SUFFOLK COLJNTY ADMINISTRATIVE CODE: Pursuant to the Suffolk County Administrative Code Sections A 14-14 to 23, referral of this application to the Suffolk County Department of Planning is not required. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is 29,033 square feet located in the R-40 Zoning District improved with a two story single family dwelling, a detached stucco garage and stucco shed. The parcel fronts Sound $each Drive to the north for 100 feet and has a second front yard along Summit Drive to the South for 120.06 feet. The adjoining property line to the East is 266.84 feet and the adjoining property line to the West is 261.58. The parcel is accessed via a 20 foot right of way (R.O.W) from Summit Drive. There is no improved access from Sound Beach Drive. Approximately half of the parcel (southern portion) is at elevation 100+/- (where the improvements are constructed and proposed) and the remainder has a steep down slope to Sound Beach Drive at an elevation of 20+/-, all of which shown on the survey/Site Plan prepared by Nathan Taft Corwin III, L.S. dated May 21, 2003, last revised March 15, 2016 "Revise House Location". BASIS OF APPLICATION: Request for Variances from Article III Section 280-15 and the Building Inspector's February 23, 2016 Amended March 24, 2016 Notice of Disapproval based on an application for building permit to . demolish existing dwelling and construct a new single family dwelling and a new accessory in-ground swimming pool, at; 1) proposed accessory in-ground swimming pool in location other than the code required rear yard or front yard on waterfront property, 2)proposed dwelling results in existing accessory shed in location other than rear yard or front yard on water front properties, located at 1790 Central Drive (Summit Drive), Mattituck, NY SCTM # 1000-106-1-30.2 RELIEF REOUESTED: The applicant requests.variances to; 1) locate a proposed in-ground swimming pool in a front yard where the code requires a rear yard location and 2)maintain the location of an existing stucco accessory shed which will be located partially in a side yard upon completion of new proposed dwelling, where the code requires a rear yard location. ADDITIONAL INFORMATION: The adjoining parcels to the East and West have similar topographies and both have an in-ground swimming pool in a front yard location(front yard to Sound Beach Drive). The existing stucco accessory shed, relative to the existing dwelling which is proposed for demolition, appears to exist partially in a side yard location. FIIVDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law �267-b(3)(b)(11. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are common accessory structures to residential properties and the adjoining parcels to the East and West both have an in-ground swimming pool in a location similar to what the applicant proposes. The subject accessory stucco shed presently exists in its location without evidence of detriment to nearby properties. 2. Town Law �267-b(3)(b)(2). The benefit sought by the applicant to construct an in-ground swimming pool cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The parcel is subject to two front yards and there is no rear yard to construct an in-ground swimming pool in a conforming location. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Placing the accessory structure in a code conforming location cannot be achieved since there is no rear yard. 3. Town Law &267-b(3)(b)(3). The variance granted herein to locate an in-ground swimming pool in a front yard location is mathematically substantial, representing 100% relief from the code. However, the subject parcel has no conforming rear yard in which to locate accessory structures and the two adjoining parcels, both similarly subject to two front yards, each have in-ground swimming pools in a front yard location. The variance granted herein to locate a stucco accessory shed partially in a side yard is mathematically substantial, representing 100% relief from the code. However, the existing stucco shed appears to presently exist partially in a side yard location and to continue this partial side yard location is not substantial. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must coinply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law �267-b(3)(b)(�. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law �267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool and existing shed location, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Geohringer, and duly carried,to Page 3, July 21, 2016 Livanos, #6965 SCTM No. 1000-106-1-30.2 GRANT the variances as applied for, and as shown on the Survey/Site Plan prepared by Nathan Taft Corwin III, L.S. dated May 21, 2003, last revised March 15, 2016 "Revise House Location". , SUBJECT TO THE FOLLOWING CONDITIONS: 1. Installation of a de watering dry well large enough to accommodate the discharge of pool water. 2. All pool equipment must be placed in a sound proof structure. That the above conditions be written into the Building Inspector's Certifrcate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board ofAppeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar desigrz that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. Your request was not done in a timely matter pursuant to Section 280-146(B) of the Southold Town Code and cited in the Determination, which reads, "Pursuant to the Code of the Town(280-146B) any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured within three (3)years from decision date. A final inspection was conducted by Building Inspector John Jarski on November 15, 2024. During this inspection, it was noted that a handrail needs to be installed on the exterior basement stairs. All other requirements for the CO, including a passed electrical inspection and final Health Department approval, have been met. Currently, my client is actively working on the installation of the handrail, which is expected to be completed promptly. Once this task is finished, no further building department requirements will remain, aside from the necessity of obtaining an extension to the ZBA decision. The reason stated by the Buiiding lnspector in the denial is that the pool is proposed in a front yard instead af the code-required rear yard_ FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence,the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RE�IEF REQUE5TED: The applicants wish to construcf a swimming pool behind their home in a front yard area 196 feet from Sound Beach Drive and at least 15 feet from the wesferly side fot fine as shown on the February 13,2006 site map prepared by Proper-T Permit Services. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties for the proposed swimming pool in a front yard location. The lot has technically two front yards, owing to the fact that the rear boundary line is a road. The road is neaw�y 200 feet behind the pool and is at the base of a steep slope. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, ottter than an area variance The proposed location for the new swimming pool is behind the house and close to it.
