years down the road and to suggest to a resident that they have got to do it?
