SUFFOLK COUNTY ADMINISTRATNE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 23, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. - LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 12,901 square foot parcel located in an R-40 Zoning District. The parcel has 80 feet of frontage on Knapp Place and measures 171.79 feet along the westerly property line , 72 feet along the northerly property line, and 170.41 feet along the easterly property line. The parcel is improved with a two story single family dwelling and a detached frame garage all of which shown on a plot plan prepared by Barrett,Bonacci, and Van Weele, Civil Engineers, last revised Apri126, 2016.. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-124 and the Building Inspector's April 27, 2016 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling at; 1) less than the code required minimum side yard setback of 10 feet, located at: 205 Knapp Place, (aka 326 Knapp Place) Greenport,NY. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to a single family dwelling that include a second story addition over the first floor footprint that will result in a non-conforming side yard setback of+/- .5 feet where 10 feet is required. ADDITIONAL INFORMATION: The Board received two letters of support from the applicant's neighbors. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and Page 2,July 21,2016 Acri,#6966 SCTM No. 1000-34-2-18.1 sui-��ounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law �267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes comparable in size to the applicant's proposed construction. The applicants are maintaining their existing non- conforming side yard setback. The second floor addition will be built directly above the first floor. The proposed deck addition will be located farther from the current non-conforming side yard setback than the house. 2. Town Law �267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing structure is set back+/- .5 feet from the side property line. Any additions, alterations, or expansion,will require the benefit of an area variance. 3. Town Law �267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 95% relief from the code. However, the proposed additions and alterations to the dwelling will not result in any changes to the footprint of the dwelling and the adjacent dwelling to the east is separated from the applicant's property by a wide driveway which mitigates the impact of the non-conforming side yard. Additionally, the .5 ft. setback increases toward the southerly(front yard) property line since the house is sited askew to the side property line. The proposed deck is setback at 5.5 ft. from the side yard line, which is a greater setback than the existing dwelling. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created: The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law �267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck and second story addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the site plan prepared by Barrett, Bonacci, and Van Weele, Civil Engineers, last revised Apri126,2016, and the building plan prepared by Meryl Kramer,Architect, labeled A- 200 and A-100 and dated April 8, 2016, (Disapproval date April 20, 2016) Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the ZoningBoard ofAppeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. The granting of the requested relief from Article XXIIi, Section 280-124 for the proposed dwelling renovation and expansion less than 10 feet from the property line will not have an undesirable impact on the character of the neighborhood because the surrounding community is characterized by dwellings which are located closer to the property line than 10 feet, including those like the applicants' which were constructed prior to when the Zoning Code was instituted. Although the applicants' "Notice of Disapproval" dated April 27th, 2016 references a notably closer side yard setback, it is important to recognize that this is not a newly proposed setback to the dwelling addition but rather the preexisting nonconforming setback of the existing house that will be maintained by the proposed project. Specifically, the second floor addition will be built directly above the existing first floor located at the nearest point .5 feet from the property line. The proposed deck addition will be located farther from the property line than the house due to the position of the house not being parallel to the property lines. The relief, therefore, would not result in a detriment to neighboring properties because the project results in the second floor addition to the existing two-story dwelling and attached deck with expansion only within the existing footprint of the house and and not increasing the proximity to either of the adjoining properties. 2. The benefit sought by the applicant is the expansion and improvement of the existing dwelling, including(kitchen, bedrooms, bathrooms, etc.) and the upgrading of inferior construction to meet current energy and building codes. Achieving this benefit requires the second floor addition to the existing dwelling, which is located less than 10 feet from the property line; and although the proposed dwelling expansion has been designed within the existing footprint of the house, the existing dwelling location makes it impossible to locate the proposed construction more than 10 feet from the property line. The benefits of remaining within the building footprint and maintaining and reusing the first floor construction and foundation are financial and sustainable from a material conservation standpoint. Therefore,the proposed layout requiring the requested side yard setback relief is the most feasible and reasonable alternative for the applicants to achieve their goals. 3.
