SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SLTFFOLK COUNTY ADMINISTRATNE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated May 23, 2016, stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency '
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT
from Coastal Consistency Review.
PROPERTY FACTS/DESCRIPTION: The applicant's property is an irregularly shaped 10,219 sq. ft. parcel in the
HB Zone. The parcel has +/- 108 feet o frontage on Main Road Route 25 in the center of downtown Mattituck, and
is adjacent to other parcels in the HB Zone. Historically, the parcel was improved with a 2 story principal
structure and a smaller lstory accessory apartment structure. Both structures were constructed before the
introduction of zoning code in 1957. In 2014 the principal structure was destroyed by fire, and subsequently
demolished, leaving only the accessory structure on the site, as shown on the sui-vey drawn by Peconic Surveyors,
P.C. and dated Jan. 18,2016.
BASIS OF APPLICATION: Request for Variance from Article X, Section 280-45A & C (2) and the Building
Inspector's March 22, 2016 Notice of Disapproval based on an application for building permit to maintain an as
built accessory apartment, 1) existing apartment without a principal use building.
RELIEF REQUESTED: The applicant requests a variance in order to establish a legal apartment on the property
where there is no principal use, because as described in Southold Zoning code, and noted on the NOD, an
apartment, solely in and of itself, is not a principal use, but is considered to be an accessory use only, and must
always be accompanied by a permitted principal use.

ADDITIONAL INFORMATION: An adjacent neighbor, the North Fork Environmental Council submitted a letter
dated July 6, 2016, in which they state objections to the applicant's request for the grant of the variance. In the
past,the property was the subject of three variance appeals,two for commercial signs, and one for a radio tower.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on July 7, 2016, at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and
surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law �267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The requested variance, if granted, will
alter the essential character of the neighborhood. Although this Board is mindful of the loss of the principal use
because of an unfortunate fire, a stand-alone accessory apartment is not characteristic in this neighborhood, or in
the HB zone, or in any zone within the Town.
2. Town Law �267-b(3)(b)(21. The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant could establish a principal use within the
existing building. The applicant could construct a new building to replace the one destroyed by fire in 2014. The
applicant could conceivably merge the parcel with the adjacent parcel that he owns, and establish a principal use.
3. Town Law �267-b(3)(b)(3). The variance requested herein is mathematically substantial, representing 100%
relief from the code. Zoning Code requires that a principal use be established on any property situated within
Southold Town, before an accessory use such as an apartment, garage, shed, or swimming pool can be constructed
on the same property. An accessory use is always considered to be customary and incidental to an existing
principal use.
4. Town Law &267-b(3)(b)(4) Evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
adjacent property owners submitted written comments and testimony at the hearing that the applicant has not
presented a long term plan for the future re-development of the subject property and therefore the granting of any
variance at this time cannot be accurately evaluated as to the possible detriments to nearby properties and the
character of the hamlet.
5. Town Law �267-b(3)(b)(5). The difficulty has been self-created.The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law �267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of a permitted use of his property, while preserving and protecting the character
of the neighborhood and the health, safety and welfare of the community.

Board are that applicant has located the structure as
appropriately as possible. The Board agrees with the
reasoning of the applicant.
The Board finds that strict application of the Ordinance

After investigation and inspection the Board finds that the zONING BOARU OFAPI��AL�
applicant wiahes to have permission for a second wall sign on his
property. The findings of the board are that the applicant's property
is located on a bend on Route 25 in Mattituck and really requires more
than one waii siqn for proper identification. In discussing this with
the applicant we find he is agreeable to removing many of the window
signs which we hope will be accomplished.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the immediate vicinity of the property and in the same use district; and
the varianae will not change the character of the neighbarhood and will
observe the spirit of the Ordinance.
On motion by Mr. Tuthill, seconded by Mr. Gillispie, it was
RESOLVED that Grabie-Scudder Appliances, Inc. , Main Road (S. R.

The North Fork Environmental Council (NFEC) is the immediate westerly neighbor of the property in
question and wishes to express its concerns regarding the application for variance.
Over the past year, the hamlet of Mattituck has seen a number of real estate related applications
before the various Town boards, departments and committees, including applications for variance,
zoning changes, etc. What many of these applications have in common is that they have been
presented to the Town by applicants who have said that they are doing so without any clear plans for
the property. Such is the case here.
In a letter sent to neighboring properties dated June 15, 2016, the applicants state: "We have not yet
decided what our long-term plans for the property will be..."And yet, this application is asking the
Town to grant what amounts to a long-term, permanent variance to the property and its use. How can
the NFEC, other neighbors and interested parties, including the ZBA and the Town, determine the
long-term impact of such a variance if neither the applicant nor those affected have a clear idea what
are the Iong-term plans for this property? Simply put, no one can.
To grant a variance under such circumstances would set a bad precedence and the NFEC asks the
ZBA to deny the application until such time that the applicant presents a complete, comprehensive
and reviewable plan to the Town for consideration.
An accessory apartment has a specific purpose and the owner must need specific health, safety and
occupancy conditions. If a variance is granted and accessory status is permitted without a main
structure, what specific conditions no longer have meaning or merit? Owner occupancy? Minimum
square footage? The building of additional accessory units? Occupancy of other units by people not
on the affordable housing registry or who would qualify to be on the affordable housing registry?
Without a proper, comprehensive and clear long-term plan, how can we or the Town address these
and other issues?

Another concern is that the applicants also stated in the above referenced letter the following: "Should
the Zoning Board grant our application, we intend to make no visible changes to the property other
than to continue to clean up the grounds and maintain the premise in a manner that will do credit to
our immediate neighbors and the community at large."This is a noble goal but one which the applicant
has already violated in both letter and spirit and this concerns us for today and what may happen
down the road.
Soon after acquiring the property, the applicants erected a split rail fence on the property line, This
was done without consultation or notification of the neighboring properties. The fence blocked off the
driveway to the applicants' property which, for the past 20+years, has been a common point of
entrance and egress to Route 25/Main Road for BOTH the NFEC and Liberty Data properties and its
owners, employees, residents, customers and visitors,just as the NFEC's driveway has served the
same purpose for both properties over those years. The erection of the fence has created a safety
issue as people coming into and leaving the NFEC property no longer have the long-held option of
using the whichever driveway which was safest on this dangerous curve. So this change has had a
negative effect on the applicants' immediate neighbors and the community at large.
With these issues, the NFEC is concerned what the future holds for this property, for its neighbors and
for the community. And without proper and clear long-term plans which can be discussed and
evaluated in the proper channels, the NFEC asks that any application for a variance or other short-
term wants, not needs, be denied at this time.

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of The Suffolk Times.
1) Before June 2ptn:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arrangements were made in either a written statement, or durinq the
hearinq, providinq the returned letter to us as soon as possible;
AND not later than June 27th: Please either mail or deliver to our office your Affidavit of
Mailin (form enclosed) with parcel numbers, names and addresses noted, along with the
green/white receipts postmarked by the Post Office. When the green signature cards are
returned to you later by the Post Office, please mail or deliver them to us before the scheduled
hearing. If any envelope is returned "undeliverable", please advise this office as soon as
possible. If any signature card is not returned, please advise the Board during the hearing and
provide the card (when available). These will be kept in the permanent record as proof of all
Notices.
2) Not Later June 29th: Please make arrangements to place the enclosed Poster on a
signboard such as cardboard, plywood or other material, posting it at the subject property seven
(7) days (or more) prior to hearing. (It is the applicant/agents responsibility to maintain sign
until Public Hearing) Securely place the sign on your property facing the street, not more than
10 feet from the front property line bordering the street. If you border more than one street or
roadway, an extra sign is supplied for posting on both front yards. Please deliver or mail your
