This Indenture, made the 4th day of March, Two Thousand and
Sixteen,
BETWEEN
ROBERT F. RARSCH, residing at 1390 Country Club Drive,
Cutchogue, New York 11935, as surviving spouse, party of the
first part, and
ROBERT F. RARSCH, as Trustee of THE ROBERT F. RARSCH
REVOCABLE TRUST, under agreement dated March 4, 2016, with an
address at 1390 Country Club Drive, Cutchogue, New York
11935; party of the second part,
WITNESSETH, that the party of the first part, in
consideration of Zero Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns of the party
TAX MAP of the second part forever, all of the party of the first
DESIGNATION part's interest in
District ALL that certain piece or parcel of real property, with the
buildings and improvements thereon erected, situate, lying
1000 and being at Cutchogue, Town of Southold, County of Suffolk
Section and State of New York, known by and designated as Lot No. 20
on a certain map entitled "Map of Country Club Estates" and
109.00 filed in the Office of the Clerk of the County of Suffolk on
10/17/78 as Map. No 6736, said lot being bounded and
Block described as follows:
03.00 BEGINNING at a point on the westerly side of Country Club
Drive where the same is intersected by the dividing line
I'ot(s) between lots 19 and 20 as shown on the aforementioned map;
RUNNING THENCE South 76 degrees 55 minutes 50 seconds West
002.015 249.33 feet; THENCE North 25 degrees 50 minutes 00 seconds
West 118.61 feet; THENCE North 59 degrees 04 minutes 30
seconds East 253.71 feet to the westerly side of Country Club
Drive; THENCE along the westerly side of Country Club Drive
the following (3) courses and distances: (1) South 30
degrees 55 minutes 30 seconds East 26.17 feet; (2) Southerly
along the arc of a curve bearing to the right, having a
radius of 540.00 feet, a length of 168.28 feet; and (3) South
13 degrees 04 minutes 10 seconds East 3.00 feet to the point
or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the
party of the first part by Deed dated May 14, 2004 and
recorded in the Suffolk County Clerk's Office on May 27, 2004
in Liber D00012321 at Page 609, the Grantor being the same
person described as the Grantee in said Deed.
Together with all right, title and interest, if any, of the
party of the first part in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
Together with the appurtenances and all the estate and rights
of the party of the first part in and to said premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and assigns
of the party of the second part forever.
And the party of the first part covenants that the party of
the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,
except as aforesaid.
And the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and
will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost
of improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the
total of the same for any other purpose. The word "party"
shall be construed as if it read "parties" whenever the sense
of this indenture so requires.
In Witness Whereof, the party of the first part has duly
executed this Deed the day and year first above written.
